Delaware Boating Regulations and Laws
The Delaware Boater Education Card (also referred to as the Delaware boating license) is proof that a boater has taken and passed an approved boater education course. The Delaware Division of Fish and Wildlife currently has a mandatory boater education requirement requiring all boaters born after January 1, 1978 to have the Delaware boating license on board when the vessel is underway to satisfy the Delaware boating regulations. Many boating fatalities occur because boaters aren't educated about boating safety. The Delaware Division of Fish and Wildlife believes that an educated boater is a safer boater.

Technology to Benefit "Homebound" Students
By Brian J. Hartman, Esq., Project Director, Disabilities Law Program Recent developments in Delaware hold great promise for "homebound" students. Students unable to attend school for extended periods due to illness or injury have typically been offered instruction at home. School districts generally followed Delaware Department of Education guidelines and provided 5-10 hours of such instruction on a weekly basis. For example, a student recovering from surgery would receive 1-2 hours of individual instruction from a visiting teacher in late afternoon from Monday through Friday. The teacher would check with the student's classroom instructors, offer tutoring following the classroom curriculum, and administer and grade assignments and tests. This approach was adopted for both special education students and those lacking special education eligibility. In the Spring of 2000, the Department proposed revisions to homebound regulations which provided an exciting opportunity to enhance homebound students' instruction. The Disabilities Law Program (DLP) prompted several amendments, including upgrading the traditional homebound model with technology.

Code 3100 ORDER FINAL After due notice in the Register of Regulations and two Delaware newspapers, a public hearing was held on May 25, 2005 at a scheduled meeting of the Delaware Board Funeral Services to receive comments regarding proposed rule. The proposed change to Rule 9.4.2 provides for automatic approval of continuing education offered by the Academy of Funeral Service Practitioners or a state licensing board for funeral directors. The proposed change was published in the Register of Regulations , Vol. 8, Issue 9, March 1, 2005. The notice for a rescheduling hearing was published in the Vol. 8, Issue 10, April 1, 2005. Summary of the Evidence and Information Submitted No written or verbal comments were received. Findings of Fact with Respect to the Evidence and Information Submitted The approval process for continuing education would be more efficient and predictable if automatic approval were available under the rules where appropriate. However, the wording should be clarified. The AFSP ëapprovesí continuing education proposals; it does not ëofferí continuing education courses itself. Rule 9.4.7 should be changed to reflect the practice of approving continuing education for the licensure period rather than two years from the date of approval.
