The short answer is that identity theft is a crime. Identity theft and identity fraud are terms used to refer to all types of crime in which someone wrongfully obtains and uses another person's personal data in some way that involves fraud or deception, typically for economic gain. These Web pages are intended to explain why you need to take precautions to protect yourself from identity theft. In one notorious case of identity theft, the criminal, a convicted felon, not only incurred more than $100,000 of credit card debt, obtained a federal home loan, and bought homes, motorcycles, and handguns in the victim's name, but called his victim to taunt him saying that he could continue to pose as the victim for as long as he wanted because identity theft was not a federal crime at that time before filing for bankruptcy, also in the victim's name. While the victim and his wife spent more than four years and more than $15,000 of their own money to restore their credit and reputation, the criminal served a brief sentence for making a false statement to procure a firearm, but made no restitution to his victim for any of the harm he had caused. This case, and others like it, prompted Congress in 1998 to create a new federal offense of

A New York identity-theft ring was recently charged with the largest identity theft scam in U.S. history, spanning almost three years and involving the theft of the credit histories of more than 30,000 victims. The identity-theft ring used the stolen information to charge huge sums to credit card numbers, empty bank accounts, and fraudulently obtain loans — costing consumers more than $2.7 million. Law enforcement authorities are calling this the largest identity theft case in U.S. history
27.3 million Americans have been victims of some form of identity theft within the past five years according to a September, 2003 FTC survey , including almost TEN MILLION people in 2002 alone . According to the survey, last year's identity theft losses to businesses and financial institutions totaled nearly $48 billion and consumer victims reported $5 billion in out-of-pocket expenses.

Identity Theft Facts
Identity theft can take many forms. An illegal immigrant may use your social security number (SSN) and date of birth (DOB) for employment purposes or to obtain a birth certificate. Imagine the confusion that can be created when the IRS wants to know why you didn't declare the extra income reported to them caused by someone using your name and social security number. Sometimes personal identification numbers are sold over and over to hundreds of individuals who in turn attempt to obtain bogus credit in your name or establish utility services and run up the bills. Sometimes arrested criminals will use false names, DOBs, and SSNs that belong to another. Innocent persons have discovered that they have criminal records because of a misused ID. See how easy it is for you to explain to family, coworkers or friends that you are mistakenly arrested for an outstanding criminal warrant. Identity theft can take months and sometimes even years to detect and can take about the same time to correct the damage. According to the California Public Interest Research Group (CALPIRG) and the Privacy Rights Clearing House, victims of identity theft spend an average of 175 hours and $808 in out-of-pocket costs (not including attorney fees) to fix their wrecked credit problem. Identity theft can significantly traumatize anyone because it is unnerving to know (or not know) the extent of the damage to your name, credit or reputation. There have been cases reported where it has taken victims years to restore their credit and good name, and had problems being able to cash checks, obtain loans or even rent an apartment.

  • Phishers typically include upsetting or exciting (but false) statements in their e-mails to get people to respond immediately Phishers typically ask for personal information such as usernames, passwords, credit card numbers, social security numbers, etc. Phisher emails are typically NOT personalized. Valid messages from your bank or e-commerce company generally have your correct name Be wary of e-mail! Never click on any link to a bank, eBay, or other merchants. Instead, open a browser (not just a new window) and type in the URL yourself. When in doubt, call the institution using the number listed in the phone book, not one provided in the e-mail or link Avoid filling out forms in e-mail messages that ask for personal financial information Practice good computer hygiene. Don't click on attachments. Run both anti-virus and anti-spyware applications. Firewall and privacy protection software are also a good idea. Update this software, as well as your operating system, on a regular basis.

Data sharing may prevent identity theft, says Fraud Advisory Panel
OUT-LAW News, 24/07/2003 The report "Identity Theft: do you know the signs?" contains some worrying statistics: the total number of identity frauds increased dramatically from 27,270 in 2001 to 42,029 in 2002 according to the Credit Industry Fraud Avoidance System; it takes an average of 300 hours for victims of identity fraud to set the record straight, says the Home Office, and It compares to a report from researchers Gartner published on Monday which found a 79% increase in identity theft in the US in the year ending June 2003. The UK report details the main methods of perpetrating identity theft. These include application fraud, where a fraudster applies for payment cards and financial products in the name of his victim; account takeover, where the fraudster collates sufficient information about the victim to dupe the victim's bank that they are the victim; the wholesale assumption of the victim's identity; and the fraudulent use of a business identity, through company stationery or the use of a bogus web site. The solution, according to the report, is to increase data sharing between government and business, and between businesses.

PURPOSE The purpose of this circular is to standardize Identity Theft Prevention and Victim Information presented during community crime prevention meetings. The circular will also assist Los Angeles Police Department (LAPD) personnel to impart basic Identity Theft Prevention and Victim Information tips to community members to help slowdown one of the fastest growing white-collar crimes. The circular will also serve to warn community members how to take steps to protect their privacy and to educate Identity Theft victims about what to do when an identity thief strikes. INTRODUCTION The crime of Identity Theft is on the rise and it has become a significant problem for the LAPD and for people who reside in the City of Los Angeles. This is because there has been an increase in the number of reported Identity Theft incidents and in the level of fear within the community. Additionally, the Identity Theft issue continues to receive considerable media attention. The LAPD believes there could be as many as 10,000 reported Identity Theft incidents within the City of Los Angeles in 2003. To more effectively coordinate Identity Theft investigations, the LAPD now investigates these crimes through their Commercial Crimes Division. The LAPD encourages anyone victimized by Identity Theft to contact the LAPD or their local law enforcement agency to report the incident. The law making Identity Theft a crime was enacted as a misdemeanor crime in 1998. In 1999, the law was upgraded to an alternate felony/misdemeanor crime. The crime of Identity Theft is described in the California Penal Code as follows:
