International Information Programs December 1, 2004 FACT SHEET: CAPITAL PUNISHMENT IN THE UNITED STATES Context Americans tend to cast the debate over capital punishment in terms of its deterrent value or appropriateness as a sanction for certain serious crimes. Overseas, the use of the death penalty in the United States is frequently raised as a human rights issue especially when juveniles, the mentally retarded, or the mentally ill are involved. The latest statistics from the U.S. Department of Justice show a downward trend in death sentences nationwide. In 2003, the latest year for which statistics are available, the number of death sentences imposed hit a 30-year low. The number of prisoners under sentence of death at year-end 2003 also decreased for the third year in a row.

The court was divided on the issue, but voted 5-4 that the death penalty for criminals aged 16 and 17 should be declared unconstitutional. The decision affects not only those convicted in future, but about 70 prisoners already on death row for offences committed before they were 18. Anti-capital punishment campaigners claimed the decision as a victory. "Now the US can proudly remove its name from the embarrassing list of human rights violators - that includes China, Iran, and Pakistan - that still execute juvenile offenders," said William Schulz, executive director of Amnesty International USA. 'No deterrent' The highest US court upheld an earlier ruling by the Missouri Supreme Court, which banned the execution of people convicted of crimes they committed before turning 18. The Missouri court said putting minors to death was a violation of the US constitution, which outlaws "cruel and unusual" punishment.

The 5-4 decision in Roper v. Simmons search ) affects 19 states that still subject youths to capital punishment, along with 72 death-row inmates who committed their crimes as teenagers. In a somewhat surprising development, Justice Sandra Day O'Connor, previously seen as the "swing" voter in the case, joined Chief Justice William H. Rehnquist and Justices Antonin Scalia and Clarence Thomas in a dissent, while Justice Anthony Kennedy sided with the majority. "When a juvenile offender commits a heinous crime, the state can exact forfeiture of some of the most basic liberties, but the state cannot extinguish his life and his potential to attain a mature understanding of his own humanity," Kennedy wrote in the majority ruling. Kennedy, who in 1989 voted in favor of upholding the death penalty for 16- and 17-year-olds, cited the court's requirement that it consider "evolving standards of decency that mark the progress of a maturing society" in the reversal of its previous ruling on capital punishment for juveniles.

The death penalty, or capital punishment, may be prescribed by Congress or any state legislature for murder and other capital crimes. The Supreme Court has ruled that the death penalty is not a per se violation of the Eighth Amendment's ban on cruel and unusual punishment. Furthermore, the Sixth Amendment does not require a jury trial on the sentencing issue of life or death. Not all states provide for the death penalty. In the landmark case, Coker v. Georgia, 433 U.S. 584 (1977) , the Supreme Court ruled that the death penalty is a grossly disproportionate punishment for the crime of rape of an adult woman. The Court came to this conclusion by considering objective indicia of the nation's attitude toward the death penalty in rape cases. At the time, only a few states allowed for executions of convicted rapists. More recently, in Atkins v. Virginia, 536 U.S. 304 (2002) , the Supreme Court used the same line of reasoning to rule that executions of mentally retarded criminals are "cruel and unusual punishments" which are prohibited by the Eighth Amendment In Roper v. WASHINGTON - The Supreme Court ruled Tuesday that the Constitution forbids the execution of killers who were under 18 when they committed their crimes, ending a practice used in 19 states. The 5-4 decision throws out the death sentences of 72 juvenile murderers and bars states from seeking to execute minors for future crimes. The ruling had an immediate effect on the nation's most notorious teen killer, sniper Lee Boyd Malvo. Prosecutors in Virginia's Prince William County had waited for the ruling to decide on bringing Malvo to trial for one of the 10 killings in an October 2002 killing spree by Malvo and accomplice John Allen Muhammad.

Simmons State-by-State Breakdown The state breakdown of the 72 people on death rows who were juveniles when they committed their crimes, according to the Death Penalty Information Center: • Texas: 29 • Alabama: 14 • Mississippi: 5 • Arizona, Louisiana, North Carolina: 4 each • Florida, South Carolina: 3 each • Georgia, Pennsylvania: 2 each • Nevada, Virginia: 1 • Arkansas, Delaware, Idaho, Kentucky, New Hampshire, Oklahoma and Utah allow the execution of juveniles but do not have any on their death rows. Major Supreme Court rulings on the death penalty:
  • 1972, Furman v. Georgia. The court rules the death penalty does not violate the Constitution, but the manner of its application in many states does. The court noted capital punishment was likely to be imposed in a discriminatory way and that blacks were far more likely to be executed than whites. The decision essentially ends the practice of executions. 1976, Gregg vs. Georgia. A Georgia death penalty statute is held constitutional, a ruling that sets the stage for resumption of executions.

An almost universal prohibition exists on the execution of persons who were under the age of 18 at the time of the crime. Since 2000, only five countries in the world are known to have executed juvenile offenders: China, Democratic Republic of Congo (DRC), Iran, Pakistan, and the United States. Pakistan and China have abolished the juvenile death penalty, but there have been problems in nationwide compliance with the law. Stop Child Executions!
