Procedures relating to sureties in the Supreme Court What is Bail?
Being on bail means a person does not wait in gaol for his or her case to be heard. A person can bail from either:
  • the police (when first arrested),a
  • a Magistrate in a Local Court,
  • a Judge in the District Court, or
  • a Justice of the Supreme Court.

Surety and bail
A surety is someone who is often mentioned in a bail undertaking. Bail is an agreement to attend court to answer a criminal charge. It can be granted at any stage of criminal proceedings. Often, when bail is granted, a number of conditions are applied to the bail undertaking. These can include surrendering a passport or agreeing to report to police on a regular basis. A well known condition is requiring the deposit of a sum of money with the Court and agreeing to forfeit that money if bail is breached. Conditions include offering security to the Court (such as property).
Who can be a surety?
To be accepted as a surety, the Judge in Court or Justice of the Peace (JP) who the bail undertaking is signed in front of, must determine that you are of suitable character. This may involve doing a criminal record check.

COMPETENCY - GENERALLY These procedures deal with adult criminal defendants or a child who has been adjudicated to be tried as an adult. A defendant has a constitutional right not to be tried if he or she is "legally incompetent;" i.e., not capable of understanding the proceedings against him or her or assisting his or her lawyer in the preparation of his or her defense. N.H. Const. pt. I, art. 15 State v. Champagne , 127 N.H. 266 (1985). INTRODUCTION What This Information Sheet Covers This Information Sheet looks at the steps that a creditor (a person to whom money is owed) can take to recover a debt. There can be two stages to recovering a debt through the Court system:
  • obtaining judgement – getting an order from the Court or Disputes Tribunal that money is owed enforcing judgement – getting the Court to enforce payment if the debtor doesn’t pay after the creditor has obtained judgement

Court Procedures for Family Law
The courts that can deal with family law matters are the: Family Court Pre-action Procedures
Usually it is necessary for people wishing to resolve disputes involving children or property to complete pre-action procedures in order to attempt to reach an agreement before filing an application in court.
These procedures are:
  • Mediation; and
  • Sending a letter notifying the other party of an intention to start a case, and try to agree on an outcome by exchange of correspondence which includes genuine offers of settlement, and include a copy of the Family Court Pre-Action Procedure (Parenting and/or Financial); and
  • Disclosing all other information and documents relevant to the dispute.
It is not necessary to complete these procedures where: Agreements
Agreements reached about children or property settlement can be formalised by a court order.
