Dockets With all the courts seemingly going in different directions when it comes to putting dockets and filings online, it can be difficult to determine who's on the web and who isn't. This site includes all dockets on the web regardless of the type of system being used. There are several different systems in place for court documents and dockets on the web, among them Web Pacer, Racer (Remote Access to Court Electronic Records) and Electronic Court Filing Systems (ECF/CM), each of which works differently. Note that Web Pacers, Racers and ECF/CM systems require a user name and password, which can be obtained from the Pacer Service Center.

Free Court Case Docket Monitoring
Paul Bush, founder of Legal Dockets Online While most attorneys are aware that many courts around the country have been offering inexpensive and free access to case dockets on the Internet for years, many are not aware that dockets can be automatically monitored for free as well. Attorneys and other researchers tend to get set in their ways, relying upon vendors to inform them which court jurisdictions are available for automatic monitoring, and which aren’t. In addition to being too busy or thinking they lack the technical ability, many people just don’t know which courts are offering docket sheets, and the methods used to monitor them.
The method for setting up a system to monitor court cases is very simple.
Federal District and Bankruptcy Courts
Currently, there are about 150 U.S. district and bankruptcy courts that utilize the CM/ECF system. In addition to the obvious benefits of docketing and electronic filing, another valuable feature of CM/ECF is electronic noticing. This is an automated process whereby the text of new case docket entries, and links to the associated documents, are distributed via e-mail. In order to participate in electronic noticing in most courts, you must first obtain an electronic case filing account. The specific requirements for obtaining an ECF account vary from court to court, but you must be admitted to practice in a court before your ID and password will be issued. Some courts allow an attorney to sign up online. They will activate the account within hours. Others require mailing a hardcopy of the ECF application. They may also require training.

Judiciary Home District Court Home Site Map Since most people appearing before a court in this state initially appear in District Court, this court has been divided into five divisions to provide easy geographic access to the court system. District Court jurisdiction includes small claims, violations of municipal ordinances and regulations, and misdemeanors when the right to a jury trial in the first instance has been waived. If a defendant invokes the right to a jury trial, the case is transferred to the Superior Court. Appeals from District Court decisions go to the Superior Court for trial de novo. Violations and hearings on involuntary hospitalization under the mental-health, drug-abuse, and alcoholism laws also fall under District Court jurisdiction. District Court hears appeals from and orders compliance with the subpoenas and rulings of the state tax administrator and several regulatory agencies and boards. District Court also hears violations of state and local housing codes except when a Municipal Court has been established to handle these matters. Decisions in all these areas are subject to review by the Supreme Court only.

State and Local U.S. District Court Rules

While the familiar discovery rules apply to electronic documents as they did to paper, some jurisdictions have enacted additional provisions specifically addressing electronic discovery. Below is a summary of state codes and federal local rules.
Update on Draft Electronic Discovery Amendments to the Federal Rules of Civil Procedure
On June 15-16, 2005 the Committee on Rules of Practice and Procedure approved a package of changes to the Federal Rules of Civil Procedure that address the discovery of electronically stored information. The proposed amendments include some modifications from the amendments that were circulated for public comment in August of 2004. For example, the amendment to Rule 37(Sanctions) was completely re-written after public comment.
The Committee submitted the new rules and amendments to the Judicial Conference on July 25, 2005 for consideration at its September 2005 session with recommendations that they be approved and transmitted to the Supreme Court. The July 25, 2005 submission contained substantial revisions to the comments. The earliest these proposed amendments can take effect is December 1, 2006.

Australia
District Court is the name given to the intermediate court in some Australian States. They hear indictable (serious) criminal offences excluding treason, murder and manslaughter. Their civil jurisdiction is also intermediate, typically being for civil disputes where the amount claimed is greater than a few tens of thousands of dollars but less than a few hundreds of thousands of dollars. The limits vary between Australian States. In Victoria, the equivalent Court is called the County Court. Below them is the Magistrates' (or Local) Courts. Finland has 61 district courts, which deal with criminal cases, civil cases and petitionary matters. Each court is headed by the Chief Judge and other District Judges. In certain cases, the district court may also have Lay Judges. The cases are handled and resolved either in a session or in chambers. In simple cases decisions can be made by notaries. edit
Hong Kong
The District Court in Hong Kong , established in 1953, has limited jurisdiction in both civil and criminal matters. With effect from December 1, 2003, it has civil jurisdiction to hear monetary claims up to $1 million or, where the claims are for recovery of land, the annual rent or rateable value does not exceed $240,000. In its criminal jurisdiction, the court may try the more serious cases, with the main exceptions of murder, manslaughter and rape. The maximum term of imprisonment it may impose is seven years. There are one Chief District Judge and 30 District Judges, among which three District Judges sit in the Family Court and two District Judges sit in the Lands Tribunal as Presiding Officers.

    In the English and Welsh legal system , magistrates hear prosecutions for and dispose of summary offences, by making orders in regard to and placing additional requirements on offenders. Magistrates' sentencing powers are limited, but extend to shorter periods of custody, fines, probation and community service orders, and a miscellany of other options. Magistrates hear committal proceedings for indictable offences, and establish whether sufficient evidence exists to pass the case to a higher court for trial and sentencing. Magistrates have power to pass summary offenders to higher courts for sentencing when, in the opinion of the magistrate, a penalty greater than can be given in magistrates court is warranted. A wide range of other legal matters are within the remit of magistrates, such as certain licensing matters. In the past, magistrates have been responsible for granting licences to sell alcohol, for instance, but this function is currently being shifted to local councils. MSU Law began its $600,000 work on the Clif and Carolyn Haley Moot Court Room in August 2004 to upgrade its technology. The law college has a current, up-to-date courtroom system similar to systems that its students and graduates will use in real courts across the country. This newly enhanced facility makes it possible for the law college to prepare its students to be outstanding trial attorneys in an age of technology. “The use of technology in the court system has drastically risen in the past few years,” said Dean Terence L. Blackburn. “In 1999, the U.S. Courts initiated a nationwide project to equip at least one courtroom in each of the 94 districts with a state-of-the-art evidence presentation and videoconference system. Court Security
Senior inspectors, deputy marshals and contracted court security officers (CSOs) provide security inside federal courthouses in each of the 94 federal judicial districts and in the District of Columbia Superior Court. The Marshals Service protects more than 2,000 sitting judges and countless other court officials at over 800 locations where court-related activities are conducted throughout the nation.
In recent years, there has been a dramatic increase in the number of threats against members of the judiciary, U.S. attorneys and other court officers. Explicit threats against the judiciary are assessed by court security inspectors to determine the level of danger. On average, about 700 threats/inappropriate communications against judicial members are logged each year - many of which result in round-the-clock protective details.

It's simple. Courts can be divided into two groups: those of a federal nature, and those in each state. Briefly, the federal court system involves a range of courts including the Federal Court, the High Court and the Family Court. The Federal Court hears matters which may involve federal laws or matters which involve more than one state. The High Court , which sits in both Canberra and each capital city, is used as a court of appeal for parties dissatisfied with state and federal court decisions. It also deals with interpretation of the constitution. The Family Court is a federal court set up specifically to hear matters involving child custody and matrimonial affairs. Matters are heard in all states and territories by a single judge. Appeals against the decisions of these judges are heard by a bench of three family court judges. The decisions of these benches may be appealed in the High Court. The Family Law Act (Section 121) is a federal law which prohibits the identification of any party concerned with a Family Law matter. This includes witnesses.

August, 2002 The openness of judicial proceedings has always been a fundamental principle of the state court system in the United States. However, the courts are finding themselves faced with some unexpected consequences of such an open access system as they become increasingly reliant upon the Internet. With caseloads growing each year, the Internet has become a valuable tool for court officials in terms of managing cases in an efficient and timely manner and streamlining document processing. At the same time, courts are using the Internet to give the public electronic access to court records, making judicial proceedings more transparent but also making widely available personally identifiable and sometimes sensitive information that, while legally a matter of public record, used to be practically obscure.

We amend the Supreme Court Statement on Limited Jurisdiction Courts under Amendment 80 dated November 25, 2002 to make clear that implementation of the policies will take place in stages and to establish a final deadline for full implementation of January 1, 2009. With this amendment, we republish the Supreme Court Statement on Limited Jurisdiction Courts under Amendment 80 Amendment 80 revised the Judicial Article of the Arkansas Constitution, and it places substantial responsibility for its implementation on the Supreme Court. In furtherance of this responsibility and as the head of the Judicial Department of state government, we publish the following: Arkansas Supreme Court Statement on Limited Jurisdiction Courts Under Amendment 80 The adoption of Amendment 80 to the Arkansas Constitution by the citizens of Arkansas has created significant change in thestructure and administration of our state court system. In 2001 our probate and chancery courts were eliminated and a unified circuit court of general jurisdiction was created. Five divisions of circuit court were created and a system for the establishment of local case administrative plans was put in place. In 2002 a change in the process for the selection of state court judges was implemented with the move from partisan to non-partisan judicial elections. Amendment 80 also requires change and improvement of our limited jurisdiction court system. The implementation date for these changes is January 1, 2005. In many respects, the reform of these courts is the most significant area of constitutional change. Arkansas' limited jurisdiction courts have historically operated as "step-children" in our state court system; in fact, in very few respects could they be considered "state" courts. Pre-Amendment 80 constitutional and statutory provisions create five different limited jurisdiction courts, each with conflicting and overlapping jurisdiction. Almost all of these courts operate on a part-time basis and there is little consistency in practice and procedure from jurisdiction to jurisdiction.
