Capital punishment , also referred to as the death penalty , is the judicially ordered execution of a prisoner as a punishment for a serious crime , often called a capital offence or a capital crime . Some jurisdictions that practice capital punishment restrict its use to a small number of criminal offences, principally treason and murder . Prisoners who have been sentenced to death are usually kept segregated from other prisoners in a special part of the prison pending their execution. In a landmark decision announced Tuesday, the justices ruled 5 to 4 that state laws authorizing capital punishment for 16- and 17-year-olds who commit murder violate the Eighth Amendment and are henceforth unconstitutional. capital punishment, imposition of a penalty of death by the state. History Capital punishment was widely applied in ancient times; it can be found (c.1750 B.C. ) in the Code of Hammurabi. From the fall of Rome to the beginnings of the modern era, capital punishment was practiced throughout Western Europe. The modern movement for the abolition of capital punishment began in the 18th cent. with the writings of Montesquieu and Voltaire, as well as Cesare Beccaria 's Essay on Crimes and Punishments (1764). In Great Britain, Jeremy Bentham was influential in having the number of capital crimes reduced in the 18th and 19th cent. Some of the first countries to abolish capital punishment included Venezuela (1863), San Marino (1865), and Costa Rica (1877). Current International Practice As of 2004, 81 countries had entirely abolished the death penalty, including the members of the European Union. Some other countries retained capital punishment only for treason and war crimes, while in others, death remained a penalty at law, though in practice there had not been any executions for decades. Among countries that retained the death penalty for ordinary crimes were many in the Caribbean, Africa, and Asia. The United States and China were believed to impose capital punishment most frequently.

I. INTRODUCTION
The American people have been executing their children in the pursuit of justice for more than three and one half centuries, beginning with the earliest days of Plymouth Colony. The most recent executions of juvenile offenders, as of this writing, occurred in April and May of 1998. This centuries-old system of death for children's crimes has always had major flaws, and the post-1972 modern era is little better. However, it was not until the last decade that American courts and scholars stumbled across this odd subtopic within the death penalty system. Now after fifteen years of debating, legislating, and deciding cases about the death penalty for offenders who commit crimes while [*pg 56] under age eighteen, the American Bar Association ("ABA") has included the juvenile death penalty in its call for a moratorium on the death penalty process as it now operates. This article provides a sketch of the sentences and actual executions in the juvenile death penalty system for the past quarter-century, as well as a brief reference to similar cases in other countries. It also provides an overview of the current law governing this practice, ranging from constitutional rulings by the United States Supreme Court to express minimum ages in death penalty statutes. Finally, it suggests some rationale for a moratorium on this practice. Two appendices list all juvenile death sentences that have been imposed and all juvenile offenders currently on death row.

In a 5-4 decision, the Supreme Court of the United States ruled today, in Roper v. Simmons , that it is unconstitutional to impose capital punishment on those who committed crimes while juveniles. Justice Anthony Kennedy wrote the majority opinion to overturn the death penalty for juveniles, which was also supported by Justices John Paul Stevens David Souter Ruth Bader Ginsburg and Stephen Breyer . Dissenting were Justices Antonin Scalia William Rehnquist , and Clarence Thomas , with Justice Sandra Day O'Connor providing a separate dissent. Christopher Simmons received the death sentence for brutally kidnapping and murdering Shirley Crook as part of a burglary. The case worked its way up the court system, with the courts continuing to uphold the death sentence. However, in light of a 2003 U.S. Supreme Court ruling, in Atkins v. Virginia
