Streib PREFACE This is the 66th issue of this periodic report, having first been launched on June 15, 1984. On that date, the death penalty for juvenile offenders was an obscure issue in law as well as in political and social arenas. These reports have been with us (1) through the intense litigation of the late 1980s, (2) through our society's near hysteria about violent juvenile crime in the 1990s, (3) into the era of the international pressure on the United States to abandon this practice, and (4) now into a revitalized movement to finally end this practice. The solitary goal of these reports is to collect in one place the best available data and information on the death penalty for juvenile offenders (defined as those under age 18 at the time of their crimes). It is left to other documents and to other organizations to argue about the pros and cons of this practice, with the hope that these data will inform those arguments and deliberations. Therefore, while a sketch of both pro and con rationales is provided, this report takes no position on the legality, wisdom, or morality of the death penalty for juvenile offenders. The author of these reports has been involved with this issue for over thirty years as a researcher and as an attorney. References to some of those involvements can be found in Appendix C to this report.

Wednesday, March 2, 2005; Page A01 The Supreme Court abolished capital punishment for juvenile offenders yesterday, ruling 5 to 4 that it is unconstitutional to sentence anyone to death for a crime he or she committed while younger than 18. In concluding that the death penalty for minors is cruel and unusual punishment, the court cited a "national consensus" against the practice, along with medical and social-science evidence that teenagers are too immature to be held accountable for their crimes to the same extent as adults.

On March 1, 2005, a closely divided U.S. Supreme Court reversed an earlier ruling and abolished the death penalty for juveniles. Relying on the "cruel and unusual punishment" provisions of the 8th Amendment, the Court cited the overwhelming weight of international opinion as a partial basis for the ruling. When did countries begin to abolish the death penalty? Capital punishment was widely applied in ancient times throughout the world. The modern movement for the abolition of capital punishment began in the 18th century with the writings of Montesquieu and Voltaire. Some of the first countries to abolish capital punishment included Venezuela (1863), San Marino (1865), and Costa Rica (1877). Today, over half the countries in the world have abolished the death penalty either by law or through practice. (Click to see map) Since 2000, Chile, Yugoslavia, Serbia, Montenegro and Turkey have joined the list of abolitionist countries. Most executions occur in a handful of countries: China, Iran, Saudi Arabia and the United States. In Great Britain, it was abolished (except for cases of treason) in 1971; France abolished it in 1981. Canada abolished it in 1976. In 1977, the United Nations General Assembly affirmed in a formal resolution that throughout the world, it is desirable to "progressively restrict the number of offenses for which the death penalty might be imposed, with a view to the desirability of abolishing this punishment".

Stephen Nathanson "Is the Death Penalty What Murderers Deserve?"
Nathanson argues against the proposition that just deserts leads to executions. He believes it is difficult to be able to know what people deserve, and setting up an institution to consistently deliver just deserts is different from the outcome in an individual case. The analogy he uses is putting a grade on essay exams and trying to decide between an A- and a B+. Randomness in some judging is acceptable, but discrepancies in the death penalty are not.
