In addition to the First Amendment to the U.S. Constitution, states can provide additional free speech protection for their own citizens by enacting state laws or regulations. California Education Code Sec. 94367, also known as the "Leonard Law," does that. California is the only state that has enacted a law that prohibits private colleges from making or enforcing any rule that would subject a student to disciplinary action for engaging in expression (on or off campus) that would be protected by the First Amendment or the California Constitution's free expression provision if it occurred off campus. The legislative history of the law states: "It is the intent of the Legislature that a student shall have the same right to exercise his or her right to free speech on campus as he or she enjoys when off campus." - Section 4(b) of Stats.1992, c. 1363 (S.B.1115) Student Press Law Center
PUBLIC COLLEGES California Education Code 66301 . Click here to download it. The Individuals with Disabilities Education Act (IDEA), 20 U.S.C.  1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. The IDEA conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with the IDEA requirements. While the federal IDEA statutes and regulations require schools to conduct functional behavioral assessments (FBAs), they provide little to no guideance on what an FBA is or how to conduct one. Therefore, states have begun to step into the void and pass laws and regulations that are more specific. Title 5 Regulations on Distance Education Overview
In July 2002 final Title 5 regulations were adopted for distance education, to replace the previous trial period regulations that were originally adopted in 1994 and modified in 1998. Language concerning curriculum and academic standards remained completely unchanged, but the language was moved out of the subchapter on independent study and into the subchapter describing regular programs, courses and classes. New section numbers were created. You can access the text of these regulations using either the old or the new section number from the links below. Other sections concerning various aspects of apportionment calculations were amended and current language is available below. New Chancellor's Office Guidelines on Distance Education that reflect the July 2002 regulation changes were released in March 2004.

English Language Education for Immigrant Children Proposition 227 Update: At its April 8, 1999 meeting, the State Board of Education voted 7 to 2 to eliminate requirements that were previously in force and unchanged by Proposition 227 regarding identification, reclassification and assessment of LEP students. According to Multicultural Education,Training, and Advocacy, Inc. (1999, Spring) the SBOE changed 1) 5 CCR 4303 that required assessment of students in their primary language for initial identification; 2) eliminated the requirment for objective standards and procedures for reclassifying LEP students as fluent English proficient (5 CCR 4306) and 3) eliminated the requirement to conduct an annual assessment of the academic progress of LEP students (5 CCR 4311). The SBOE stated reasons were that the language of the regulations was inconsistent with the provisions of Proposition 227 and that it felt the need to give school districts more flexibility. META has filed a legal memorandum opposing the changes on the grounds that they seriously undermine rights neither curtailed by passage of 227 nor inconsistent with its provisions and that the changes consistute an action in excess of the authority granted to the board by the Legislature. Among the policies and procedures left in place under established regulations are the requirements for teacher qualifications and authorizing credentials for serving English language learners (BCLAD and CLAD credential or certificate).
