The Empire Strikes Back Well, Salon just ran a piece by Eric Boehlert covering the persecution of Al Lorentz for his crime of ..um.. exercising his right to free speech. The story is that a career military man stationed in Iraq wrote an article making the case that the Iraq war is unwinnable, posted the article to a conservative website, and is now the target of a legal attack by the Pentagon. I believe this is the biggest news source that has touched this one so far. For those of you without Salon subscriptions here's a meaty excerpt:
The essay that sparked the military investigation is titled "Why We Cannot Win" and was posted Sept. 20 on the conservative antiwar Web site LewRockwell.com. Written by Al Lorentz, a non-commissioned officer from Texas with nearly 20 years in the Army who is serving in Iraq, the essay offers a bleak assessment of America's chances for success in Iraq.

He is the author of several hundred articles dealing with the hot political and economic topics, both Bulgarian and international. ("A Royal Solution." World Press Review. Appeal from judgment of the United States District Court for the Southern District of New York, Robert W. Sweet, J., denying defendants' motion to dismiss nonpecuniary damages. Held, the Death on the High Seas Act, 46 U.S.C. app. 761-767 (DOHSA) does not apply to a crash occurring about eight miles from the coast of the United States, in United States territorial waters. Affirmed. Judge SOTOMAYOR dissents in a separate opinion.
I. Background The appeal arises out of the crash of TWA Flight 800, which departed from John F. Kennedy International Airport in New York on July 17, 1996, for Paris, France and Rome, Italy. Shortly after takeoff, the plane appears to have exploded in midair and crashed. According to the National Transportation Safety Board, the crash occurred approximately eight nautical miles south of the shore of Long Island, New York. All 230 persons on board perished.

SAN JUAN, Puerto Rico (AP) - Two Yemeni men say they were held in solitary confinement in secret, underground U.S. detention facilities in an unknown country and interrogated by masked men for more than 18 months without being charged or allowed any contact with the outside world, Amnesty International charged Wednesday. Amnesty and human rights lawyers argued that the report added to long-standing claims that the United States has held "secret detainees" in its war on terror. "We fear that what we have heard from these two men is just one small part of the much broader picture of U.S. secret detentions around the world," said Sharon Critoph, a researcher at Amnesty International who interviewed the men in Yemen. Navy Lt. Commander Flex Plexico, noting that it was difficult to respond to a report he hasn't seen said, "We have said many times that the Department of Defense does not engage in the practice of renditions" - the transfer of terror suspects to third countries without court approval. Plexico, a spokesman for the department, said it was important to note that training manuals of al Qaida terrorist network "emphasize the tactic of making false abuse allegations."

Yet it was fought over ideas as well. It did not prove to be the war to end wars, as those who survived it hoped. Yet, it did give birth to the ideal of international institutions and binding humanitarian law that would encompass all nations and peoples. It also kindled in the hearts of many who had witnessed the suffering, the idea of a united and peaceful Europe. I am proud to give this lecture, at such a moment and in Australia's National University. I applaud the initiative of the University to establish the National Europe Centre. It is an instance of the special contribution of the University to Australia. Looking out to the world. Strengthening our links with it. Helping us in Australia to understand our own future by appreciating the world's future. In that future, Europe, the cradle of Western civilisation, continues to play a pivotal role. It is made larger because Europeans can never forget the suffering and the necessities, every year, that Remembrance Day teaches.

Once again, they marked the Armistice that brought to a close the Great War of 1914-1918. It was a war substantially fought in Europe, between European powers and their empires. Yet it was fought over ideas as well. It did not prove to be the war to end wars, as those who survived it hoped. Yet, it did give birth to the ideal of international institutions and binding humanitarian law that would encompass all nations and peoples. It also kindled in the hearts of many who had witnessed the suffering, the idea of a united and peaceful Europe. That idea was to bear fruit after the Second World War. It is an idea whose realisation continues to grow in strength. In recent days, Australians have witnessed from afar two remarkable European events. The first was the signature in Rome of the proposed new European Constitution. The second was the assertion of democratic accountability of the Commission of the European Union to the European Parliament, elected by the people of the member states.
