education law: an overview
One government function is education, which is administered through the public school system by the department of education. The states, therefore, have primary responsibility for the maintenance and operation of public schools. The Federal Government also has an interest in education. The National Institute of Education was created to improve education in the United States. Each state is required by its state constitution to provide a school system whereby children may receive an education. State legislatures exercise power over schools in any manner consistent with the state's constitution. Many state legislatures delegate power over the school system to a state board of education. There is a strong concern with equality in education. Within states this leads to efforts to assure that each child no matter where he or she is situated receives an adequate education. The Equal Education Opportunities Act of 1974 provides that no state shall deny equal educational opportunity to an individual on the basis of race, color, sex, or national origin.

Academic Honesty
Orange Coast College has the responsibility to ensure that grades assigned are indicative of the knowledge and skill level of each student. Acts of academic dishonesty make it impossible to fulfill this responsibility and weaken our society. Faculty have a responsibility to ensure that academic honesty is maintained in their classroom. Students share that responsibility and are expected to refrain from all acts of academic dishonesty. Procedures for dealing with any violation of academic honesty will be followed. Additionally, the Student Code of Conduct and Disciplinary Procedure shall be applied to incidents of academic dishonesty. A disciplinary "F" grade may be assigned for violation of the Academic Honesty Policy, consistent with the District Student Code of Conduct.

The policy of this district is that, unless specifically exempted by regulation, every course section, or class, reported for state aid, wherever offered and maintained by the district, shall be fully open to enrollment and participation by any person who has been admitted to the college(s) and who meets such prerequisites as may be established pursuant to regulations contained in Article 2.5 (commencing with Section 55200) of subchapter 1 of Chapter 6 of Division 6 of Title 5 of the California Code of Regulations.

EPA Rejects Petition to Strengthen Smog Regulations WASHINGTON, DC
, July 8, 2005 (ENS) - The U.S. Environmental Protection Agency (EPA) has rejected a petition filed by public health and conservation groups urging the agency to restore stronger anti-smog limits in some of the nation’s most polluted cities. The groups filed the petition in response to an EPA rule adopted last year to implement the new 8-hour standard for ground level ozone, or smog. Although the new standard is supposed to be stronger than the prior standard, EPA’s rule permits states to relax important pollution limits that applied under the old standard. In some cities, the rule could allow pollution increases of hundreds or even thousands of tons over levels previously permitted. Earthjustice petitioned EPA to reverse this weakening provision on behalf of American Lung Association, Environmental Defense, the Natural Resources Defense Council, Sierra Club, Clean Air Task Force, Conservation Law Foundation, and Southern Alliance for Clean Energy. Last Friday EPA rejected that petition.
