The Appellate Rules Advisory Committee has written a new Rule 32.1 which permits attorneys and courts in federal appeals in all circuits to cite unpublished opinions. At its June 2004 meeting, the Standing Committee on Rules of Practice and Procedure asked the Appellate Rules Advisory Committee to ask the Federal Judicial Center to conduct empirical research that would yield results helpful to the Standing Committee's consideration of the proposed rule. The Center's research effort consisted of three components: (1) a survey of judges, (2) a survey of attorneys, and (3) a survey of case files. This report was presented to and considered by the Standing Committee during its June 15-16, 2005 meeting, at which it approved the Advisory Committee's proposed rule for consideration by the Judicial Conference at its September 2005 meeting.

Winter 2000, Vol. 6, No. 2, p. 12 By Diane Cabell One of the most active areas of litigation involving the Internet has been generated by the conflict between trademark law and domain names. The basic conflict stems from the fact that trademark law allows for multiple uses of the same word. Two different entities may label their products with the same name, as long as the consumer is not likely to be confused or deceived as to the affiliation, connection or association of the two. Ford automobiles are not confused with Ford agency fashion models. Consumers do not call Delta Air Lines in order to purchase Delta faucets. Unfortunately, in cyberspace there is only one “delta.com.” This new policy imposed a mandatory dispute procedure on domain holders. Resolution services will be supplied by approved providers. Three organizations that have received provider accreditation are the World Intellectual Property Organization, The National Arbitration Forum and a small US/Canadian startup, eResolution.org. Others may be approved soon.

Raj Bhala presented a one-week training course on the World Trade Organization to 40 officials of the Taiwan government from several different ministries and bureaus in October. He presented a paper, “Fundamental GATT Obligations and Recent WTO Developments,” at the Second International Law Conference of the Indian Society of International Law in New Delhi in November. Laura Bond Robert Casad published supplements to three books: Casad, Jurisdiction and Forum Selection Jurisdiction in Civil Actions , (3rd ed., 2 vols.), and Gard And Casad, Kansas Code of Civil Procedure Annotated , (4th ed., 3 vols.) Carolyn Clark presented “Unauthorized Practice of Law and the Provision of Legal Information,” Federal Statutory Research on the Internet,” and “ Federal Judicial Research on the Internet” at a Kansas University Continuing Legal Education program in August. She presented, “Avoiding Unauthorized Practice of Law at the Reference Desk,” at the Southeastern Kansas Library System In-Service in October. While it appears foreign-born women did not complain about any remaining link between a woman's naturalization and her husband's, some Naturalization Bureau officials thought any remaining connection was unfair.(14) Clear dissatisfaction was expressed by U.S.-born women who, in many cases, belatedly discovered they had lost their citizenship by marriage prior to September 1922 and now must petition for naturalization if they wished to regain it. After considering that other Americans who expatriated themselves by swearing allegiance to another nation during World War I needed only to take the oath of allegiance in court to restore their U.S. citizenship, U.S. Commissioner of Naturalization Raymond Crist suggested that Congress might create some similar provision for U.S.-born women: Some women feel that a certain stigma attaches to the need of "naturalization" in the same manner as any lowly immigrant. TITLE IX PROCEDURE
Section 1 General Provisions
Article 73 Statement of reasons on which decisions are based
Decisions of the Office shall state the reasons on which they are based. They shall be based only on reasons for evidence on which the parties concerned have had an opportunity to present their comments.
Article 74 Examination of the facts by the Office of its own motion
1. In proceedings before it the Office shall examine the facts of its own motion; however, in proceedings relating to relative grounds for refusal of registration, the Office shall be restricted in this examination to the facts, evidence and arguments provided by the parties and the relief sought.
2. The Office may disregard facts or evidence which are not submitted in due time by the parties concerned.
Article 75 Oral proceedings
1. If the Office considers that oral proceedings would be expedient they shall be held either at the instance of the Office or at the request of any party to the proceedings. 2. Oral proceedings before the examiners, the Opposition Division and the Administration of Trade Marks and Legal Division shall not be public.

  • Carol Anderson made a day-long presentation in December Anderson on Advocacy. The presentation received stellar reviews.
    February
    Professor Anderson is also overseeing the regionals of the National Trial Competition which is being hosted by Wake Forest School of Law during the first week in February. This competition involves the coordination of over 100 volunteer participants who serve as judges and witnesses as well as 20 teams from law schools across the country. In addition, Professor Anderson has been actively working with the Wake Forest Trial Team to prepare them for the competition.
    Finally, Professor Anderson is assisting local lawyers with a focus group/mock trial for an upcoming capital case. She and clinic student, Brad Roehrenbeck, developed a mock jury made up of Forsyth County citizens to view the evidence and gauge their reaction February by the Harvard Journal on Legislation Journal of National Security Law and Policy.
