[1910] A.C. 637 Judicial Committee of the Privy Council, Lord Loreburn L.C., Lord Macnaghten, Lord Atkinson, Lord Shaw of Dunfermline and Lord Mersey, 29 July 1910 (On appeal from judgment of Supreme Court of Canada, reported sub nom. Province of Ontario v. Dominion of Canada, supra p.221)
354 DOM. OF CAN. v. PROV. OF ONT. (637) Law of CanadaTreaty of October 3, l873, extinguishing the Indian Interest in LandsPayments by the Dominion under the TreatySuit by the Dominion against the Province of Ontario for Contribution as respects Lands within the Province. By a treaty dated October 3, 1873, the Dominion Government, acting in the interests of the Dominion as a whole, secured to the Salteaux tribe of the Ojibeway Indians certain payments and other rights, at the time extinguishing by consent their interest over a large tract of land about 50,000 square miles in extent, the greater part of which was subsequently ascertained to lie within the boundaries of the Province of Ontario. It having been decided that the release of the Indian interest effected by the treaty enured to the benefit of Ontario, the Dominion Government sued in the Exchequer Court for a declaration that it was entitled to recover from and be paid by the Province of Ontario a proper proportion of annuities and other moneys paid and payable under the treaty: Held , affirming the judgment of the Supreme Court, that, having regard to the jurisdiction conferred upon the Exchequer Court, the action must be dismissed as unsustainable on any principle of law. In making the treaty, although it resulted in direct advantage to the province, the Dominion Government did not act as agent or trustee for the province or with its consent, or for the benefit of the lands, but with a view to great national intereststhat is, for distinct and important interests of their ownin pursuance of powers derived from the British North America Act, 1867.

Manitoba Provincial Heritage Site No. 92
Glenboro
Canadian Pacific Railway Water Tower
Railway Avenue,
Village of Glenboro Designation Date: September 26, 1996
Designation Authority: Honourable Harold Gilleshammer, Minister of Culture, Heritage and Citizenship
Present Owner: The Village of Glenboro This octagonal wooden railway tower is a rare vestige from the age of the steam-powered locomotive. This design, the Standard No. 1 Plan was pioneered by the Canadian Pacific Railway (CPR) in 1903 to replace the low, round, wooden water tower in use since 1882. It quickly became part of the Manitoba landscape, with 75 water towers constructed by the CPR from 1902 to 1925. Towers, pumphouses, coal sheds, and sidings were constructed approximately every 80 kilometres (50 miles), the distance a steam locomotive could safely travel between water refills. Constructed in 1904, the Glenboro structure is the best surviving example of an intact, fully-equipped water tower in Manitoba. The adjacent pumphouse fed water to the tank inside the water tower. A coal-burning boiler powered an interior water pump and prevented the water in the tank from freezing. In 1939 this pumping mechanism was replaced by an electric motor and pump installed inside the tower. A ball, or "float", glided along a pole atop the tower to indicate the level of the water in the tank. The cedar water tank, with a capacity of 181,840 litres (40,000 gallons) of water, rests upon a framework of large wooden support timbers.
