(View pdf) Rules of Civil Procedure Pursuant to such rule making power the Supreme Court appointed a Civil Procedural Rules Committee to assist the Court in the preparation and revision of the Rules. The Rules of Civil Procedure were recommended by the Committee and adopted by the Court. Specific numbers were assigned to the chapters of the rules as they were promulgated pursuant to a general plan. The explanatory notes following the Rules were prepared by the Committee for the convenience of the Bench and Bar but were not part of the Rules and were not officially adopted or promulgated by the Supreme Court. By an order of the Supreme Court dated December 31, 1968, all rules then in force governing practice and procedure in courts, including the rules of civil procedure, were continued in force under the Constitution of 1968 until suspended, revoked or modified pursuant to Article V, Section 10(c) of that Constitution.

Wichita Municipal Court Leaving City Of Wichita Website City of Wichita City Offices Municipal Court Rules of the Municipal Court Rule 12: General Practice and Procedure All pleadings, briefs, and other papers prepared by attorneys or litigants for filing in the courts shall, unless the judge specifically permits otherwise, be typed with black ink on one side only of standard size (8 ½" x 11") sheets and shall include the name, address, and telephone number of the attorney (or of the defendant, if the defendant has no attorney) filing them. Typing shall be double-spaced except that single spacing may be used for subparagraphs, legal descriptions of real estate, itemizations, quotations, and similar subsidiary portions of the instrument. The Municipal Court docket number (if available) and the Wichita Police Department case number must be included with the caption upon each pleading to be filed. In the absence of a specific directive by the court, the original of a pleading, brief or memorandum shall be filed with the clerk of the court. Other communications with the judge shall be mailed or delivered to the judge handling the matter at his chambers. Copies of briefs, memoranda or communications shall be forwarded to other counsel of record. This rule does not supersede the requirement of any specific statute, ordinance or rule as to the filing of documents.

Definitions:
  • Provincial Court/Small Claims Court: There are different levels of courts in Saskatchewan. The first level of court is called Provincial Court. The Small Claims Court is the same as the Provincial Court. This level of court also deals with most of the less serious criminal matters. In Small Claims actions, the court cannot grant a judgment for more than $5,000.00 plus interest. There are also certain types of actions that the Provincial Court cannot hear. An example might be a law suit against a Government, a dispute over who has the right to be the registered owner of land, etc.
  • Court of Appeal:
  • Other Specialized Courts: There are also other specialized courts such as the Federal Court, Trial Division and the Federal Court of Appeal. If someone is suing to enforce a trademark or patent, for example, or if they are suing the federal government, they may choose to proceed through the Federal Court instead. There are also other courts such as the Tax Court of Canada that this article does not discuss specifically. However, many of the documents and procedures described here apply in general to those courts as well.
  • Statement of Claim: This is the document that most court actions are commenced with. It begins by setting out who the parties are and contains a warning statement to the person being served, advising them that they have a limited time to respond to the claim. If they do not, judgment can be entered against them without notice. The balance of the document sets out general facts about the claim and then describes the remedy that the person suing is asking for. If someone is served with a Statement of Claim there are only a certain number of days to respond to it by serving a Statement of Defence and filing a copy with the court. If that is not done, the person suing will usually be entitled to judgment without further notice to the Defendant. If a Statement of Defence is served and filed by the Defendant, then there are many steps to be followed before the court can make a decision. Those steps are outlined below.

    PROBATE COURT PROCEDURE BULLETIN 23 (REVISED) RELATIVE TO: PROBATE MEDIATION PROCEDURES Following are general procedures for processing mediation cases in the probate courts. Refer also to Administrative Order 11 for additional information. An appendix of forms is attached for reference. DISSEMINATION OF INFORMATION
  • Brochures will be available to the public at each of the probate courts, at the counter, in judge's chambers and in court rooms. Using the Probate Court form #228 "Structuring Order" at structuring conferences will lead to a discussion of the availability of mediation; brochures may be distributed at that time as needed.
  • SCHEDULING MEDIATION
  • Mediation may be initiated at the structuring conference by using the Structuring Order (AOC-228-003) or, if a party decides at a later time that they would like to pursue mediation, by a general motion to the court. Each court may want to designate a specific day or days per month for mediation sessions (ex: first Wednesday; second and fourth Thursdays) in order to avoid conflicts with other courts who will be using the same mediator resources. When mediation is needed, the courts will know when the next available mediation date will be, and will have reserved space for the sessions. At the structuring conference, the parties will agree to a mediation date based on ones suggested by the court. At that time, the court will also determine who the parties to the mediation are; those parties will be the only ones to receive notice of the mediation session and will also be expected to attend the mediation session. Parties will be advised at the hearing that they will receive a mediation notice telling them which mediator has been assigned to the case and also confirming the mediation date. The court staff will then select a mediator from the List of Mediators, and call to confirm the mediator's availability for the date selected. This last step may be done after the parties have left.
