Ahearn, Ph.D. Email this Print this Introduction The due process provisions of the Individuals with Disabilities Education Act (IDEA) guarantee the right of any party to a hearing to be "accompanied and advised by counsel and by individuals with special knowledge or training with respect to the problems of children with disabilities" [34 CFR §300.509(a)(1)]. This phrase has been the focus of litigation in which charges of unauthorized practice of law were brought against advocates who represented families of children with disabilities in Delaware. Project FORUM at the National Association of State Directors of Special Education (NASDSE), under its Cooperative Agreement #H326F000001 with the U. S. Department of Education Office of Special Education Programs (OSEP), worked with Perry Zirkel, University Professor of Education and Law at Lehigh University in Bethlehem, PA, to examine this issue through a survey of state directors of special education.

Each year, the Council reports its progress to the Inter Agency Resource Management Committee and sets its agenda. While elementary and secondary schools only receive about 8 to 9 percent of their funds from the federal government, nearly one-third of higher education funds come from the federal government. The bill introduced by the House Republicans will focus on a wide range of HEA issues, including Pell Grant funding.
