    GOVERNMENT Although the Government of Azerbaijan consists of three branches, Azerbaijan has a strong presidential system in which the legislative and judicial branches have only limited independence. The executive branch is made up of a president, his apparat, a prime minister, and the cabinet of ministers. The legislative branch consists of the 125-member parliament (Milli Majlis). Members are elected for 5-year terms, with 100 of them elected from territorial districts and 25 elected from party lists. The judicial branch, headed by a Constitutional Court, is nominally independent. Azerbaijan's first parliament was elected in 1995. The present 125-member unicameral parliament was elected in November 2000 in an election that showed improvements in democratic processes, but still did not meet international standards as free and fair. A majority of parliamentarians are from the current President's "New Azerbaijan Party." Opposition parties are represented in parliament. According to the constitution, the Speaker of parliament stands next in line to the president. The current Speaker is Murtuz Aleskerov.

    Azerbaijan government accused Mikhail Gorbachev of genocide crimes
    The incumbent government of the republic lays all responsibility for further events in the republic on Mikhail Gorbachev. President Alieyv said that the suggestion to institute the criminal persecution against Gorbachev was a “right suggestion.” This statement became news number one not only in Azerbaijan, but also far abroad. However, mass media did not pay attention to a very important stipulation: Gorbachev trial will become possible only if all procedure formalities are observed.
    Those formalities make a criminal case against the former president of the Soviet Union absolutely impossible. Yury Kolosov, a specialist of law from the Moscow State University of International Relations said in his interview to the Nezavisimaya Gazeta newspaper: “The given situation looks like the one with Pinochet, from the legal point of view. Mikhail Gorbachev is a foreign citizen for Azerbaijan. Needless to mention that he will not rush to yield to the Azerbaijan government. As a matter of fact, Baku will have to address to Moscow with a request to deliver the genocide crime suspect. However, there are no bilateral agreements between Russia and Azerbaijan to deliver criminals. Russia is a member of the European Convention for delivering criminals, although Azerbaijan is not. This means that the only thing that Baku can do about it is to put Mikhail Gorbachev on Interpol’s wanted list. Azerbaijan should have very weighty arguments to prove Gorbachev’s guilt at that. If Mikhail Gorbachev goes somewhere abroad, Interpol agents will be authorized to arrest him then.”

    Illegal Travel Ban Thwarted When Becket Fund Attorney Presents Imam Ilgar Allahverdiev's Speech Before Human Rights Commission The government of Azerbaijan was able to stop Imam Ilgar Allahverdiev from traveling to Geneva to speak at the United Nations Commission on Human Rights, but it could not stop his message of religious freedom. On April 2, Imam Allahverdiev was not allowed to board his Turkish Airlines flight from Baku, the capital of Azerbaijan, to Geneva, Switzerland. Despite repeated requests, the border police gave no reason for not allowing Imam Allahverdiev to travel. In Imam Allahverdiev's stead, Emilie Kao, Director of International Advocacy at The Becket Fund for Religious Liberty, delivered the speech focused principally on religious liberty More specifically, Imam Allahverdiev's speech described the repeated abuse suffered by the Juma Mosque he leads, including closure of the Mosque, imprisonment, and torture of Mosque members. He stated that the Mosque perseveres because it yearns for religious freedom: "If a person cannot choose to believe what he or she wants, how can that person be called truly free, even if he or she can talk about many other things? Freedom of religious belief - and the ability to manifest those beliefs in public - allows us to be honest and truthful with one another, to be truly human with one another."

    In the late 1980s, the advent of Mikhail S. Gorbachev's policy of glasnost in Moscow encouraged vocal opposition to the ruling Azerbaijani Communist Party (ACP). In 1989 the central opposition role went to the Azerbaijani Popular Front (APF), which was able to capture the presidency in the 1992 election. But failure to resolve the disastrous conflict in Nagorno-Karabakh continued to destabilize Azerbaijani regimes throughout the early 1990s. Growing masses of disaffected refugees pressed vociferously for military victory and quickly shifted their support from one leader to another when losses occurred, negating efforts to establish solid political institutions at home or to make concessions that might provide a diplomatic solution to the Nagorno-Karabakh conflict.     Baku, 25 October 2004 - On 18-20 October 2004 United Nations Development Programme (UNDP) Assistant Administrator and the Director of the Regional Bureau for Europe and CIS, Mr. Kalman Mizsei paid an official visit to Azerbaijan. The objectives of the country visit of Mr. Mizsei were to further strengthen cooperation between UNDP and the Government of Azerbaijan in important areas of the organization's work in the country such as poverty reduction, private sector development and Information and Communication Technologies (ICT). During the visit Mr. Mizsei met with the Head of the Executive Office of the President of the Azerbaijan Republic, Mr. Ramiz Mehdiyev, the Minister of Foreign Affairs, Mr. Elmar Mammadyarov, the Minister for Economic Development, Mr. Farhad Aliyev and the Minister of Communication and Information Technologies, Mr. Ali Abbasov. The Head of the Executive Office of the President of the Azerbaijan Republic, Mr. Ramiz Mehdiyev, spoke highly about cooperation between UNDP and the Government and underlined the importance of its expansion. Commending the joint activities of the Government and UNDP in the field of Information and Communication Technology (ICT), he reiterated that the Government of Azerbaijan considers ICT to be one of the priorities of the State. Mr. Mehdiyev recognized the importance of ICT application in E-Governance in general.
