DETERMINATION OF RESIDENCE FOR
NONRESIDENT TUITION PURPOSES
The law governing residence for tuition purposes at the California State University is California Education Code sections 68000-68090, 68120-68134, and 89705-89707.5, and California Code of Regulations, Title 5, Subchapter 5, Article 4, sections 41900-41916. This material can be viewed on the Internet by accessing the California State University 's website at http:www.calstate.edu/GC/resources.shtml Each campus's Admissions Office is responsible for determining the residence status of all new and returning students based on the Application for Admission, Residency Questionnaire, Reclassification Request Form, and, as necessary, other evidence furnished by the student. A student who fails to submit adequate information to establish eligibility for resident classification will be classified as a nonresident. Generally, establishing California residence for tuition purposes requires a combination of physical presence and intent to remain indefinitely. An adult who, at least one full year prior to the residence determination date for the term in which enrollment is contemplated, can demonstrate both physical presence in the state combined with evidence of intent to remain in California indefinitely may establish California residence for tuition purposes. A minor normally derives residence from the parent(s) they reside with or most recently resided with.

Sacramento, CA 95814 Re: Comments Concerning Proposed Regulations on Reclassification of English Learners Dear Members of the Board: I represent Ron Unz, the proponent of Proposition 227 (Education Code Sections 300-340) and his organization, English for the Children. I am writing on his behalf to formally object to certain provisions set forth in the State Board of Education's proposed regulations concerning English Learners (Item 31). We are dismayed to see that several provisions of Section 11309 of the proposed regulations ("Parental Exception Waivers") sharply conflict with the text and intent of Proposition 227. On June 3, 1998, California voters passed Proposition 227 by well over a million votes, one of the greatest landslides for any contested initiative in recent California history. Aimed at replacing California's system of bilingual education with intensive English immersion, the measure passed by a percentage margin greater than that achieved by Gov. Gray Davis in his 1998 landslide victory over Republican Dan Lungren - and nearly twice as great as Al Gore's 2000 Presidential vote victory in California over George W. Bush. Since the passage of the measure, the mean percentile test scores of California's more than one million immigrant students have risen by an average of 50%, a dramatic result extensively covered in much of the major national media, from the New York Times to the Washington Post to CBS News. Most analysts have strongly connected these results with Proposition 227.

Privacy Rights of Students in Education Records
The federal Family Educational Rights and Privacy Act of 1974 (20 U.S.C. 1232g) and regulations adopted thereunder (34 C.F.R. 99) and California Education Code Section 67100 et seq., set out requirements designed to protect the privacy of students concerning their education records maintained by the campus.
Specifically, the statute and regulations govern access to student records maintained by the campus and the release of such records. In brief, the law provides that the campus must provide students access to records directly related to the student and an opportunity for a hearing to challenge such records on the grounds that they are inaccurate, misleading, or otherwise inappropriate. The right to a hearing under the law does not include any right to challenge the appropriateness of a grade as determined by the instructor. The law generally requires that written consent of the student be received before releasing personally ident ifiable data about the student from records to other than a specified list of exceptions. The institution has adopted a set of policies and procedures concerning implementation of the statutes and the regulations on the campus. Copies of these policies and procedures may be obtained at the Office of the Dean of Student Affairs.

Washington, DC 20202-6132 Dear Dr. Johnson: We are writing in response to the May 6, 2002 Federal Register notice of proposed rulemaking on the standards and assessments requirements in Title I of the Elementary and Secondary Education Act, as reauthorized by the No Child Left Behind Act. We are very pleased with the proposed regulations clarifying the inclusion of students experiencing homelessness in State academic assessment, reporting, and accountability systems. This regulation will help schools understand and implement the legislative mandate that all students be assessed. The individual student reports produced by assessment will help parents, teachers, and principals know how students in homeless situations are faring, be able to measure their progress, and thus be able to provide the types of educational support needed in order to meet the state's high academic standards. We thus strongly support the incorporation of this language in the final regulations issued by ED. In addition, we support Title I guidance advising LEAs to include the assessments of children experiencing homelessness in the economically disadvantaged category of disaggregation, in addition to other applicable categories, as was agreed to by ED during the negotiated rulemaking process. Such guidance will help ensure that the performance of students in homeless situations is included in accountability systems, and that LEAs develop a better understanding of the relationship between poverty and homelessness, and the impact of those conditions on academic achievement.

    70.10 Definition; Registration and Membership Requirements
    A Registered Campus Organization is an organization whose membership predominantly comprises students, faculty, and/or staff of a particular University campus, and that attains recognition as a Registered Campus Organization by complying with the requirements and procedures set forth in campus implementing regulations. Such regulations shall require that the organization furnish a written statement of its name and its purposes, signed by its officers or other authorized representatives, and that includes as well such other pertinent information as the campus may specify. Membership in a Registered Campus Organization shall be open to any student, consistent with the Nondiscrimination Policy Statement for University of California Publications Regarding Student-Related Matters , with the exception that membership in an officially recognized sorority or fraternity may be limited by gender. This Policy revision was necessitated by changes in the final regulations for the Drug-Free Workplace Act of 1988, the issuance of Department of Education regulations related to the Drug-Free Schools and Communities Act of 1989, and issuance of the State Drug-Free Workplace Act 1990. The revised Policy includes the addition of students, clarification of those employees who must report convictions of any criminal drug statute violation occurring in the workplace or while on University business, and the extension of special requirements to those engaged on State contracts and grants. Please ensure appropriate notification of employees under your jurisdiction. Implementing Guidelines for the Policy will be issued soon by the Assistant Vice PresidentEmployee Relations.     Article 2. Academic Senates 53200. Definitions. For the purpose of this Subchapter:
  • "Faculty" means those employees of a community college district who are employed in positions that are not designated as supervisory or management for the purposes of Article 5 (commencing with Section 3540) of Chapter 10.7 of Division 4 of Title 1 of the Government Code, and for which minimum qualifications for hire are specified by the Board of Governors.
  • "Academic senate," "faculty council," and "faculty senate" means an organization formed in accordance with the provisions of this Subchapter whose primary function, as the representative of the faculty, is to make recommendations to the administration of a college and to the governing board of a district with respect to academic and professional matters. For purposes of this Subchapter, reference to the term "academic senate" also constitutes reference to "faculty council"; or "faculty senate."
  • "Academic and professional matters" means the following policy development and implementation matters:
