General Information Training Information Pro Bono Information Law Enforcement, Judges and Prosecutors Contact Information The Federal Violence Against Women Act (1994) was the first National legislation to specifically target Criminal Domestic Violence (CDV) and other abusive behaviors toward women. Through the Violence Against Women Act, a grant was established in the Department of Justice. The South Carolina Office of the Attorney General established the S.T.O.P. Violence Against Women program in 1996 with monies the VAWA grant provided. Within the program there is a Special Prosecutor, a Program Coordinator and a Technical Assistant. The primary goal of the S.T.O.P. program is to educate Law Enforcement, Judges and Prosecutors on CDV - its causes, consequences and laws pertaining thereto. Therefore, the Office of the Attorney General through the S.T.O.P. program hosts several trainings throughout the year and across the Palmetto State. Employees of the program quite regularly give speeches at other trainings or seminars in the state, as well.

October 4, 2004 MADIGAN, LAW ENFORCEMENT, VICTIM ADVOCATES ANNOUNCE INITIATIVE TO ARM DOMESTIC VIOLENCE VICTIMS WITH UPDATED INFORMATION OCTOBER OBSERVED AS NATIONAL DOMESTIC VIOLENCE AWARENESS MONTH Under the Illinois Domestic Violence Act, which was initially passed in 1982, law enforcement agencies are required to provide information to victims of domestic violence. The tear sheets, used by most law enforcement to provide the information, were last printed in 1995 and had become obsolete. For example, penalties for some domestic violence crimes have increased since 1995 and many of the phone numbers listed on the old tear sheet had been disconnected or changed. Madigan said the new tear sheet initiative was funded by a $35,000 grant awarded to her office by the Illinois Criminal Justice Information Authority. Madigan last month announced a new pilot program that allows the new Order of Protection Short Form Notification, or Short Form, to be served by any law enforcement officer in the state, reducing the likelihood that an abuser will successfully evade service. Once a domestic abuser has been served with the Short Form, he or she can be charged with violations of the Order of Protection in the event that the abuse continues. www.IllinoisAttorneyGeneral.gov/women

As domestic violence awareness has increased, it has become evident that abuse can occur within a number of relationships. The laws in many states cover incidents of violence occurring between married couples, as well as abuse of elders by family members, abuse between roommates, dating couples and those in lesbian and gay relationships. In an abusive relationship, the abuser may use a number of tactics other than physical violence in order to maintain power and control over his or her partner: Emotional and verbal abuse: Survivors of domestic violence recount stories of put-downs, public humiliation, name-calling, mind games and manipulation by their partners. Many say that the emotional abuse they have suffered has left the deepest scars. Isolation: It is common for an abuser to be extremely jealous, and insist that the victim not see her friends or family members. The resulting feeling of isolation may then be increased for the victim if she loses her job as a result of absenteeism or decreased productivity (which are often associated with people who are experiencing domestic violence).

Gender-based violence is a form of discrimination that seriously inhibits women's ability to enjoy rights and freedoms on a basis of equality with men. 2. In 1989, the Committee recommended that States should include in their reports information on violence and on measures introduced to deal with it (General recommendation 12, eighth session). 3. At its tenth session in 1991, it was decided to allocate part of the eleventh session to a discussion and study on article 6 and other articles of the Convention relating to violence towards women and the sexual harassment and exploitation of women. That subject was chosen in anticipation of the 1993 World Conference on Human Rights, convened by the General Assembly by its resolution 45/155 of 18 December 1990. 4. The Committee concluded that not all the reports of States parties adequately reflected the close connection between discrimination against women, gender-based violence, and violations of human rights and fundamental freedoms. The full implementation of the Convention required States to take positive measures to eliminate all forms of violence against women.

Domestic Violence and Healthcare Domestic violence is an important healthcare issue. Healthcare settings provide a safe entry point for victims of domestic violence. Healthcare providers have a unique opportunity to detect abuse and assist in the management of each victim’s care. Victims of domestic violence seeking assistance for injuries sustained during a battering incident may go to any hospital and receive help. I am a victim of domestic violence. How can the City’s hospitals help me?
All hospitals provide care for domestic violence injuries, including sexual assault. Crime Victims Board reimbursement allows hospitals to be reimbursed for care given to victims following a sexual assault, even if the victim does not have medical coverage. In addition to private hospitals, there are 11 City hospitals and six diagnostic and treatment centers that offer help to domestic violence victims regardless of income. All private and City hospitals have a Domestic Violence Coordinator or social worker onsite or on-call 24-hours a day, 7 days a week. Domestic Violence Coordinators provide an array of services including, but not limited to, confidential crisis intervention, short-term counseling, and safety planning. The Domestic Violence Coordinator or hospital social worker can also assist victims with emergency shelter, referrals to language-specific community organizations, legal assistance, and counseling.

Stop the Cycle of Violence!
All of you know how much needs to be done to take meaningful steps to end domestic violence and sexual assault. We need tough law enforcement, aggressive prosecutions, effective prevention programs and available shelters for families in distress. Most importantly, we need to insure that more people know and understand that domestic violence is not a private matter. It is a critical national problem that affects us all in every community, in every work place and in every school.
Each of us can do more and this handbook shows us how.
President Clinton recognized the seriousness of the problem when he signed the Violence Against Women Act as part of the Violent Crime Control and Law Enforcement Act of 1994. In the past year, the Department of Justice has sought to combine tough federal penalties along with substantial resources to the states to begin dealing with the problem of domestic violence in a comprehensive, multi-faceted way. States and local law enforcement agencies have been encouraged to begin programs that will enhance their ability to prevent domestic violence, to punish it and to stop the cycle of violence. The Act also established a:

Domestic Violence Prosecution Unit
The District Attorney's office created a domestic violence prosecution unit in August, 1994. The fully staffed unit includes victim-witness advocates, attorneys, and legal and administrative support. The Metro Police Department's domestic violence unit is composed of 35 officers, exclusively devoted to the investigation and prosecution of crimes of domestic violence. Division of Child Abuse and Domestic Violence Services
The Office of Child Abuse and Domestic Violence Services was established by Executive Order in 1996 and statutorily enabled by the 1998 General Assembly (KRS 12.350). In 2004, the office was reorganized as a division within the new Cabinet for Health and Family Services and structurally aligned under the Undersecretary for Human Services, Mike Fields. The Division of Child Abuse and Domestic Violence Services works with all divisions of CHFS to promote the most efficient and effective delivery of human services to all Kentuckians. The division is statutorily enabled and directed to increase the financial and program efficiency and accountability of state and community child abuse and domestic violence services and to enhance delivery of services by other organizations that assist victims of child abuse, domestic violence and sexual assault. Our Mission The mission of the Division of Child Abuse and Domestic Violence Services is two-fold:

Domestic violence is about power and control. It is not just about hitting or punching. It is a pattern of assaultive and coercive behavior, including psychological, sexual and physical abuse. The syndrome of dominance and control by the perpetrator leading to increasing entrapment of the victim is also known as the "battering syndrome." The majority of the time, it is a female that is abused. There are instances of a male being abused but it seems to be less common. Nearly a quarter of women in the United States will be abused at some time in their lives. There are two thousand deaths each year. About 20-25 percent of pregnant women are victims of domestic violence. Nineteen to 30 percent of women coming to emergency departments with physical injuries are battered. Battered women account for 25 percent of women who attempt suicide and 25 percent of women using a psychiatric emergency service. There is no typical victim of domestic violence.

'Routine questioning about domestic violence [by GPs] should be thought of as a way of uncovering and reframing a hidden stigma.' ('Reported frequency of domestic violence: cross-sectional survey of women attending general practice', Fiona Bradley et al British Medical Journal , 2 February 2002 (1)) If a 'hidden stigma' is a contradiction in terms, the term 'violence' is also used here with little respect for definition. The goal of this survey, conducted in 22 general practices in Ireland, was to 'uncover' a wide range of interpersonal bad behaviour and to 'reframe' it in terms of violence. A common feature of the flourishing literature on domestic violence in medical practice is the inflation of the concept of violence beyond its familiar usage, which refers to the deployment of physical force. The authors of this survey use a definition of domestic violence that 'incorporates three dimensions of abuse: controlling behaviours, violent incidents and consequent injuries'. 'Controlling behaviours' include 'shouted, screamed at you', 'criticised you', 'put you down in front of others', 'restricted your social life', 'checked your movements', 'threatened you', 'shouted at, threatened the kids' and 'kept you short of money'. Violent behaviours include 'punched walls, furniture', 'shouted at, threatened the kids', 'pushed, grabbed, shoved you', as well as a range of more directly aggressive acts.

  • Abuser:
    A person who carries out a pattern of coercive tactics against a family or household member (the victim).
  • Victim:

    Social Services Law defines family or household member as persons related by consanguinity or affinity; persons legally married to one another; persons formerly married to one another; persons who have a child in common, regardless of whether such persons are married or have lived together at any time, and unrelated persons who are continually or at regular intervals living in the same household or who have in the past continually or at regular intervals lived in the same household.
