Finance Canada Seeks Views On The Canadian International Trade Tribunal (CITT) Textile Tariff Reference
In 1994, the Minister of Finance established a standing textile tariff reference at the Canadian International Trade Tribunal (Tribunal) to conduct economic reviews of requests from Canadian downstream producers for tariff relief on imported textile manufacturing inputs and to make recommendations to him that would maximize the net economic benefits to Canada. (A copy of the current letter of reference from the Minister of Finance to the Chair of the Tribunal is attached as Appendix A Based on a review of the working of the textile tariff reference to date, and to ensure that it works in the overall interests of Canadian industry, it is considered that the terms of reference might benefit from certain clarifications to reinforce the original policy intent. A copy of a draft letter of reference showing how this might be achieved is attached as Appendix B . It would replace the existing letter of reference that guides the Tribunal’s analysis and recommendations on requests it receives for tariff relief on imported textile manufacturing inputs. The main clarifications contained in the draft letter include the following:
  • A preamble establishes the overall tariff policy context of the textile tariff reference as one where tariff relief on manufacturing inputs is generally considered to enhance the competitiveness of Canadian downstream producers, taking into account the impact that such relief might have on domestic producers of competing goods;

Minister of Finance Announces Appointment to Canadian International Trade Tribunal
Related document: Finance Minister Paul Martin today announced the appointment of Mr. Pierre Gosselin to the position of Chair of the Canadian International Trade Tribunal (CITT) Mr. Gosselin is currently Director General, Human Resources Development Bureau, at Foreign Affairs and International Trade Canada. He received a Bachelor of Commerce and a Master of Economics from the University of Ottawa. He has occupied various senior positions with Foreign Affairs and International Trade Canada and Industry, Trade and Commerce Canada. "Mr. Gosselin has acquired extensive expertise in the area of international trade during the past 20 years in the public service, which will serve him and the Tribunal very well," noted Mr. Martin. The CITT is an administrative tribunal operating within Canada's trade remedies system. The Canadian International Trade Tribunal Act provides for the appointment by Governor in Council of up to nine members comprising a Chair, two Vice-Chairs and six members.

PLCom has won two rulings from the CITT (Canadian International Trade Tribunal) against two separate Canadian government procurement solicitations that attempted to mandate Microsoft-only Server software specifications in their Request for Proposals (RFPs). These CITT rulings secure the right for Canadian suppliers to bid Linux-based database applications in both instances. The Tribunal determinations have also established a precedent setting legal framework in Canadian administrative law that compels Canadian government agencies and departments to issue technical specifications based on recognized Open Standard Protocols rather than proprietary software brand names.

On August 14, 2001 , the CITT released its reasons for its July 24th ruling that the Library of Parliament was guilty of discrimination and had breached Sections 501, 504 and 506 of a Canadian procurement law, the Agreement on Internal Trade (AIT). PLCom had filed a formal complaint to the CITT on March 13,2001, arguing that the Library of Parliament was in breach of the AIT because, amongst other things, it had specified Microsoft NT Server as the only acceptable OS platform for an Intranet- based database application. The fact that the Library's RFP relied upon Microsoft brand names as a proxy for technical specifications, rather than using open standards-based criteria, led the Tribunal to issue its finding of discrimination.

On December 29, 2000, The Department of Public Works and Government Services (PWGSC) published on Canada's Electronic Tendering Service (MERX) an Advanced Contract Award Notice (ACAN) for Solicitation No. 39014-010701/A, sole-sourcing the contract to Densan Consultants, Ltd. The procurement in question was for an electronic media monitoring system to be delivered to the Canadian Food Inspection Agency (CFIA). (PLCom) of Ottawa, Ontario, produces a web/intranet-based media-monitoring application called InfoLynx , and wished to be given an opportunity to compete for this contract. On January 15, 2001, PLCom submitted a challenge to the ACAN, asking that the procurement be opened up for competition. The CFIA responded by stating that InfoLynx did not meet the mandatory technical requirements because it ran on Linux and PHP, and not Windows NT and ASP. PLCom was exasperated at this response. First of all it was technically incorrect: InfoLynx does indeed run on Linux, but is built with C++ and mod_perl and contains no PHP code. More importantly the response was in serious breach of the trade regulations. PLCom felt that it had to seek legal action, or go out of business, as this was the third solicitation in the past 12 months that mandated Windows NT. complaint before the Canadian International Trade Tribunal (CITT). The complaint contained the following passage:
