Original Intent and the Canadian Constitution
Posted by Kevin Brennan at February 23, 2004 02:17 PM in Political Philosophy Other weblogs commenting on this post Although sympathetic to the idea of civil unions for homosexual couples, I've been bothered at what I perceived as judicial activism that stepped outside the intent of the Constitution. But it seems I may have been wrong to think that: One Tory framer, Roy McMurtry, went on to be one of the judges who wrote Ontario's decision allowing same-sex marriages...the truth is, none of Canada's framers have any respect for the textualist or originalist forms of interpretation. In fact, they wrote the Charter using language that specifically precludes such interpretations. So, I guess I can't complain that the decision went beyond the intent of the Charter anymore. In a way, that's a relief because it forces me to confront my real issues. While I'm at it, I'll dispense with the other strawman, the complaint that judges are unelected. True. But so are civil servants, who are called on to interpret the law all the time. Both make errors in judgement that force us to amend the law or appeal to Parliament. Interestingly, this is not true in the U.S. Given the overt politicization of judicial appointments there, it's not at all clear to me that American judges have any less moral right to make law than American politicians.

E-mail: dweiden@fhsu.edu THE MYTH OF THE SACRED presents a varied and eclectic collection of articles on the Canadian constitutional process. The reader will find empirical analysis, doctrinal work, political theory, and game-theoretical perspectives on Canadian judicial politics. Although some could argue that this diversity leads to a less than coherent collection, I would suggest that the book represents a healthy multiplicity of scholarly approaches to the study of the Canadian judiciary. Indeed, this book is a very worthwhile volume not only for those interested in the Canadian constitutional system, but also for scholars engaged in the general study of comparative judicial systems. A number of articles in the book address issues not often found in collections of this type: Abelson discusses the role of think tanks in the Canadian constitutional process, Kelly examines the complexity of judicial activism, and Smithey analyzes interest group influence in a landmark Supreme Court case.

Family relationships are also legal relationships the law sets out some of the rights and obligations of parents to children, and children to parents, and of spouses to each other. One's legal status affects one's liability to pay taxes and one's eligibility to receive benefits such as health insurance coverage or pensions. So, law is much more than sensational criminal trials or speed limits on the highway. It is an expression of the common good and the fundamental values of society, and it is one of the tools that the state uses to maintain order in society. The Canadian legal system has evolved as Canada has evolved, and is today one of the unifying elements in a pluralistic society. Three Legal Traditions hen the judges in Canada's highest court make a decision on a matter before them, they may draw on the three different traditions of law that Canada inherited when it was created in 1867. When the European colonizers claimed the North American continent for their various monarchs, they found the land already inhabited by indigenous societies with their own social structure, culture and laws. English-speaking colonizers brought with them their own legal tradition, the common law. This body of law had evolved from decisions made by the English royal courts of justice since the Norman Conquest (1066) and it applies in most English-speaking countries.

GENERAL PRINCIPLES OF THE CANADIAN CONSTITUTIONAL LAW As a former member of the British Empire, Canada has been widely influenced by English law. The Canadian parliamentary system finds its origins in the British institutions that were settled after the conquest of 1760, and more particularly with the 1791 constitutional Act of the British Parliament. In 1867, Canada inheritated a federal structure mainly inspired from the American example. From four original states in 1867, this structure progressively extended until obtaining Newfoundland in 1949, the tenth province. Through the years the country has learnt to develop its own legal system, and though several constitutional problems were raised, such as the question of Quebec and biculturalism, Canada remains a model of parliamentarism and one of the most achieved democracy. We should therefore start with a glance at the elaboration of Canadian law ; then we shall deal with its specificity in the common-law world ; and finally we will analyse the aspect of biculturalism , which is particular, legally speaking, to Canada.

Who could forget Hunter v. Southam Inc. case and Justice Wilson's bold incorporation of Canada's international obligations under various United Nations refugee conventions, curtailing the historically unrestricted power of immigration officials? But then, some fifteen years down the constitutional law road, who can remember? It is the ambition of this article to trace the ebb of constitutionalism against the flow of internationalism, focusing on those areas in which they have most starkly intersected. To that end, the article undertakes an assessment of two phenomena which sit at the confluence of criminal process and international norms: the extradition of Canadians in the face of domestic constitutional defences and the domestic prosecution of Canadians in the face of foreign violations of constitutional rights. The goal of the exercise is to discern the force of an increasingly internationalist set of arguments on a simultaneously emerging constitutionalism, all in an effort to explain how these two thematic teammates have been transformed into apparent competitors.

In a series of journal articles and books, Laski argued for the banishment of the concept of sovereignty in political theory, pleading for a functional federalism in its place. It is within this heated intellectual environment, where centralized authority was under sustained attack, that I propose situating the jurisprudence of Richard Burdon Haldane as it concerned the division of powers in the Canadian Constitution. He embraced the legacy left by Lord William Watson, actively shaping the law of the Canadian Constitution in ways that shielded provincial authority from the threat of federal domination, a process that culminated in the 1925 decision striking down the federal Industrial Disputes Investigation Act in Toronto Electric Commissioners v. Snider. Haldane was accused, particularly in the period after his death, of having stripped the federal trade and commerce power of any content, of having relegated the federal power to make laws for the peace, order and good government of Canada to only the most extreme emergencies, such as war, and of having denied the national government the ability to regulate labour relations.
