An Overview of Court Process
Courts are the most visible part of our legal system. Though many legal issues and disputes are never brought to the courthouse, each year approximately seven million new cases are filed in New Jersey's courts. In those cases, judges are called upon to decide disputes involving such diverse topics as criminal law, motor vehicle violations, divorce, and other family matters, wills, contracts, defective products, and of course our basic rights as Americans, such as freedom of speech. People set the agenda for New Jersey Courts through these cases, and it is through these cases that courts influence our lives. The structure of New Jersey's court system is among the simplest in the nation. There are only a few basic types of courts in the state. Municipal courts, Tax Court, state Superior Court, which includes the trial courts, an Appellate Division and the New Jersey Supreme Court. The Chief Justice of the Supreme Court of New Jersey is Deborah T. Poritz.

NEWS RELEASE CONCORD—Chief Justice Walter L. Murphy of the Superior Court has asked the Attorney General’s Office to investigate reports that members of the public have been receiving "e-mails" purporting to come from the Superior Court, summoning them to jury duty and requesting them to fill out questionnaires asking for personal information. "The court system would never contact a potential juror by e-mail and no one should respond to these requests," Murphy said. Superior Court clerks in Manchester, Concord and Nashua have received reports about the e-mails, which apparently also threaten court-imposed sanctions if the e-mail questionnaires are unanswered.

  • What is a Court Case?
    Introduction There are four levels of courts in the Alaska Court System, each with different powers, duties and responsibilities. Alaska has a unified, centrally administered, and totally state-funded judicial system. Municipal governments do not maintain separate court systems. The four levels of courts in the Alaska Court System are the supreme court, the court of appeals, the superior court and the district court. The supreme court and the court of appeals are appellate courts, while the superior and district courts are trial courts. Jurisdiction and responsibilities of each level of court are set out in Title 22 of the Alaska Statutes. The supreme court and the superior court were established in the Alaska Constitution. In 1959, the legislature created a district court for each judicial district and granted power to the supreme court to increase or decrease the number of district court judges. In 1980, the legislature created a court of appeals. The chief justice of the Alaska Supreme Court is the administrative head of the Alaska Court System. An administrative director is appointed by the chief justice with concurrence of the supreme court. The director supervises the administration of all courts in the state.

    AG's Task Force Makes 44 Recommendations to Reduce Domestic Violence July 26, 2005
    FOR IMMEDIATE RELEASE
    (SAN FRANCISCO) – Attorney General Bill Lockyer today released a report revealing that the criminal justice system is failing to enforce California's domestic violence laws. Joined by statewide leaders, Lockyer called for implementation of 5 key recommendations to reduce domestic abuse and challenged local law enforcement and judicial officers to increase and improve their efforts to stop the cycle of family violence.
    "The laws already on the books should be holding batterers accountable for their violent behavior, but the criminal justice system often fails to enforce them," Lockyer said. "System fatigue is not an excuse for domestic abuse. We are going to shift a culture of complacency into a culture of compliance."
    The report is based on an extensive two-year assessment by Attorney General Bill Lockyer's Task Force on Local Criminal Justice Response to Domestic Violence a 26-member group of experts and leaders in law enforcement, the courts, victim advocacy, public health and the legislature.

    Dear Mr. Wepsiec:
    I have your letter wherein you inquire whether the circuit court may direct the expenditure of the fees collected pursuant to section 5-1101 of the Counties Code (55 ILCS 5/5-1101 (West 1996)). For the reasons hereinafter stated, it is my opinion that these fees are, in general, required to be paid into the county general fund, and the proceeds thereof are subject to appropriation by the county board for purposes relating to operation of the court system; the circuit court has no authority to direct or restrict the expenditure of such funds. Section 5-1101 of the Counties Code permits a county board to impose by ordinance or resolution an additional fee to be collected in criminal and traffic cases. Subsection 5-1101(e) of the Code provides: (e) The proceeds of all fees enacted under this Section shall, except as provided in subsection (d), be placed in the county general fund and used to finance the court system in the county, unless the fee is subject to disbursement by the circuit clerk as provided under Section 27.5 of the Clerks of Courts Act."

    Chairman Inouye, Vice-Chairman Campbell, and Members of the Committee: I appreciate the opportunity to appear before this Committee to discuss the Justice Department's proposed Fiscal Year 2003 budget priorities for Indian Country. As the Committee is aware, for far too long the needs of Indian tribal governments in combating crime and violence have been ignored. This Administration is committed to addressing the most serious law enforcement problems in Indian Country, including substance abuse, domestic violence, and other violent crimes and to ensuring that Indian tribes are full partners in this effort. One of the Department's primary resources for funding and other assistance in Indian Country is the Office of Justice Programs (OJP). Through OJP and its component bureaus, the Department identifies emerging criminal and juvenile justice system issues, develops new ideas and tests promising approaches, evaluates program results, collects statistics, and disseminates these findings and other information to federal, state, and local units of government, Indian tribes, and criminal justice professionals. OJP works to prevent and control crime and help crime victims by providing funding to and assisting state and local governments, Indian tribes, law enforcement, prosecutors, courts, corrections, and other service providers.

    From the get-go, the trial of so-called "20 th hijacker" Zacarias Moussaoui has been hamstrung by a Justice Department that seemingly wanted one prosecution to serve half a dozen irreconcilable ends. With a single deft trial, Attorney General John Ashcroft had hoped to avenge the evil of Sept. 11 for all Americans, while showcasing the even-handedness of the American justice system for the rest of the world. He wanted to soothe us with proven legal truths: He did it, and he paid for it with his life. And Ashcroft thought he could demonstrate to terrorists everywhere that transparency and due process would triumph over theocracy and prejudice. But as this prosecution unravels, indecision on the part of the Justice Department reveals nothing less than the government's own lack of faith in the courts. Moussaoui—intent on defending himself—undid the government by using transparency and due process to embarrass the prosecution and allegedly compromise national security. The man refused to go quietly, insisting on challenging the evidence against him and exercising his full range of rights as a criminal defendant. The prosecution—applying a broad new theory of conspiracy law—didn't help matters by filing an indictment shot through with circumstantial evidence and unsupported speculation. And so Moussaoui, considered nuttier than a Snickers bar when this trial began almost a year ago, suddenly looks like a Jeremiah. His ongoing contention—that the proceedings are nothing more than a "death show trial" jiggered to result in his execution—suddenly looks to be true.
