The Canadian Constitution protects all race-based theories
THE CONSTITUTION ACT OF 1982 ensures that even the Charter of Rights and Freedoms does not frustrate our attempts, as an enlightened society, to strive towards justice and genuine equality. Although section 15(1) of the Charter states every individual is equal before and under the law without discrimination, it is followed immediately by section 15(2):
Subsection (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.
And Section 25 makes sure the Charter is not "construed so as to abrogate or derogate from any aboriginal, treaty or other rights that pertain to the aboriginal peoples of Canada."
The tradition of civil political discourse in Canada has led to a renewed vision of Aboriginal Inherent and Treaty Rights, which is enshrined in the 1982 Constitution, Section 35(1):

    In 1984, New Zealand voters booted a left-leaning conservative government and brought in a free-market-oriented labour government. Immediately, finance minister Sir Roger Douglas began to implement some of the most important reforms in any country of the 20th century.     I. Introduction The topic of this paper is Charter-induced transformation of political community. Charters or bills of rights are central ingredients in the constitutional make-up of modern democratic polities. They confer rights upon individuals and groups and evoke civic identities and collective self-conceptions. The Canadian Charter of Rights and Freedoms is central to Alan Cairns’ Citizens’ Constitution Theory, which deals with how constitutional culture – the civic identities and collective self-conceptions that emanate from the constitution – affect constitutional change. The critical change in the country’s constitutional culture that the theory addresses is the inclusion of the Charter in the Constitution Act 1982. This inclusion injected a far stronger participant ethos into the Canadian constitutional culture and helped spark a period of ‘mega constitutional’ politics in Canada. Constitutional politics at the mega level, as Peter Russell notes, is “concerned with reaching agreement on the identity and fundamental principle of the body politic.”(Russell 1993:75) Canada is unique in the world in that it has been involved in mega constitutional politics

    The Building Blocks of Parliament

    Discussion is a fundamental part of any democratic system.  As a nation, every day, we hear and present viewpoints, we struggle with issues, we reach agreement on actions, we share ideas and dreams — and we create the laws, policies and programs that are the framework for the national vision. Parliament is a place of discussion and debate.  You can see it in Question Period, when Ministers are called to account for their actions and policies.  It’s there in caucus meetings when party members hammer out their position on issues that will determine the country’s future.  It’s there in committees, when members of industry or labour or any interest group speak out about the Government’s policies.  Such debate is the basis of democracy. A Tree with Strong Roots By 1864, many people in the British North American colonies were discussing the benefits of union.  They could do much together that they could not do separately — pooling their economic resources to overcome the challenges of a vast geography and working together to protect themselves against the economic and military dominance of the United States.  Their solution — Confederation — did much to respect the deep differences in economic interest, language, religion, law and education among the regions that came together in 1867. Confederation established the constitutional agreements and the Parliament we know today.

    The Canadian Constitution
    Constitutional law is always a fascinating enterprise. Over the years, observers have noted that they work best when the courts interpret them in a manner at odds with the original intent. It does seem that the The US Constitution originally emphasized states' rights, but the courts have shaped an over-riding federal jurisdiction; similarly, Canada was intended to be a strong federal state, but crucial early cases acknowledged greater provincial powers. In Australia, it is said, the courts did what the Constitution intended and the result was constitutional crisis. As it stands, our constitution is something of a hodgepodge of British legislation reflecting the growth of Canada from the original 4 colonies to 10 provinces and two territories, as well as changing social policy in matters such as unemployment insurance and emerging technologies such as radio and aviation. Many of these constitutent elements of our Constitution are set out in the list of links below, but that list is not complete. The authoritative list of what enactments now form part of the Constitution is set out in one of the schedules to the 1982 Act. Where specific matters are not dealt with, we can fall back on generous phrasing such as "peace, order and good government" or make reference to the Constitution of Great Britain which is, unhelpfully, unwritten.
