A Long-Term Relationship Put to the Test
"It's appalling to me that our schools can be hijacked by conservative elements that seem to care less about our children than they do about setting forth their own agenda." Planned Parenthood of the Rocky Mountains (PPRM) has been a trusted provider of comprehensive sex education in D-11 for nearly 17 years. But in October 2004, anti-choice zealots forced Planned Parenthood sex educators out of one D-11 high school after three days of heated protest. Then, on November 1, 2004, Eric Christen, one of the most outspoken and conservative of the school board's seven members, called an impromptu press conference to announce that he planned to eject Planned Parenthood from the district and enforce an abstinence-only sex education curriculum.
The Community Speaks Out
When the time came to discuss the future of Planned Parenthood in the school district, the opening comments pushed the debate far off message, careering into discussions of morality, abortion, and even evolution. After two hours of back-and-forth, the board members finally spoke, beginning with Christen, who denounced Planned Parenthood much as he had during his November press conference.

Behavioral Drugs Focus of Debate in Colorado Schools
By MICHAEL JANOFSKY ENVER A resolution recently passed by the Colorado Board of Education to discourage teachers from recommending behavioral drugs like Ritalin and Luvox has intensified a national debate over the growing use of prescription drugs for children. The resolution, the first of its kind in the country, carries no legal weight. But it urges teachers and other school personnel to use discipline and instruction to overcome problem behavior in the classroom, rather than to encourage parents to put their children on drugs that are commonly prescribed for attention deficit and hyperactive disorders. Proponents of the resolution, which passed by a 6-to-1 vote on Nov. 11, said they were motivated, in part, by evidence that they said suggested that dozens of violent crimes, including the massacre last spring at Columbine High School in Littleton, Colo., had been committed by young people taking psychotropic drugs. One of the teenage shooters at Columbine, Eric Harris, had been taking Luvox, an anti-depressant, although there is no evidence that the drug had anything to do with the shootings or that a teacher recommended the use of the medication.

In a December 2003 decision, a Colorado trial court judge invalidated the state’s new school voucher program. The decision was unusual in that the court relied not on traditional separation-of-church-and-state concerns, but instead on a provision of the Colorado state constitution that vests control over public education in local school boards. The court held that by failing to give local school boards any “input whatsoever into the instruction to be offered by the private schools” that accepted voucher students, the state had violated the constitutional provision that grants local boards “control of instruction in the public schools of their respective districts.” The ruling in Colorado Congress of Parents v. Owens , which has already been appealed, illustrates the longstanding tension in American education law between two competing models of the relationship between states and local school boards. The dominant approach has treated school boards as legally subordinate to their states, recognizing that most state constitutions explicitly assign responsibility for and authority over public education to the state government. While the states’ nearly unlimited authority has been repeatedly affirmed by the courts, there has been intermittent legal recognition of the de facto autonomy enjoyed by local school boards in the day-to-day operation and management of their schools. Moreover, as the Colorado decision indicates, courts have occasionally recognized—and even celebrated—the powerful tradition of local control in American education.

Charter Schools in Colorado
A charter school is a public school that is granted a contract, or charter, by the school district in which it operates. The charter provides the terms under which the charter school is to operate, and generally provides freedom from specified school district policies and state regulations. The local board of education has the ability to waive the applicability of any state statutes or regulations other than assessment and accountability requirements. Charter schools also must adhere to laws prohibiting discrimination and requiring special education services. The charter school is responsible for its own operation, although it may contract with the school district for services such as the provision of school facilities or special education.
Charter schools are here to stay in Colorado. Future action with respect to charter schools is likely to include finding ways to sufficiently fund expansion of charter schools without harming other public schools; exploring whether local boards of education are the best chartering authorities for charter schools or whether some other entity, such as the state board of education or an independent chartering authority, is more appropriate; exploring the concept of charter school districts, or districts comprised entirely of charter schools; and encouraging the use of charter schools to help close the achievement gap and promote higher academic performance from traditionally at-risk populations.

Charter schools have emerged in the 1990s as a prominent and controversial school reform idea. This Digest describes characteristics of charter schools, outlines some tentative research findings, discusses advantages and shortcomings, and summarizes challenges rural communities might face in starting such a school.
WHAT WE HAVE LEARNED ABOUT CHARTER SCHOOLS
In some ways, charter schools are traditional and tap historic rural roots of public education. They give parents, students, and educators public school alternatives based on the idea that competition will bring educational innovations (Thomas, 1996). But there is potential for controversy, especially in poor rural communities with limited financial and educational resources to support additional schools. Since Minnesota passed the first charter school law in 1991, 32 other states and the District of Columbia have passed similar legislation (Hirsch, 1998). The Center for Education Reform (1998) estimated 1,129 charter schools existed nationwide in September 1998. Most schools were in the South and West. Half were in three states: Arizona, California, and Michigan. Almost another quarter were in four other states: Colorado, Florida, North Carolina, and Texas. While the number of charter schools has increased rapidly since 1991, these schools represented only about 0.5% of public school students in charter states during the 1996-1997 school year (RPP International, 1998). It is unclear how many were in rural areas.

On the Edge: Defusing Tensions on the Colorado River by Glenn Totten Introduction With interstate discussions of critical Colorado River issues seemingly headed for stalemate, Secretary of the Interior Gale Norton stepped in May 2 to defuse, or at least defer, a potentially divisive debate over water releases from Lake Powell. In a letter to governors of the seven Colorado River Basin states, Norton preserved the status quo of river operations for five months, giving states and stakeholders a chance to move back from the edge before positions had hardened on two key issues: (1) shortage guidelines for the Lower Basin and (2) Upper Basin/ Lower Basin reservoir operations, particularly at Lake Powell. But Norton served notice that she wants discussions on those two issues to continue, possibly outside of the annual operation plan (AOP) consultation process, which at least one observer described as unwieldy. In her letter, Norton said no adjustment is necessary in the amount of water scheduled to be released from Lake Powell for the next five months. According to the 2005 AOP, the Bureau of Reclamation (Reclamation) is to schedule releases from Lake Powell to the Lower Basin to achieve the minimum objective release goal of 8.23 million acre-feet during 2005.

Draft 10-7-99 I. Introduction The state's public higher education system is built on the understanding that both the individual and society benefit from high-quality public and private higher education. The purpose of this document is to delineate the goals and objectives of the Commission and staff to implement their mission. II. Role of the Colorado Commission on Higher Education The Colorado Commission on Higher Education (CCHE) provides coordination and policy direction with Colorado's 28 public colleges and universities and serves as a bridge between the Governor and the Colorado General Assembly and the institutions of higher learning within the State of Colorado. As the state entity overseeing the governance of all public institutions of higher education, the Colorado Department of Higher Education also has oversight of the Division of Private Occupational Schools, the Colorado Council on the Arts, Colorado Historical Society , and the Colorado Student Loan Program. Statutory authority for the department is contained in Chapter 23, Colorado Revised Statutes.
