The London Free Press , June 6, 2003 OTTAWA Anti-spanking advocates carried their cause to the country's highest court yesterday, arguing corporal punishment of children should be outlawed as an affront to human dignity. "This case is about the right of children not to be hit, a right that in a modern, 21st-century democracy should be unquestioned," lawyer Paul Schabas told the Supreme Court of Canada. He got a skeptical reception from some of the nine judges, who sharply questioned his legal reasoning. He also met vigorous opposition from the federal government, which maintained that, whatever the merits or pitfalls of spanking, parents should be free to resort to it in "mild to moderate" measure. At issue is Section 43 of the Criminal Code, enacted more than a century ago, which protects parents, teachers and caregivers from prosecution for using "reasonable" force to discipline children. Children's advocacy group the Canadian Foundation for Children, Youth and the Law wants that immunity struck down as a violation of the Charter of Rights. "Section 43 has the effect of making children second-class citizens," Schabas said on behalf of the foundation.

Canadian Supreme Court rejects oncomouse patent
OUT-LAW News, 10/12/2002 The Supreme Court of Canada on Thursday ruled that a genetically modified mouse, developed by Harvard University to be used in cancer research, is not an invention and cannot be patented under Canadian law. The Harvard mouse, also known as "oncomouse" from the Greek word for tumour, was developed in the late 1980s. It is genetically altered so that it is susceptible to cancer after receiving relatively small amounts of carcinogens that do not normally affect other animals. Its developers claim that it helps clinical research by producing fast experimental results. Harvard has been trying to patent the mouse in Canada since 1985. Its application was initially rejected by the country's commissioner for patents, who decided that the creation of the mouse did not meet the Canadian patent law's requirements of "manufacture" and "composition of matter". A federal court in 1997 sided with the commissioner's decision. However, an appeals court ruled in 2000 that transgenic mammals, such as the oncomouse, constitute a composition of matter and therefore can be patentable under certain conditions.

Canadian Supreme Court suspends Quebec private health care ruling for one year

[JURIST] The Supreme Court of Canada [official website] on Thursday granted a one-year stay of its June ruling [JURIST report] that the Quebec government can't block people from obtaining private insurance for health care procedures covered under the public system. In its June 9 decision, the Supreme Court ruled that unreasonably long waiting times for procedures under Canada's Medicare program [Wikipedia backgrounder] violated the Quebec Charter of Rights [text] by not providing access to health care in a timely manner. The government in Quebec had asked for an 18-month delay [JURIST report] to plan for a new two-tiered health care system and the court seemed to agree that a private system could compromise funding for the public system. BREAKING NEWS ~ Canadian Supreme Court approves same-sex marriage bill

[JURIST] CTV News is reporting that the Supreme Court of Canada has approved a proposed federal law that would make same-sex marriage legal across Canada. Lower courts in six Canadian provinces and one territory have already ruled that the traditional legal definition of marriage as between a man and a woman is unconstitutional under the Canadian Charter of Rights and Freedoms. In its ruling delivered just a few minutes ago, the high court concluded that the federal government has the right to legalize same-sex marriage but declined to rule on the question of whether the traditional definition of marriage was constitutional or not under the Charter. Canadian Supreme Court Rules Flashing Children OK From Living Room Window OTTAWA, January 28, 2005 (LifeSiteNews.com ) - A British Columbia man will not have to close his drapes when he commits indecent acts in his living room. The Supreme Court of Canada has ruled that a person's private abode, even if it is in full view of the neighbourhood children, cannot be considered a public space. Anything, therefore, that Daryl Clark wants to do in it, including masturbation, is not a matter for the police.
On Oct. 28, 2000 Clark's neighbours complained to police when they saw him engaged in this activity in full view of their two daughters. The couple, identified only as Mr. and Mrs. S, were concerned that Clark was deliberately displaying himself to be seen by children. Lower courts concluded that Clark had consciously converted his living room into a public place.

Canadian Supreme Court Judges Question Being Used to Bypass Parliament on Gay 'Marriage' OTTAWA, October 6, 2004 (LifeSiteNews.com) - Reuters reported this afternoon that "In a surprise twist, several of Canada's Supreme Court judges suggested on Wednesday that the government was trying to use the court to do the politically charged work of introducing gay marriage across the country".
The court began hearings today on questions submitted to the court on the marriage issue. The most significant question the Liberal government has asked to the court to answer is whether it is unconstitutional not to allow same-sex marriage.
Justice Michel Bastarache told the government's lawyers the government's request "seems to be a description of a political role for the decision of the court. The legal role is not there".

A federal judge in Washington, D.C., on Thursday set up an immediate appeal to the D.C. Circuit of her ruling last Monday establishing constitutional and international treaty rights for terrorism suspects now being held by the U.S. military at Guantanamo Bay, Cuba. U.S. District Judge Joyce Hens Green acted soon after receiving the Bush Administration request to certify the In re Guantanamo Detainee Cases to the appeals court. The Administration had voiced fears of serious judicial interference with its ability to wage the war on terrorism if Green's ruling was not appealed. The appeal in the D.C. Circuit – which the Administration said should be on an expedited basis would be a likely prelude to an attempt to appeal later to the Supreme Court. The Administration is expected to ask the D.C. Circuit to expedite its review of the appeal.

Canadian Supreme Court Ruling That Same-Sex Couples Entitled To Equality May 20, 1999 EGALE PRESS RELEASE SUPREME COURT RULES: SAME-SEX COUPLES ENTITLED TO EQUALITY In the landmark decision of M v H & Ontario, the Supreme Court of Canada ruled today that the opposite-sex definition of "spouse" in Ontario’s Family Law Act is unconstitutional. The Court ordered that the law be changed to ensure equal treatment for same-sex spouses. Cory J., for the majority, held: "The societal significance of the benefit conferred by the statute cannot be overemphasized. The exclusion of same-sex partners from the benefits of s. 29 of the FLA promotes the view that M, and individuals in same-sex relationships generally, are less worthy of recognition and protection. It implies that they are judged to be incapable of forming intimate relationships of economic interdependence as compared to opposite sex couples, without regard to their actual circumstances. As the intervenor EGALE submitted, such exclusion perpetuates the disadvantages suffered by individuals in same-sex relationships and contributes to the erasure of their existence." "This is the first time ever that the Supreme Court has ruled that a law is unconstitutional because it fails to treat same-sex couples equally," said Jan Cheney, Chair of the Legal Issues Committee of EGALE (Equality for Gays and Lesbians Everywhere), which intervened in the appeal. "The decision is, however, consistent with numerous lower Court rulings. Now the Supreme Court has placed the matter beyond all doubt: it is a violation of the Constitution for Governments to deny equality to those in same-sex relationships. This decision is entirely consistent with a recent Angus Reid poll, which shows that more than two-thirds of Canadians support equal rights and responsibilities for those in same-sex relationships. British Columbia has already enacted similar legislation, and the sky has not fallen."
