Ottawa, August 29, 1997 In response to the resolution passed by the Canadian Police Association today calling for the return of the death penalty in certain cases, the Minister of Justice and Attorney General of Canada, Anne McLellan, issued the following statement: "Capital punishment has been debated and voted on in free votes in the House of Commons twice in the past two decades. In 1976, Parliament voted to abolish capital punishment and in 1987 Parliament voted against reinstating it. Capital Punishment The applied ethics issue of capital punishment involves determining whether the execution of criminals is ever justified, and, if so under what circumstances it is permissible. Philosophical defenses of capital punishment typically draw from more general discussions of punishment. The issue of corrective justice in legal philosophy distinguishes between two principal theories of punishment: utilitarian and retributive. Accordingly, defenses of capital punishment are usually either utilitarian or retributive in nature. By contrast, most criticisms of capital punishment seek to expose flaws in popular justifications of capital punishment. Thus, in the absence of any good reason for executing a criminal, the critic of capital punishment concludes that the criminal should be allowed to live.

Utilitarian Arguments Concerning Capital Punishment Perhaps the most common defenses of capital punishment are on utilitarian grounds. For utilitarians, punishment in general is justified only insofar as it creates a greater balance of happiness vs. unhappiness. From the utilitarian perspective, then, capital punishment is justified if it (1) prevents the criminal from repeating his crime; or (2) deters crime by discouraging would-be offenders. For, both of these contribute to a greater balance of happiness in society. There are several immediate problems with this line of reasoning. First, the burden of proof is on the defender of capital punishment to show that the same effects could not be accomplished with less severe punishment, such as life imprisonment. This is especially pertinent since the goal of utilitarianism is to reduce as much unhappiness as possible and this entails imposing the least severe of two possible punishments when everything else is equal. Other Contemporary Issues This AG Perspective reflects commonly held beliefs based on scripture which have been endorsed by the church's Commission on Doctrinal Purity and the Executive Presbytery. What is the Assemblies of God position on capital punishment? Opinion in the Assemblies of God on capital punishment is mixed. However, more people associated with the Assemblies of God probably favor capital punishment for certain types of crimes such as premeditated murder than those who would oppose capital punishment without reservation. This consensus grows out of a common interpretation that the Old Testament sanctions capital punishment, and nothing in the New Testament negates maximum punishment as society's means of dealing effectively with serious crimes. As more and more heinous crimes are reported by the media, public sentiment shifts toward capital punishment as a means of reversing the escalating violence and outrageous behavior of criminals and irresponsible citizens. Some Christians believe capital punishment is mandated , while others believe it is merely permitted.

    Arguments For and Against the Death Penalty

    Abstract
      Despite capital punishment having been abolished in Canada 20 years ago, the majority of Canadians continue to favour the death penalty as a sentencing option. In this study, a 2 x 6 design was employed to investigate the effects that argument position (for or against the death penalty) and type of justification for punishment (deterrence, morality, rehabilitation, incapacitation, economic, and possibility of mistake) have on participants' sentence recommendations for a defendant found guilty of first degree murder. Results indicated that only those arguments in favour of the death penalty, based on retribution, economics, and impossibility of mistake, were effective in influencing participants to recommend that the accused be sentenced to death. Compared to participants who recommended a life sentence, those who recommended the death penalty were found to have significantly higher scores on a measure of vengeance.
    A lthough the Parliament of Canada abolished the death penalty as a sentencing option in 1976 (Amnesty International, 1987), a majority of Canadians (approximately 65-75%) have indicated that they would support a return of the death penalty (Reid, 1987). Furthermore, calls for the reintroduction of the death penalty by politicians and others occur frequently. As a result of the public's apparent support for capital punishment, and the possibility of its return, it is important to continue studying factors that influence people's attitudes regarding the death penalty.

    Capital punishment is the lawful infliction of death as a punishment and since ancient times it has been used for a wide variety of offences. The Bible prescribes death for murder and many other crimes, including kidnapping and witchcraft. By 1500 in England, only major felonies carried the death penalty - treason, murder, larceny, burglary, rape, and arson. By 1700, however, Parliament had enacted many new capital offences, and hundreds of persons were being put to death each year. Reform of the death penalty began in Europe by the 1750s, and was championed by academics such as the Italian jurist Cesare Beccaria, the French philosopher Voltaire, and the English law reformers Jeremy Bentham and Samuel Romilly. They argued that the death penalty was needlessly cruel, overrated as a deterrent, and occasionally imposed in fatal error. Along with Quaker leaders and other social reformers, they defended life imprisonment as a more rational alternative. By the 1850s these reform efforts began to bear fruit. Venezuela (1853) and Portugal (1867) were the first nations to abolish the death penalty altogether. In the United States Michigan was first state to abolish it for murder in 1847. Today, it is virtually abolished in all of Western Europe and most of Latin America.
