Dear Mr. Corey: You have asked whether the Federal Credit Union Act (Act) and NCUA’s lending regulation preempt a Connecticut law that bars financial institutions from permitting borrowers to use credit cards to access a home equity line of credit (HELOC).  C ONN . G EN . S TAT . A NN . §49-2(c)(9)(C).  Our opinion is that, because the effect of this state law is to regulate the conditions of loans, lines of credit or credit cards, it is preempted, and the State of Connecticut may not require federal credit unions (FCUs) to comply with it. The Connecticut law permits advances under a mortgage for a “consumer revolving loan,” commonly known as a HELOC.  The issue is that the Connecticut law defines a consumer revolving loan as: [A] loan . . . which . . . does not authorize access to the loan proceeds by credit card or any similar instrument or device, whether known as a credit card, credit plate, or by any other name, issued with or without a fee by an issuer for the use of the cardholder in obtaining money, goods, services, or anything else of value on credit . . . .

Gastman and McKinley Center Associates (hereafter "Gastman"), seeking rescission of a policy insuring Gastman's life. *fn1 The policy lapsed because Gastman failed to make a premium payment, and Connecticut Mutual argued below that it had been induced to reinstate the policy by the misrepresentations of Gastman in the application for reinstatement. On cross-motions the district court ruled that Connecticut Mutual was entitled to rescission of the policy, granted it summary judgment, and dismissed a related action which had been brought by Gastman and McKinley Center Associates for a declaration of the value of the policy.

The statute authorizing this weapons seizure - the first of its kind in the U.S., and one of the toughest gun-seizure laws in force - was passed by the Connecticut legislature in June 1999 in the wake of a March 1998 murder-suicide by Matthew Beck, a 35-year old accountant who killed four people in the headquarters offices of the Connecticut Lottery before killing himself. The product can be sold by pharmacies with a prescription. Marinol is intended for use to alleviate the side effects of chemotherapy. But Marinol itself has negative side effects, sometimes lasting two days, that has affected its popularity. Marinol is a Schedule II controlled substance because of the form of the product. Ind. Courts - More on Terre Haute Court's closing - bankruptcy court to remain open until 11/08
The Indianapolis Star has a little more information today on the closing of the S.D. Indiana's location in Terre Haute. The bankruptcy court will continue to operate and will remain in the federal building downtown until the building is turned over to Indiana State University in November 2008. * * * The district also has courthouses in Indianapolis, Evansville and New Albany and has had five judges since 1978. In February, judges asked Congress to add a sixth judge after a study found the district's judges had the third-heaviest case load among the 94 federal districts.
