Reasonable Doubt: Can Crime Labs Be Trusted?

While television shows like CSI make forensic science appear infallible, a joint investigation by the Center for Investigative Reporting and CNN reveals a far different story in the real world. A new CNN Presents documentary, “Reasonable Doubt: Can Crime Labs be Trusted?,” examines the lack of standards, quality controls and training at many of the nation’s forensic laboratories and looks at how those problems have contributed to a string of wrongful convictions across the country.
Funding to CIR for early research and development of this investigation was provided by the Ford Foundation. Robin Mejia reported on forensic science and bullet lead analysis for New Scientist magazine in April 2002.
Mejia was awarded a Soros Justice Media Fellowship from the Open Society Institute to continue her research in the area of forensic science through February 2004, resulting in a book proposal.

E-mail it to a friend HPD statement on missing evidence 02:37 PM CDT on Thursday, August 26, 2004 From 11 News Staff Reports HPD released the following statement concerning the boxes of evidence found in the warehouse: Preliminary information indicates that about 280 boxes of evidence, which dates from the late 1970s to early 1990s, are involved. They likely were mislabeled during resubmission to the Property Room from the Crime Lab. IAD investigators found, in August of 2003, approximately 280 additional boxes of Crime Lab evidence in the Property Room that was submitted by various Crime Lab personnel. Investigators were unaware of the contents within the boxes and delayed examination of such based upon markings on the boxes indicating the evidence was pre-DNA material. Instead, they focused on DNA and other Crime Lab-related priorities known to them at the time. Investigators began their review of the boxes last week and preliminary information indicates that the evidence was improperly labeled and stored during its resubmission to the Property Room from the Crime Lab. In November 2002, the Houston Police Department Crime Lab came under scrutiny due to a well-published independent audit as well as newscasts aired by Channel 11. Local newscasts highlighted seven criminal cases, one of which was the Jose Nieto case.

The guy seems totally believable, but you too have read the lab report and so you know, I mean like, really know, it is indeed his blood, or hair, or whatever...says so right in the crime lab report's section on "Results". It's enough to make you think to yourself; "This guy would make a great witness. Even I can't tell he's lying". Well, not so fast! There is an ever increasing possibility that your client really is telling you the truth and what you're confronted with is an error that occurred somewhere between the collection of the evidence and the writing of a report of the laboratory's findings. Few areas of examination at trial can seem as daunting as the prospect of taking on the prosecution's forensic experts. Crime lab reports seem to have this aura of invincibility about them that lead few trial lawyers to confront their conclusions head on in front of a jury. Maybe it's because some part of us believes that the reported results are based upon "science", and science, in turn, can be empirically tested. Hence, we reason, if the stuff can be checked, no lab technician would put things in their report that could easily be shown to be incorrect...Or maybe it's because we tremble at how excruciating high school chemistry was and would rather set ourselves on fire than delve back into that pit from hell...Or maybe, just maybe, it's because we simply don't realize how extremely vulnerable to challenge the crime lab work product really is.

    Introduction
    What do forensic scientists do?
    Essentially, forensic science is the application of science to the law, forensic scientists examine contact trace materials associated with crimes in order to provide evidence for criminal investigations. The work is usually dealt with under three sections: biology, chemistry and drugs/toxicology. Occasionally, forensic scientists may be required to attend crime scenes but more often than not it is the Scene of Crime Officers (SOCO) working for police forces who are responsible for collecting the evidence. Forensic scientists are usually based in laboratories although senior forensic staff may attend crime scenes. The SOCO role is open to non-graduates whereas forensic scientists will often have a first degree, usually in Biology or Chemistry. Other less common specialisms include document analysis and ballistics.

Starting to work on the case
Recently, the number of theft cases targeting persons withdrawing cash from a bank or an automated teller has increased. Techniques such as purposely putting something on someone's clothes or dropping money in front of him has been used to avert the attention of a potential victim.
The number of theft cases involving lock picking tools has increased as well, with their techniques getting more devious than ever.
@Moreover, crimes utilizing computer technology has also increased and includes producing counterfeit and altered credit cards. Thus, crime has become even more malicious and cunning as ever. In an effort to expeditiously solve these constantly evolving crimes, the MPD is relentlessly improving its investigative procedures with new technical equipment and training.
@Meanwhile, each MPD investigator continues to actively do their job to prevent future crimes from occurring and ensure the residents of Tokyo continue to live in a peaceful and safe environment.
Aiming for the 100% Clearance Rate @In 2002, the penal code offenses numbered 301,913 (excluding the traffic accidents and offenses) in Tokyo. This was equivalent to 10.6% of the nationwide total offenses, 2,853,738.

SEATTLE POST-INTELLIGENCER REPORTER Washington State Patrol officials fired beleaguered crime lab forensic scientist Arnold Melnikoff yesterday, saying his flawed hair-analysis testimony in a Montana rape trial while on the agency's payroll violated professional standards. SPECIAL REPORT Shadow of Doubt: They sit in prison but crime lab tests are flawed Citing a need to restore "public trust and confidence," the State Patrol said Melnikoff's "incompetent and inaccurate" testimony in that 1990 case meant he could no longer do his job. But State Patrol and crime-lab officials downplayed a scathing internal audit that raised questions about 30 out of 100 drug-analysis cases handled by Melnikoff at the Spokane crime lab between 1999 and 2002.

SEATTLE POST-INTELLIGENCER REPORTER Washington State Patrol officials will notify prosecutors in seven counties that drug evidence handled by one of their employees a crime lab forensic scientist facing termination has been called into question. BACKGROUND This report is a follow-up to Shadow of Doubt , P-I investigation into the state crime lab's handling of drug evidence. The decision, announced late yesterday, comes nearly a year after an internal audit found flaws in 30 out of 100 Eastern Washington drug-analysis cases assigned to Arnold Melnikoff. State Patrol Chief Lowell Porter also pledged to meet with the state prosecutors association to discuss that group's demand that the crime lab notify every county where Melnikoff's work helped convict suspects in recent years potentially hundreds of cases.

Monday :: April 28, 2003 FBI Lab Investigation Widens The investigation into the DNA lab at the FBI is widening. Instapundit is on top of it, as is MSNBC. The AP reported this month that FBI lab technician Jacquelyn Blake quit while under investigation for failing to follow required scientific procedures while analyzing 103 DNA samples over the past couple of years, and a second lab employee was indicted for allegedly providing false testimony. Inspector General Glenn Fine expanded the Blake inquiry to examine the FBI lab’s broader practices in DNA cases. The FBI has been cooperating, the government officials said. The officials said the goal of the investigation is to identify vulnerabilities in lab procedure that could affect the quality of the FBI’s DNA analyses or permit a rogue employee to go undetected. Frederic Whitehurst, the whistleblower in the 1995 FBI lab scandal that affected the WTC and Oklahoma City bombing investigations, and who has gone on to become a lawyer as well as forensic specialist, is also on top of the new inquiry. According to the MSNBC report, Criminal defense lawyers are planning challenges to the database and to DNA evidence in cases involving the FBI lab technician or the local crime labs accused of wrongdoing.

IPRT Scientists Lend Helping Hand to Iowa Crime Lab
Cooperative effort part of a proposal to establish forensics research facility at ISU
AMES, Iowa Scientists at Iowa State University's Institute for Physical Research and Technology are investigating equipment and new techniques to help crime labs assess evidence more quickly and reliably. IPRT researchers are concentrating on technologies suggested by forensic investigators at the Iowa Division of Criminal Investigation's crime laboratory, which analyzes crime-scene evidence for law-enforcement agencies throughout the state. IPRT's work with the Iowa crime lab is part of its broader goal of establishing a regional forensics support and research facility at the university. "Our scientists work with a variety of analytical techniques and equipment, and we can use that expertise to develop new methods of analyzing forensic evidence," said Shelley Coldiron, one of three IPRT scientists spearheading the effort to develop the partnerships needed to launch a forensics facility. IPRT is a network of 11 research and technology-transfer centers that includes the U.S. Department of Energy's Ames Laboratory.

Early in the investigation, Mr. Bromwich had experienced difficulty in obtaining the cooperation of certain key former Crime Lab managers and analysts. Two of these former Crime Lab employees have each now been interviewed multiple times. Mr. Bromwich reports, however, that his efforts to obtain the cooperation of a third former Crime Lab employee, former longtime DNA/serology analyst Christy Kim, so far have been unsuccessful.
