This was the top story on the Jan. 28 front page of the Arizona Daily Star . It was good to see another blow for justice, and it makes me proud to live in a community that takes these things seriously. Anti-gay activists are eager to point to the FBI's annual Hate Crime Statistics as evidence that gays and lesbians are not particularly "oppressed" compared to anybody else. But as is always the case in such contentions, there is more to the story than meets the eye. Federal law requires that the FBI solicit quarterly hate crime statistics from local law enforcement agencies, which the FBI compiles and releases in annual reports. The categories for which the FBI is responsible for tracking include race, religion, sexual orientation, ethnicity and disability. Congress requires the FBI to track sexual orientation even though there are no provisions in federal law for prosecuting hate crimes based on sexual orientation. So at least on a federal level, this exercise is purely informational as far as sexual orientation is concerned. The most recent report for 2003 was released last November ( PDF: 14MB/166 pages ). Types of offending bias include crimes motivated by the victim's race, color, religion, national origin, and, more controversially, sexual orientation and gender identity. When the Clinton administration in November backed those changes, activists garnered both political and tactical support for a campaign that now moves to Congress The administration's announcement came during a day-long White House Conference on Hate Crimes Nov. 11, which NOW President Patricia Ireland attended and local activists viewed via satellite downlinks. It was held days after top NOW leaders met with Attorney General Janet Reno to stress the importance of expanding not only the prosecution, but also the documentation of these crimes. During the meeting, Attorney General Reno said she had been stymied when preparing a speech on violence against women because she could not find reliable statistics, according to NOW President Patricia Ireland. "When the attorney general of the United States herself cannot get reliable data, we know we have a serious problem," Ireland said. Bonnie Campbell , director of the Office of Violence Against Women at the Justice Department , said at the same meeting that the largest number of complaints her office receives are from women who find state and local authorities fail or refuse to enforce the law, especially restraining orders. Campbell said her office is also concerned about complaints that law enforcement personnel cover up hate crimes against women, citing cases in which police evidence and reports disappear before the women can bring their claims.

@import url(/css/default.css); NOW Pushes to Increase Hate Crimes Prosecution by Kimberlee Ward Lesbian Rights Program Director Despite an increase in bias-motivated crimes, including the bombing of a lesbian bar in Atlanta, the federal government does not have the authority to investigate or prosecute offenses motivated by a person's real or perceived sex or sexual orientation. NOW is working to change that. In coalition with other civil rights organizations, NOW is lobbying members of Congress to amend the existing federal hate crimes criminal statute to include sexual orientation and gender-bias crimes. The coalition's unanimous decision to add gender was a radical change, inspired in part by the Atlanta bombings. It comes some eight years after NOW called the first meeting of coalition allies to discuss adding gender-motivated crimes to federal legislation. While other federal laws provide increased penalties and data collection for certain hate crimes, NOW is working to amend Section 245 of Title 18 of the U.S. Criminal Code, which allows the federal government to investigate and prosecute bias-motivated crimes based on race, religion and ethnicity, but not sex or sexual orientation. The Atlanta lesbian bar bombing highlights the need for Section 245 to include both gender and sexual orientation. As is common with hate violence against lesbians, we may never know if the bombing was a targeted attack on women in general or lesbians in particular. Nevertheless, the federal government could only investigate the bombing because it was a serial attack following the bombing of an Atlanta abortion clinic. Otherwise, the FBI would have no jurisdiction to investigate the case as a hate crime. Lack of a Georgia hate crimes law also prevented a state-level investigation.

Civil Rights 20 June 2003 Giuliani Recommends Countries Keep Hate Crime Statistics Addresses OSCE anti-Semitism conference in Vienna Former New York Mayor Rudolph Giuliani, head of the U.S. delegation to the OSCE (Organization for Security and Cooperation in Europe) Anti-Semitism Conference in Vienna, says he recommends that each country attending the conference keep hate crime statistics. "It is the only way in which you're going to be able to figure out where you have to combat prejudice, where you have to combat crime, and where ultimately the educational efforts are necessary to turn this around," Giuliani told conference attendees June 19. In his remarks, he discussed compiling such statistics as the first of eight suggestions.
