Mr. CORZINE introduced the following bill; which was read twice and referred to the Committee on Environment and Public Works A BILL To amend title 23, United States Code, to provide for a prohibition on use of mobile telephones while operating a motor vehicle.
    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
    This Act may be cited as the `Mobile Telephone Driving Safety Act of 2003'.
SEC 2. MOBILE TELEPHONE USE WHILE OPERATING MOTOR VEHICLES.
    (a) IN GENERAL- Subchapter I of chapter 1 of title 23, United States Code, is amended by adding at the end the following:

Executive Summary
Introduction
Alcohol abuse and alcohol-related problems remain a major public health issue. Drink driving is one alcohol-related problem that has gained much attention over recent years. The magnitude of the drink driving problem is often shown using crash data. Approximately one-third of all fatal road crashes, where the driver had been tested for alcohol, were associated with blood alcohol concentrations above the legal limit. Road trauma, unlicensed driving and recidivist offending place additional financial and legal burdens on communities and reinforce the need to establish effective drink driving interventions.
Defining the Drink Driver
Drink driving has consistently been shown to be associated with a range of risk factors.
  • Male, young age, low socio-economic background Problems with alcohol consumption and high levels of alcohol use Poor knowledge and deviant attitudes toward drink driving Extensive histories of criminal and traffic convictions
Drink Driving and the Social Context

Those who are not in favor of motherhood, baseball and apple pie, please raise your hands. Nope, I'm not seeing a lot of hands go up there in cyberland. (By the way, our hidden cameras allow us to see each and every one of you 24 hours a day. You knew that, didn't you?)
Now those of you who are dead-set against auto safety, please raise your hand. Oh my, still very few hands being raised. You see what we're getting at here. The fact of the matter is just about all of us, except for some random sociopaths, are strongly in favor of driving safety. But just how strongly that feeling goes was revealed recently by a Louis Harris poll commissioned by Advocates for Highway and Auto Safety, an alliance of consumer, health, safety, insurance and law enforcement organizations. The study is the fourth independent Harris survey gauging the American public's views on crucial highway and vehicle safety concerns, and it showed a strong desire for a number of safety-related initiatives, some of them controversial.
First, let's eyeball the problem. You might not realize this, but motor vehicle crashes are the leading cause of death of Americans aged one to 34. Over the past decade, highway deaths have been stuck at more than 40,000 annually, with a slight increase in 2000 versus 1999. Last year, 41,800 people were killed in highway crashes, up from 41,611 the year prior. While highway deaths in general held about steady, deaths of young drivers aged 16 to 20 years went up from 3,481 in 1999 to 3,570 in 2000, and rollover deaths of sport utility vehicle occupants rose from 1,898 in 1999 to 1,951 in 2000. This, of course, must be viewed in the context of the millions of drivers and passengers who travel on our roads and highways every day, which means your individual likelihood of being involved in a fatal accident are slim. Yet no one could call 40,000 deaths per year incidental.

Aggressive driving is defined as a progression of unlawful driving actions such as:
  • speeding exceeding the posted limit or driving too fast for conditions;
  • improper or excessive lane changing: failing to signal intent, failing to see that movement can be made safely, or
  • improper passing failing to signal intent, using an emergency lane to pass, or passing on the shoulder.
  • The "aggressive driver" fails to consider the human element involved. The anonymity of being behind the wheel gives aggressive drivers a false sense of control and power; therefore, they seldom take into account the consequences of their actions.
  • Aggressive Driving vs. Road Rage. There is a difference. Aggressive driving is a traffic offense; road rage is a criminal offense.
  • Road rage is defined as "an assault with a motor vehicle or other dangerous weapon by the operator or passenger(s) of another motor vehicle or an assualt precipitated by an incident that occurred on a roadway."
  • Road rage requires willful and wanton disregard for the safety of others.
  • A national survey sponsored by NHTSA of 6,000 drivers over the age of sixteen showed that the public supports increased enforcement including photo enforcement, increasing sanctions, increasing intervention by vehicle occupants and increasing public awareness of risks, as ways of reducing these types of unsafe driving practices.

CHAPTER 51 - TEXAS LABOR CODE
GENERAL
The purpose of the Texas Child Labor Law is to ensure that a child is not employed in an occupation or manner that is detrimental to the child's safety, health, or well-being. "Child" is defined as an individual under 18 years of age. Except as specifically authorized by the statute, it is illegal to employ a child under 14 years of age. One of the principal exemptions in the statute allows the Texas Workforce Commission (Commission) to adopt rules which authorize the employment of children under 14 years of age as performers in a motion picture or a theatrical, radio, or television production. Pursuant to that authority, the Commission has adopted Texas Commission Rule Section 817.31, which sets out the procedure for authorization of work by a child actor. These rules also contain provisions designed to ensure that employment does not interfere with a child's education and does not pose a threat to the child's health, safety, or general well-being. The Commission or its designee may, during working hours, inspect a place of business where there is good reason to believe a child is or has been employed within the last two years and collect information about the employment of children there. Knowingly or intentionally hindering such an investigation is a violation of the law.

1: Introduction
All members of the university who are authorized to drive university vehicles or otherwise operate a vehicle to conduct university business must operate vehicles in strict accordance with all Washington State and Pierce County laws. No work or errand is of sufficient importance to violate safe driving practices. Safe vehicle operation is the responsibility of all members of the PLU community while participating in all PLU business or activities.
1.1 Hazards
Traffic-related motor vehicle accidents are the leading cause of work-related injury death. According to the National Institute of Occupational Safety and Health, three workers die every day in vehicle crashes.
Vehicle accidents can happen at any time. In general, however, the PLU community experiences the most accidents after events that are physically tiring, during long trips, during bad weather, or in the late afternoon and evening hours. Parking accidents are also common.

    When operating a State vehicle it is important that the following guidelines be observed:
    • Use your seat belt. It is mandatory for all state employees to use seat belts in state fleet vehicles.
    • Follow cars at a safe distance.
    • Children 12 or younger, unless over five feet in height, must ride in the back seats of vehicles with air bags.
    • Eliminate any distractions. Pull off the road in a safe area to use cellular phones.
    • If you are feeling drowsy, it is best to pull over and take a break. Additional tips to help prevent you from becoming drowsy include: opening the windows; turning on the air; chewing gum or seeds; listening to the radio; or drinking a beverage with caffeine.
    • Never drink alcohol or use drugs and drive. Heed all prescription and over-the-counter drug warnings.
    • Always drive the speed limit, adjusting to road and weather conditions. Use your signals at all times.
