Volume 1 Number 4 - July 1995 Anal Sex Law Ruled Discriminatory Both the Federal Court and the Ontario Court of Appeal have ruled unconstitutional section 159 of the Criminal Code, which provides for jail sentences for unmarried people who engage in anal intercourse while one is under 18 years. In both cases the Federal Crown ( Halm v Canada ) and the provincial Crown ( R v Carmen M ) had argued that the provision was necessary, in part, to prevent the spread of HIV infection. The decisions may be seen as affirming the right to freedom of sexual expression, particularly of gay men. However, the decision to prosecute, the decision to appeal, and the arguments presented by the prosecution raise serious questions about the lack of awareness and sensitivity of the prosecutors in these cases regarding HIV and AIDS, which has implications for the use of the criminal law in other HIV-related cases. In Halm Justice Reed considered an application to set aside a conditional order for deportation against Henry Halm, a non-Canadian. To obtain the deportation order the Crown had to show that Halm had been convicted of an offence which carries a penalty of 10 years or more imprisonment if committed in Canada. Halm had been convicted in New York State of sodomy offenses involving anal intercourse with boys aged between 14 and 18. He argued that the crimes had no equivalent in Canada because section 159 of the Canadian Criminal Code , which would otherwise apply, was unconstitutional.

Volume 2 Number 1 - October 1995 Criminal Law and HIV/AIDS Whether or not the criminal law should be used to deal with the behaviour of HIV-positive persons who put others at risk of contracting HIV is a hotly debated topic and has received much attention in the media and from policy- and law-makers. As Patterson reported in a previous issue of the Newsletter Canada has so far resisted the temptation to amend the Criminal Code to contain a provision specifically dealing with HIV transmission or endangerment of transmission. However, Federal Minister of Justice Allan Rock declared in January 1995 that he was considering a Criminal Code amendment to make it a crime to "knowingly communicate" HIV. In the absence of an offence to "knowingly communicate" HIV, there have been at least 11 cases in which existing Criminal Code provisions have been used to deal with HIV transmission or endangerment thereof. In most of these cases, prosecutions have been successful and have resulted in terms of imprisonment of up to 11 years. The following is the first part of a review of these cases. Criminal Code DNA Provisions
The provisions of the Criminal Code that govern the taking of bodily substances for law enforcement purposes have been carefully designed to be respectful of constitutional requirements. The DNA profiles derived from bodily substances obtained from a suspect under a Criminal Code DNA warrant are only to be used in the investigation and prosecution of a designated offence and are not to be included in the national DNA data bank. This approach is consistent with the constitutionally protected presumption of innocence and permits the use of the DNA information either to exclude the person as a suspect or as evidence against the person by establishing a link between that person and the alleged crime. The DNA profiles derived from bodily substances taken from offenders who have been convicted of a designated offence under a Criminal Code DNA data bank order are only to be included in the convicted offenders index . The national DNA data bank helps law enforcement agencies identify or exclude offenders alleged to have committed other designated offences, including those committed before the coming into force of the DNA Identification Act The DNA warrant scheme and the DNA data bank scheme have a number of features in common, including:

... Gerald L. Shargel Michael Cahill joins BLS as an Assistant Professor of Law. Previously, he was a Visiting Assistant Professor at Chicago-Kent School of Law and an Adjunct Professor at Northwestern University School of Law. His primary areas of interest are criminal law and health law. From 2000-03, he was the staff director of the Illinois Criminal Code Rewrite and Reform Commission helping to draft and revise criminal code provisions. He has also served as a consultant on the Penal Code Reform Project of the Kentucky Criminal Justice Council. Among his publications are the book, Law Without Justice: How, and Why, Criminal Law Deliberately Sacrifices Justice , co-authored with Paul H. Robinson (Oxford University Press, forthcoming), and two articles co-authored with Peter D. Jacobson published in the “Pegram’s Regress: A Missed Chance for Sensible Judicial Review of Managed Care Decisions”(2001); and “Applying Fiduciary Responsibilities in the Managed Care Context” (2000). Professor Cahill was a law clerk to Judge James Loken of the United States Court of Appeals for the Eighth Circuit. He is a graduate of Yale University and received an M.P.P. from the University of Michigan School of Public Policy. In the meantime, the size of the web and the power of search engines have both leaped forward. The growth of the web has made representative or comprehensive link pages more difficult to produce, and the improvement of search engines has made them less necessary. Link pages can still be very useful, but to make them more useful than the best search engines takes more work than they are usually worth. So I won't be updating this link page (from the previous iteration of the course) but I leave it online in case it has any remaining utility. When I know of specific web pages helpful for a class discussion, then I'll mail out the URLs to the class email list during the semester (and I encourage you to do the same). For general online research on the many topics of the course, I recommend Google There are hundreds of good web pages that collect links to U.S. law. The only excuse to make another one is to customize it for (1) undergraduate students (2) studying law as a liberal art (3) in Indiana (4) for my course, .
