INTRODUCTION
The National Incident-Based Reporting System (NIBRS) is an incident-based crime reporting program for local, state, and federal law enforcement agencies. Within each criminal incident, NIBRS captures information on offenses, victims, offenders, property, and persons arrested. The ability to link and analyze this detailed information is a significant improvement to the existing Uniform Crime Reporting (UCR) Program. NIBRS is rich with information about bias crimes reported to the police, and particularly about juveniles who are victims and offenders of these crimes. However, NIBRS is a very large and complex dataset, a fact that has become an impediment to its full utilization.     By Daniel de Vise Washington Post Staff Writer Thursday, July 7, 2005; Page AA03 Anne Arundel civil rights leaders met with the county state's attorney last week to discuss what they fear is an upward trend in local hate crimes. Law enforcement officials say that given the uncertainties of hate crime investigation, it's hard to tell whether such incidents are on the upswing. Nonetheless, civic leaders say that the latest incidents seem unusually hostile, and that they are unaccustomed to seeing so much activity in such a short time.

    Hate Crime Resources for Victims and Their Lawyers
    Department of Justice Resources All 50 states, the District of Columbia, the U.S. Virgin Islands, Guam, and Puerto Rico have established crime victim assistance and compensation programs. Crime victim assistance programs can provide a range of services to hate crime victims and their families, including crisis intervention, counseling, emergency shelter, criminal justice advocacy, and emergency transportation. Crime victim compensation programs can provide substantial financial assistance to hate crime victims and their families. The compensation programs reimburse victims for crime-related expenses such as medical costs and mental health counseling, funeral and burial costs, lost wages or loss of support. A number of programs also cover crime-scene cleanup, travel costs to receive treatment, moving expenses, and the cost of house-keeping and child care. Some expenses are not covered by most compensation programs, including theft, damage, and property loss.

    The Federal Bureau of Investigation (FBI) defines a hate crime or bias crime as a "criminal offense committed against a property or society motivated in whole or part by the offender's bias against a religion, disability, sexual orientation or ethnicity/national origin." Typical hate crime laws make illegal the use of force or the threat of force against a person because of their affiliation with a specific group. Studies show that ordinary crimes are typically committed by people with whom the victims are familiar; hate crimes, on the contrary, are often committed by strangers who simply perceive another as belonging to a particular group. Statistics also show that most perpetrators of hate crimes are under the age of 20.

    In their book, Hate Crimes: Criminal Law and Identity Politics (Oxford University Press), law professor James Jacobs and lawyer Kimberly Potter dissect and challenge the rationale for "hate crime" legislation. Here is some of what they have to say: It is a serious mistake for the government to pursue the goal of seeking to identify and highlight the maximum possible amount of prejudice in the crime problem by counting as a hate crime every offense motivated in any degree by the offender's prejudice. This definition sweeps under the hate crime umbrella crimes involving low-intensity prejudices that bubble to the surface during ad hoc conflicts. The majority of hate crimes turn out to be fights involving epithets rather than "hard core" ideologically driven violence by people identified with extremist groups or causes. Because the former are much more numerous than the latter, the numbers suggest a picture of American society as a conglomeration of clashing identity groups. Defining the prejudice-motivated criminal as a group representative rather than as a lone outlaw transforms the social understanding of crime from aberrant and deviant behavior into the kind of sociopolitical conflict among broad social groupings that marks the current situation in the former Yugoslavia. . . .

    The Uniform Crime Reporting (UCR) Program was conceived in 1929 by the International Association of Chiefs of Police to meet a need for reliable, uniform crime statistics for the nation. In 1930, the FBI was tasked with collecting, publishing, and archiving those statistics. Today, several annual statistical publications, such as the comprehensive Crime in the United States , are produced from data provided by nearly 17,000 law enforcement agencies across the United States.     The Special Nature of an Extreme Expression of Prejudice Hate crimesviolent acts against people, property, or organizations because of the group to which they belong or identify withare a tragic part of American history. However, it wasn't until early in this decade that the federal government began to collect data on how many and what kind of hate crimes are being committed, and by whom. Thus, the statistical history on hate crimes is meager. Psychological studies are also fairly new. Nevertheless, scientific research is beginning to yield some good perspectives on the general nature of crimes committed because of real or perceived differences in race, religion, ethnicity or national origin, sexual orientation, disability, or gender. According to the FBI, about 30% of hate crimes in 1996, the most recent year for which figures are available, were crimes against property. They involved robbing, vandalizing, destroying, stealing, or setting fire to vehicles, homes, stores, or places of worship.

    Monitor staff H ate crimes constitute a unique class of violence against a person’s identity, demanding distinctive psychological, legislative and policy responses, psychologists said at a briefing co-sponsored by APA and the Society for the Psychology Study of Social Issues. The briefing, timed to correspond with a larger White House Conference on Hate Crimes, was attended by representatives from 24 House and Senate offices, including Rep. John Lewis (D-Ga.) who recounted his experience as a hate crimes survivor during the civil rights movement. Four distinct motives underlie hate crimes based on sexual orientation, according to research by Karen Franklin, PhD, forensic psychology fellow at Washington University’s Washington Institute for Mental Illness Research and Training. Such hate crimes are motivated by self-defense, where perpetrators interpret the victim’s actions as a sexual proposition; ideology, where perpetrators view themselves as enforcers of social norms that deem homosexuality unacceptable; thrill-seeking, where perpetrators commit assaults to alleviate boredom; and peer dynamics, where perpetrators aim to prove their toughness and heterosexuality to friends, she found. When addressing ethnically based hate crimes, the highest rate of crime occurs when nonwhites rapidly move into previously all-white enclaves, said Donald Green, PhD, professor of political science and director of the Institute for Social Policy Studies at Yale University. “It’s not just how white the neighborhood is but also how rapid the changes are,” he said. Green, who helped train the New Haven, Conn., police department how to deal with hate crimes, says such crimes probably will increase in the suburbs in the next few years as more minorities move there, and it is important for the police to be prepared and respond appropriately.

    A total of 12,073 law enforcement agencies participated in the hate crime program during 2002. Of these agencies, 1,868 agencies (15.5 percent) submitted 7,462 hate crime incident reports to the FBI. (See Table 2.36.) The following hate crime abstract is based on the data received from those law enforcement agencies that provided 1 to 12 months of hate crime reports.

    The UCR Program data collection guidelines stipulate that a hate crime may involve multiple offenses, victims, and offenders within one incident. Accordingly, in 2002, the 7,462 hate crime incidents reported to the FBI involved 8,832 separate offenses, 9,222 victims, and 7,314 known offenders. (See Table 2.33.) (The term known offender does not imply that the identity of the suspect is known but only that some attribute of the suspect has been identified, distinguishing him or her from an unknown offender.)
    Incidents
    Of the total single-bias incidents reported in 2002, 48.8 percent were motivated by racial bias, 19.1 percent were driven by prejudice against a particular religion, 16.7 percent involved a sexual-orientation bias, 14.8 percent resulted from a bias against an ethnicity or national origin, and 0.6 percent were motivated by a disability bias. (Based on Table 2.33.)
