  • Subject to the approval of the Chancellor pursuant to Section 55724, a community college district may designate an amount of time in each fiscal year for employees to conduct staff, student, and instructional improvement activities. These activities may be conducted at any time during the fiscal year. The time designated for these activities shall be known as "flexible time."
  • A district with an approved flexible calendar may designate as flexible time for an employee not more than 8.57 percent of that employee's contractual obligation for hours of classroom instruction which are eligible for state apportionments in that academic year, exclusive of any intersessions.
  • Pursuant to Section 55726, a district with an approved flexible calendar shall ensure that all employees under contract with the district work at least 175 days, including flexible days, in each academic year.

This handbook describes both California and federal laws that deal with issues important to most women. This handbook is not meant to be used in the place of a qualified attorney. If you feel that your rights have been violated, you should seek qualified legal assistance. For information on how to find an attorney, see the "Directory of Services" at the back of this book. The handbook is divided into eight chapters which discuss the legal rights of the women of California - - employment, economic independence, education, housing, health care, domestic relations, childcare and violent crime, and a directory of services.     MEDICAL PRACTICE ACT LAWS RELATING TO MEDICAL ASSISTANTS

    Section 2069
    (A) Notwithstanding any other provision of law, a medical assistant may administer medication only by intradermal, subcutaneous, or intramuscular injections and perform skin tests and additional technical supportive service upon the specific authorization and supervision of a licensed physician and surgeon or a licensed podiatrist. A medical assistant may also perform all these tasks and services in a clinic licensed pursuant to subdivision (a) of Section 1204 of the Health and Safety Code upon the specific authorization of a physician assistant, a nurse practitioner, or a nurse-midwife. (2) The supervising physician and surgeon at a clinic described in paragraph (1) may, at this or her discretion, in consultation with the nurse practitioner, nurse-midwife, or physician assistant provide written instructions to be followed by a medical assistant in the performance of tasks or supportive services. These written instructions may provide that the supervisory function for the medical assistant for these tasks or supportive services may be delegated to the nurse practitioner, nurse-midwife, or physician assistant within the standardized procedures or protocol, and that tasks may be performed when the supervising physician and surgeon is not onsite, so long as the following apply: (a) The nurse practitioner or nurse-midwife is functioning pursuant to standardized procedures, as defined by Section 2725, or protocol. The standardized procedures or protocol shall be developed and approved by the supervising physician and surgeon, the nurse practitioner or nurse-midwife, and the facility administrator or his or her designee. (b) The physician assistant is functioning pursuant to regulated services defined in Section 3502 and is approved to do so by the supervising physician or surgeon.

    Government Code section 8201 requires all notary public applicants to complete approved courses of study prior to being appointed as notaries public.
    The goal of mandatory education is to commission notaries public who are properly trained in their professions and who fully understand their duties and responsibilities, in an effort to standardize knowledge for all notaries public, and thereby reduce complaints and lawsuits due to negligence or misconduct. The Secretary of State's office has adopted regulations to implement this mandatory education program and the procedures for approving educational vendors.   • Review the comments received during the 15-day comment period , April 12, 2004 through April 26, 200, on the additional changes to the EMS Continuing Education Regulations approved at the March 24, 2004 Commission on EMS Meeting. Approve Chapter 11, EMS Continuing Education, as proposed , and approve filing the rulemaking file with the Office of Administrative Law on proposed, Chapter 11, Continuing Education (CE) Regulations (Chapter 11, Division 9, Title 22, California Code of Regulations).
  • FISCAL IMPACT: None. DISCUSSION: On March 24, 2004, the Commission on EMS approved additional changes to the proposed Chapter 11, EMS Continuing Education Regulations and approved a 15-day public review and comment period, which began on April 12, 2004 and ended April 26, 2004. Following the March 24, 2004 Commission on EMS Meeting and prior to the regulations being sent out for the 15-day comment period, the EMS Authority made one other change to the regulations. The change was made in Section 100395(g) on page 14 reducing the required number of hours for program director training from 60 hours to 40 hours (see enclosed draft EMS Continuing Education Regulations, Public Comment Period 4-12-04 through 4-26-04).

    Education Code Section 306(c), an English learner shall be transferred from
    a structured English immersion classroom to an English language mainstream
    classroom when the pupil has acquired a reasonable level of English
    proficiency as measured by any of the state-designated assessments approved
    by the California Department of Education, or any locally developed assessments.
    "Reasonable level of English proficiency" appears to be whatever the school
    districts wish to define it to be. There is absolutely no accountability
    hereno indication of what this term means in terms of language assessment

    California provides significant educational opportunities and health programs to private school students. Recordkeeping/Reports: Transportation. Instruction in English: Discrimination: Teacher Certification: Curriculum: Special Education: Health: Safety: et seq. Transportation: State subsidized transportation for children attending parochial schools is proper under the California Constitution in view of the broad police powers of the state to promote educational welfare and safety of the children. Bowker v. Baker, 167 P.2d 256 (1946). Public Aid for Private Schools/Private School Students: The California Constitution prohibits the appropriation of public money for the support of sectarian or denominational schools or any other school not under the exclusive control of the officers of the public schools. Cal. Const. Art. IX. Section 8. In addition, Art. XVI. Section 5. prohibits any public support for a school controlled by any religious creed, church, or sectarian denomination, including any grant of personal property or real estate. The lending of textbooks, without charge, to students attending nonprofit, nonpublic schools violates the California Constitution prohibiting appropriations for the support of sectarian schools.

    Dear Ms. Reed: Your correspondence and the materials you enclose contain the following facts and representations. CalPERS is a state-run system providing primarily retirement income and death benefits to public employees or their beneficiaries within the State of California. The Western Association of Schools and Colleges upon obtaining a written advisory opinion from the United States Department of Labor that the
    participation of the officers and employees of the association in this system
    would not affect this system's exemption as a governmental plan under
    Section 1001 et seq. of Title 29 of the United States Code [Title I of ERISA]. The association shall be deemed a "public agency" only for this purpose. No action has yet been taken to permit WASC employees to participate in CalPERS. WASC was organized in 1962 by individuals representing both private and public school interests and was incorporated in California pursuant to that state's nonprofit corporation statute. The U.S. Department of Education recognizes WASC as a regional accrediting agency to conduct nongovernmental, peer evaluations of educational institutions. You indicate that WASC's activities with public and private educational institutions provide quality assurance to state and federal educational programs. Within its region, which is one of six covering the nation, WASC accredits most schools at the secondary school level and above. Because all public schools in WASC's region must apply for accreditation, approximately 75 percent of schools accredited by WASC are public schools. In addition, more than 90 percent of WASC's activities involve schools in California.

  • Patients may be seen and treated by House Staff at the discretion of the attending physician and under his/her supervision. Whenever reasonably possible under the circumstances, the attending physician shall disclose to the parents/guardians that the patient may be treated by House Staff under the attending physician's supervision. In the event of an objection by the parents/guardians, the attending physician shall not utilize House Staff in treating the patient, except when necessary in an emergency or due to unforeseen circumstances.
    Members of the medical staff are encouraged to participate in the Program, as teaching is part of the Hospital mission. Those members, however, who choose not to participate in the Program shall not be subject to denial or limitation of privileges for this reason alone.
    Except to the extent they qualify for and are specifically granted independent privileges, all House Staff are under the supervision of members of the medical staff. The intensity and level of supervision provided by the supervising member in each case shall be based upon the demonstrated knowledge and proficiency of the House Officer, the clinical condition of the patient, and the complexity of the circumstances under which the patient is being treated.
