Court system begins with elected district justices
Many people are baffled by the state's judicial system, but a resident doesn't need a law degree to grasp a basic understanding of it. The system includes four court levels. Beginning with the lowest, they are: district justices, courts of common pleas (county courts), Superior and Commonwealth courts, and the state Supreme Court. Each court serves a unique function. At the lowest level, eight district magistrates, or justices, serve Cumberland County. They are elected and serve six-year terms. They have initial jurisdiction over any civil case involving claims of less than $8,000 unless it is a real estate dispute, which they do not handle. In criminal cases, they set bail, handle preliminary arraignments and hold preliminary hearings to determine if there is sufficient evidence to refer the cases to the court of common pleas. They also issue search and arrest warrants and handle ordinance violations and various summary offenses such as violations of the Pennsylvania Motor Vehicle Code, disorderly conduct, criminal mischief and public drunkenness.

Circuit courts generally hear felony, domestic relations, domestic violence, juvenile, probate, guardianship, mental health, child support and civil cases where the matter in controversy is $15,000.00 or more. County courts generally hear misdemeanor, small claims, landlord/tenant disputes, violations of county or municipal ordinances, traffic violations and civil cases where the matter in controversy is less than $15,000.00. Hernando County is part of the Fifth Circuit, which has its headquarters located in Ocala. The Fifth Judicial Circuit is comprised of: Hernando Marion Lake Sumter ... Citrus Hernando County currently has four full-time and one part-time Circuit Court Judges and one County Court Judge assigned. There is also a General Magistrate assigned to Hernando County . Additionally there is a special hearing officer who is assigned to hear cases involving child support enforcement. There are five appellate districts in the State of Florida. Hernando County is part of the Fifth District Court of Appeal, which is located in Daytona Beach.

Office of the State Court Administrator The Office of the State Court Administrator oversees a statewide, state-funded court system. It promotes efficient, statewide improvement and supports local courts in responding to community and statewide needs. The Chief Justice of the Supreme Court is the administrative head of the Oregon Judicial Department, which is a statewide, unified court system with almost 200 judges, before 2002 budget cuts, 1700 full and part-time staff. The Chief Justice appoints a chief administrative officer whose title is State Court Administrator, a position created by statute. Our State Court Administrator is Kingsley W. Click. She is responsible for making the Judicial Department work day-to-day. She oversees all administrative and executive operations of the state trial and appellate courts, the indigence verification program, and the foster care review program. The district courts are the trial courts of general jurisdiction of Texas. Each county must be served by at least one district court, but the size and shape of each district is determined by the legislature, primarily on the basis of population. Most district courts try both criminal and civil cases. District courts have original jurisdiction in all felony criminal cases, divorce cases, cases involving title to land, election contest cases, civil matters in which the amount in controversy (the amount of money or damages involved) is $200 or more, and any matters in which jurisdiction is not placed in another trial court. In densely populated counties the district courts may specialize in civil, criminal, juvenile, or family law matters.

Home NC Court System Structure History of NC Judges Cumberland County The Twelfth Judicial District encompasses Cumberland County with the seat of court in Fayetteville, North Carolina. The twelfth judicial district has a superior court division and a district court division. The jurisdiction of each division and the administration of the twelfth judicial district is examined more closely below. This judicial district is the fourth largest in the State of North Carolina handling in excess of 100,000 cases per year Superior Court Judges Superior Court judges have authority across the state to hear all matters within the jurisdiction of the superior court, (excluding matters of probate and administration of guardianships which is within the jurisdiction of the clerk of superior court.) Cumberland County is the twelfth judicial district for administrative purposes and composed of three districts for electoral purposes. These electoral districts are known as 12A, 12B, and 12C. District 12A and 12B each has one superior court judge, and district 12C has two superior court judges. Each judge is required to reside within the district and elected by all voters in nonpartisan elections within that district for an eight-year term. The names of the four superior court judges for Cumberland County are listed in the directory.

The District Attorney is elected by the voters of Genesee County and is responsible to them for carrying out the prosecution of criminal cases referred to the District Attorney's Office by the various police agencies within the County, including the New York State Police, the Genesee County Sheriff's Office, the Batavia Police Department, the LeRoy Police Department and the Corfu Police Department.

BREDESEN NAMES CLARK NEW SUPREME COURT JUSTICE
Governor Phil Bredesen has named Cornelia “Connie” Clark to serve as the newest justice of the Tennessee Supreme Court, where she will fill a vacancy created by the retirement of Justice Frank Drowota. The governor appointed and swore in the newest member of the court on September 19. “Each day in her work, Judge Clark displays the qualities required in a Supreme Court justice. She’s knowledgeable of the law, hard-working, articulate, and always conducts herself with the highest of moral standards,” Bredesen said. “I’m confident that in Judge Clark we’ve chosen the best person to fill this important position.” “I am honored that Governor Bredesen has selected me to serve the people of Tennessee in this position that holds such a high degree of public trust,” Clark said. “I promise to discharge my duties to the best of my ability and to always put the public good first in my work.”

In 2001 -
  • Half the prosecutors' offices Nationwide employed 9 or fewer people and had a budget of $318,000 or less.
    The 2,341 State court prosecutors' offices employed over 79,000 attorneys, investigators, and support staff; a 39% increase from 1992 and 13% from 1996.
    Over three-quarters of the Nation's chief prosecutors occupied full-time positions compared to about half in 1990. Sixty-five percent of all offices had at least one full-time assistant attorney.
    Forty-one percent of the prosecutors' offices had a staff person who had been threatened or assaulted compared to 49% in 1996.
    Over two-thirds of all offices reported the use of DNA evidence during plea negotiations or felony trials compared to about half of the offices in 1996.
    Approximately 69% of all offices indicated having proceeded against an estimated 32,000 juveniles in criminal court.
