The original question which generated these responses was from Erika Jaques (MO): "I'd like to know if other States have a Mountain Bicycling representative on their State Trail Advisory Boards? We have always had just a general "Bicycling" rep, but I'm considering breaking it into two separate categories - one for mountain biking, and the other for more greenway-type biking."
Summary
Number of States responding: 33 States are about evenly split between those including BOTH a mountain bike rep and a road / greenway rep, and those with just a single representative for general bicycling. Some States do not require specific trail use representation, and others include bike representation by agency or community reps.
Comments From States
Alabama - We have two bicycle reps on our advisory board. One is president of the Birmingham Urban Mountain Pedalers who also happens to be a street bike guy and the other represents hikers and urban bicyclists. In fact, several of our board members have multiple trail-use interests. We have left distance bicycling to the Alabama Department of Transportation as they deal with statewide bicycle planning issues and have deep pockets for alternative transportation projects. Arkansas - our RTP committee has a Mountain Bike rep but not a road bike rep unless you count me.

In today's litigious society, private landowners and public land managers must concern themselves with the issue of liability. The fear of a lawsuit is often enough to prevent private landowners from opening their land to mountain bicycling even though they would like to share their land with the public. Public land managers must also deal with the issue of liability and may even use it as one reason to close trails to mountain bicycling. Most states have enacted laws that greatly limit both private and public landowner liability. On the private side, these laws are called Recreational Use Statutes. For public land, the governing law is usually the state's Governmental Immunity Act or State Tort Claims Act. These laws are important for the future of mountain bicycling as they can shift the burden of responsibility to bicyclists and away from private landowners and public land managers. Private landowners and public land mangers are more likely to welcome mountain bicycling and other recreational activities if they are protected from liability. IMBA has always stressed personal responsibility for mountain bicycling and this notion can be further underscored by these laws. While most states currently have laws that limit landowner liability, these laws can vary greatly from state to state. The purpose of the following information is to provide a general picture of how these laws work and to answer some general questions regarding landowner liability. This information is meant to provide a starting point and reference guide for those interested in their state's liability laws.

Welcome
The Delaware and Hudson Rail Trail is a 19.8 mile long converted railroad bed in southwestern Vermont which was originally part of the Delaware and Hudson rail system that connected Rutland, Vermont with Albany, New York. The two nearly ten mile long sections extend through scenic areas of western Rutland and Bennington Counties with views of nearby hills, open farmland, forests, wetlands, end villages. The rail trail leaves Vermont and continues into New York State in three locations. However, these sections have not been developed for recreational purposes, the uses mentioned below may not be suitable and portions of the railbed have legally reverted to the adjacent private landowners.

Trail Surface
The trail surface consists of the original cinder ballast and in some locations gravel and stone. The trail, although graded, may offer a surface too soft for the narrow tires found on most ten- speed bicycles. The surface is better suited for the wider tires of mountain bikes.

Cheese Country Trail Map The Cheese Country Trail is a unique multi-purpose trail meandering 47 miles (80 kilometers) from Monroe through neighboring Lafayette County and on to historic Mineral Point in Iowa County. All-terrain vehicles (ATVs), off-road dirt bikes, mopeds, motorcycles, horses and horse-drawn conveyances, bicycles, and hikers share this multi-use trail. Because of the trail's varied uses, mountain bikes or wide-tired bikes are recommended for safety. Users areurged to be cautious and courteous of the many trail-users traveling at different speeds along this scenic, back road view of southern Wisconsin.
