How can anyone take a position on the issue of capital punishment without considering the spiritual implications of death and judgment? Dead Man Walking was made into a feature film starring Sean Penn and Susan Sarandon. Reeking with false compassion for convicted murderers awaiting execution on death row, both the book and the movie offered an emotional appeal for the prohibition of capital punishment. Ironically, Sister Helen has conceded in at least one interview that some of the condemned men to whom she has ministered have experienced conversion as a direct result of knowing the certain date of their departure from this world. Nevertheless, she seems unable to recognize that salvation is a greater good than life itself, and persists in opposing the one means available for rescuing especially hard cases from certain damnation. by U. D. J. Jinadasa The hangman's noose has been spared for convicts of capital crimes for nearly 27 years. But now there is a growing public opinion for the restoration of death penalty in view of the escalating homicide rates in the country. According to a recent pronouncement of the Interior Minister a recommendation would be made to the Government to resume executions. This may be nauseating news for human rights activists, for according to them the execution of death sentence is "a cruel and inhuman act". Further, as most democratic countries including Sri Lanka are committed to protect human rights, its compatibility with the constitutionally guaranteed rights needs deeper examination. However, by common sense death penalty was thought justified as it was mean to serve social ends for which purpose it was enacted. Furthermore, the Government is duty bound to protect the society from criminal elements who form a very small segment of the population. National leaders In the past some of our national leaders such as D. S. Senanayake, S. W. R. D. Bandaranaike and Professor Gunapala Malalasekera made sincere attempts to remove the death penalty from the statute book. In 1928 D. S. Senanayake moved a resolution in the Legislative Council to abolish death penalty but it was rejected as there was no alternative proposed. Susantha de Fonseka in 1936 introduced a proposal in the State Council for the same purpose suggesting life imprisonment as the alternative but that too failed.

Arguments in favour of Capital Punishment:
  • Capital Punishment is justified according to Judaeo-Christian principals.
  • Those who kill should be killed. (An eye-for-an-eye)
  • Exercising Capital Punishment would save the expense of long-term jail sentences.
  • It would meet people's sense of basic justice.
  • The state needs to show that life is precious and that it takes the cases of first degree murder so seriously that the perpetrator may forfeit his/her life.
  • Capital Punishment would deter further murders.
  • The general public is in favour of capital punishment most of the time - usually between 60-80%.
Arguments opposed to Capital Punishment:
  • If one is going to use the Bible to support Capital Punishment, you have to note that the first murderer (Cain murdered his brother Able) was not executed. Also the term "an eye for an eye and a life for a life" must be taken in the context of that time. The phase really meant that the punishment could not exceed the crime.
  • The way that Capital Punishment is excised in the U.S. (a western democratic country) executions actually cost much more that long term jailing.

Monday :: January 06, 2003 Turow on Capital Punishment The Jan. 6 issue of the New Yorker has an article by author and former federal prosecutor Scott Turow titled To Kill or Not to Kill : Coming to Terms with Capital Punishment. Turow served on Illinois Governor Ryan's Commission on Capital Punishment, formed after Ryan declared a moratorium on the death penalty in January, 2000. The purpose of the commission was to study what went wrong in Illinois and to make specific recommendations about how to fix the state's broken death penalty system. The Commission issued this report , containing 85 specific recommendations. Not one has been adopted by the Illinois legislature, prompting Governor Ryan to consider blanket clemency for all on death row, a decision he is still contemplating in his final weeks of office. First, Turow explains who served on this Commission: Two sitting prosecutors; two sitting public defenders; a former Chief Judge of the Federal District Court; a former U.S. senator; three women; four members of racial minorities; prominent Democrats and Republicans. Twelve of us were lawyers, nine with experience as defense attorneys and eleven—including William Martin, who won a capital conviction against the mass murderer Richard Speck, in 1967—with prosecutorial backgrounds." Turow recounts that at the press conference announcing the Commission, the members were asked whether any of them opposed capital punishment. Four people raised their hands, Turow's was not among them.

From time to time, the execution of a convicted killer touches off a flurry of protests, editorials in various print media, and TV and radio talk shows in which the pros and cons (mostly the "cons") of capital punishment are discussed. The message that usually comes from these sources is clear: capital punishment is a barbaric, discriminatory and ineffective method of punishment that needs to be eliminated. Even the Bible is sometimes appealed to in an effort to dissuade the minds of many regarding the state's right to take human life.
It is unfortunate that many who look to God as their ultimate authority in life and to the Bible as the authoritative expression of His will often allow such persuasive speech (Col. 2:4) to shape their attitudes and conclusions on this highly emotional subject. Intimidation seems to have more impact on some than inspiration. Thus this article will limit itself to a study of various texts from divine revelation with the hope and prayer that men and women who claim their first allegiance is to God will allow heavenly wisdom, rather than earthly, to determine their convictions on this subject. When this is done it should not be difficult to conclude that God's will is now and always has been that those who wantonly take the life of another human being deserve to have their life taken from them by the state.

To many people, jury duty is an inconvenience, but I've always wanted to try it. I had my chance six months after moving to Washington, D.C. On the prescribed day, I was shuttled into a courtroom with other would-be jurors and was asked whether I had qualms about the death penalty. Widespread support for death penalty
Public support for the death penalty is reinforced by the large number of mainly elderly farmers being murdered on their farms. Over the past few years an average of two to three farmers are murdered every week; some with vicious brutality. The recent upsurge of cases, where infants who are only a few months old are raped, has filled newspaper letters pages with demands for a return of the gallows.
Effectiveness of deterrence
There is a popular assumption that the harsh punishment of criminals serves as a deterrent to crime and thereby ultimately reduces crime. There is, however, little undisputed scientific evidence to demonstrate a correlation between harsh punishment and levels of crime.
According to the 1997 national Victims of Crime Survey, 60% of assault victims and 63% of sexual offence victims knew the offender by name, while a further 17% of assault victims and 12% of victims of a sexual offence knew the offender by sight. Fewer than a quarter of assault and sexual offence victims did not know the offender at all.
It would appear that the majority of murders, rapes and assaults in South Africa (as in most countries) are not committed by calculating individuals who plan their crimes and weigh up the pros and cons of committing them. Rather, most of these crimes are committed in a moment of passion, anger, thoughtlessness, spite or drunkenness. The fear of being punished harshly if they are caught and convicted for their deeds, does little to prevent the criminal actions of such offenders.

OVERVIEW
Throughout history, civilizations have used capital punishment as a means of keeping social order as well as for retribution. Today, throughout the United States as well as in Mississippi, lethal injection is the common form of capital punishment. Although the practice of capital punishment has evolved through the use of modern day technological advancement, the very practice itself has remained controversial. As of October 2004, Mississippi has sixty-nine condemned inmates that await execution on death row at the state penitentiary at Parchman.
