Ominously dubbed the "turn in your neighbor" law, a new Connecticut gun control provision which proponents predicted would be rarely used has already resulted in police seizing firearms and ammunition from four gun owners since Oct. 1 when the law took effect. Hailed as groundbreaking by gun control advocates, the law reportedly opens up a new frontier for gun laws in the coming election season. As originally written, the provision would have allowed seizure of firearms by police based on unproven allegations by any two persons in an affidavit to a judge. The language was later modified to require that two police officers or a state's attorney go before a judge with the belief, after investigation, that an individual "poses a risk of imminent personal injury to himself or herself or to other individuals," in order to obtain a warrant to seize the subject's firearms. No crime needs to have been committed for the seizure to take place. Alleged threatening behavior, cruelty to animals, alcohol and drug abuse or prior confinement in a psychiatric facility can be considered by a judge in assessing whether an individual poses an imminent risk of danger. The law requires that a hearing be held within 14 days of the firearm seizure, although critics say in practice the 14-day hearing will be delayed for months. If the subject is proven at the hearing to be an "imminent risk," he loses his firearms for one year.

Summary of Connecticut's Prevailing Wage Law Connecticut’s prevailing wage law is codified in Connecticut General Statutes Section Section 31-53 and . The law applies to each contract for the construction, remodeling, refinishing, refurbishing, rehabilitation, alteration or repair of any public works project by the State or its agents, or by any political subdivision of the State. Coverage: Conn. Gen. Stat. Section 31-53(g) provides monetary thresholds which must be met before the law is applicable. The FTC staff comments suggest that a restrictive interpretation of Connecticut law could diminish competition from these relatively recent entrants, who often sell via mail order or over the Internet. According to the FTC staff comments, which are available on the Commission's Web site as a link to this press release, requiring stand-alone sellers of replacement contacts to obtain Connecticut optician's and optical establishment licenses "would likely increase consumer costs while producing no offsetting health benefits." "Indeed," FTC staff concluded, "such licensing could harm public health by raising the cost of replacement contact lenses, inducing consumers to replace the lenses less frequently than doctors recommend or to substitute other forms of contact lenses that pose greater health risks."

Rowland pledged Thursday to sign legislation that would require new high-voltage lines to be buried, including a pending controversial project proposed by two major utilities. Both the state House and Senate overwhelming approved the restrictive measure that is being hailed as the toughest in the country when it comes to regulating electric transmission lines. "It’s outstanding," said state Sen. Winthrop Smith, R-Milford. "The power companies kept saying, ‘We can’t do this. No one else has done this,’ and we said, ‘Oh, yes we can,’ and we did it." A previous form of the bill included strict buffers, but the language was deleted in order to get the bill approved. The Siting Council will use its discretion in setting appropriate buffers.

Substitute Senate Bill No. 301 PUBLIC ACT NO. 96-258 (effective Oct 1996) AN ACT CONCERNING ACCESS TO GENEALOGICAL RECORDS AND THE VALIDATION OF CERTAIN MARRIAGES. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 7-41a of the general statutes, as amended by sections 12 and 21 of public act 95-257, is repealed and the following is substituted in lieu thereof: All records of vital statistics including births, marriages and deaths in the custody of any registrar of vital statistics or of the Department of Public Health shall be open for research to any member of a [legally incorporated] genealogy society INCORPORATED OR AUTHORIZED TO DO BUSINESS OR CONDUCT AFFAIRS IN THIS STATE and such societies shall be permitted to incorporate statistics derived therefrom in their publications. Sec. 2. Section 7-51 of the general statutes, as amended by sections 12 and 21 of public act 95-257, is repealed and the following is substituted in lieu thereof:

Gordon There is a crisis in access to legal services in this country. According to the American Bar Association, each year 38 million low- and moderate-income Americans are closed out of the civil justice system because they cannot afford to hire a lawyer. In large part, this is due to the refusal of the bar to allow competition from any source, whether it is non-lawyers or out-of-state lawyers. Fortunately, the Connecticut legislature has taken a step toward solving this problem. Unfortunately, its solution only benefits 188 people-Governor John Rowland and the 187 members of the General Assembly-while leaving the other 3.5 million residents of the state subject to the existing protectionist regime. On March 10, the General Assembly unanimously passed an emergency bill allowing out-of-state counsel to work for the governor and the legislature on impeachment matters. It is ironic that the legislature used an "emergency" bill to provide for its own legal needs, but fails to recognize the real emergency inherent in the lack of access to the law for the average person. Restrictions on who can provide legal services need to be lifted across the board, not just for the impeachment investigation. No doubt the General Assembly and the governor have good reasons for employing out-of-state counsel. In the case of impeachment, it is likely that the attorneys best qualified to handle the issue are not from Connecticut. However, this is also true of attorneys in the fields of estate planning, divorce, corporate law, civil rights, employment or any other specialty. Consumers of legal services have a right to the service provider they feel is best for them. The legislature and governor are justifiably entitled to use attorneys from New York and Washington if they feel it best meets their needs. They should also be allowed to use the advice of a Yale University political science professor. So, too, should a resident of Greenwich be permitted to have a New York attorney, or even a non-lawyer, draft her will if that person would better serve her for reasons of quality, price or convenience.
