Executing criminals who couldn't legally buy a drink when they committed their capital crimes
I haven't yet read the Supreme Court's new death penalty decision, and may have more to write about it tomorrow. But I can't resist whacking this comment by Andrew Stuttaford on The Corner: Looks like a good decision to me (although international 'law' should not have been cited in any way). I'm biased, of course, in that I'm opposed to the death penalty in almost every circumstance, but, in particular, I've never understood the logic of a system which provides that someone is old enough to be executed for a crime committed at an age at which (so says Elizabeth Dole) he is too young to handle a beer. Juries decide the fates of adults charged with capital crimes. I believe in that system. I believe that juries are able to make highly individualized and conscientious decisions about whether a particular defendant's age when he committed the capital crime is a sufficient factor, when added in with all the other aggravating and mitigating factors, to swing the balance against the death sentence, with the prosecution appropriately being given the burden of proving the aggravating factors beyond a reasonable doubt just as they did the underlying crime. The Pine Valley Cosmonauts The Executioner's Last Songs, Vol. 1 Bloodshot, 2002 RiYL : Mekons, Waco Brothers, Gram Parsons There's something downright eerie about being in Washington, DC, and listening to a haunting collection of folk songs about death and capital punishment, but I can't really put my finger on it. I mean, the songs themselves on The Executioner's Last Songs, Vol. 1 , a collection of murder ballads sung by an all-star lineup of guest singers backed by Chicago's Pine Valley Cosmonauts, are mostly updated versions of Appalachian music or folklore. And heaven knows, there's no folklore about D.C.
And maybe that's it. After all, any benefit CD against the death penalty is clearly aimed at the politicians up here. If the suits and ties on Capitol Hill pick up the disc and learn a thing or two, well, that'd be a bonus. But in the end, what we're left with is a mostly strong, sometimes beautiful assortment of tunes that, if nothing else, demonstrate that the Pine Valley Cosmos are one damn fine band, and guiding light Jon Langford is one passionate man.
Langford, who also laces 'em up with the Mekons and the Waco Brothers, came up with the concept two years ago to do a benefit for the Illinois Death Penalty Moratorium Project after performing a few benefit gigs a few years back.

As a result, this fall promises to be an exciting and rewarding experience for interns.

The idea of televising executions seems like a bad joke - a satiric comment on media values, audience taste or the latest in tougher-than-thou political campaigning. Any media cynic can quickly apply the logic of television to the event and create instant dark humor about summer reruns and slow motion reverse angles. What's an appropriate commercial to go with them, or is this event more like a World Wrestling Federation pay-per-view program? Pathways to Televised Executions Many of the assumptions underlying the various positions are open to question and explored in subsequent sections, but one important conclusion is that people with opposing views on capital punishment could become strange bedfellows in the politics of televising an execution. They could even have drastically different reasons for supporting it, but still work together to support legislation, a litigation strategy, or a mission to capture an image and distribute it.
