A ten-year-old kid on an adult-sized, all-terrain vehicle (ATV) barrels through the woods behind his house. He swerves to the right to avoid a tree stump. He blinks. Before he knows it he veers off the path and up a dirt hill. The five-hundred-pound ATV tilts to one side, flips over, and crushes him. ATV crashes involving riders under the age of sixteen continue to be a source of serious injuries and fatalities, even when riders are required to wear helmets, according to a study published in the journal Pediatrics. Study coauthors were Heather Keenan, who conducted the work while an assistant professor of social medicine at UNC-Chapel Hill, and Susan Bratton of the University of Michigan. They collected injury and fatality data from trauma centers, hospitals, and death reports in Pennsylvania, which has ATV regulations, and in North Carolina, which does not. The researchers then compared the data to determine if regulations were having the effect intended. Several states allow ATV riders to be as young as twelve, and twenty-three states do not have minimum age laws at all, according to the Specialty Vehicle Institute of America, an industry trade group. Some states such as Pennsylvania require helmet use and restrict driving or riding. Pennsylvania does not allow children under ten years old to ride ATVs on public lands or recreation areas and requires special permits for children under sixteen years old to ride. Other states such as North Carolina have no such restrictions.

As an ATV rider you are responsbile for the safe operation of your machine. However, most of us forget that we also have a civic responsibility for the safety of others, especially children. Simple things like reminding other riders to bring their helmets, discouraging riders from attempting any trail they are not completely comfortable in navigating and riding in groups are just a few small things that can be a big help.

Wear a helmet, HSE warns quad bike users
The Health and Safety Executive (HSE) has issued a warning to users of ATVs (All Terrain Vehicles or quad bikes), particularly agricultural and forestry workers, to ensure they are wearing the appropriate head protection and have received sufficient training on the safe operation of ATVs. These measures can save lives. Charles Fraser, 32, an agricultural mechanic, was fatally injured when he fell, or was thrown, from an ATV which he was testing after repair. Mr Fraser had not been provided with any head protection by his employer, and A.M. Phillip Ltd had not undertaken a suitable and sufficient risk assessment associated with the test-driving of ATVs. The company pleaded guilty and was fined for contravening the Health and Safety at Work etc Act 1974, Section 2(1), in that it failed to ensure, so far as is reasonably practicable, the safety of one of its employees while at work.

COUNTY SNOWMOBILE / ATV REGULATIONS 44.01 DEFINITIONS.
Snowmobile . Any engine driven vehicle of a type which utilizes sled type runners, skis or an endless belt tread or any combination of these or similar means of contact with the surface upon which it is operated, but does not include such vehicles which are either manually propelled or driven by a motor of 4 horse power or less and operated only on private property. All-Terrain Vehicle (hereinafter referred to as ATV) . As defined in Section 340.01(2g), Wisconsin Statutes, means an engine driven device which has a net weight of 650 pounds or less, which has a width of 48" or less, which is equipped with a seat designed to be straddled by the operator and which is designed to travel on 3 or more low-pressure tires. A low-pressure tire is a tire which has a minimum width of 6", which is designed to be mounted on a rim with a maximum diameter of 12" and which is designed to be inflated with an operating pressure not to exceed 6 pounds per square inch as recommended by the manufacturer. Approved Snowmobile trails . Includes all snowmobile trails or routes that have been designated by the County Snowmobile and ATV Coordinator or Forestry and Recreation Committee. OLR Bill Analysis HB 5599 AN ACT CONCERNING THE OPERATION OF ALL-TERRAIN VEHICLES SUMMARY This bill expands the registration requirements for all-terrain vehicles (ATVs); increases the registration fee for ATVs and snowmobiles and the fine for operating an unregistered ATV or snowmobile; creates an ATV account within the Conservation Fund to fund ATV-related uses, and restricts ATV and snowmobile use on state-owned and -managed lands. By law, the Department of Environmental Protection (DEP) commissioner must set aside certain state property for ATV use. The bill reduces, from 12 to 10, the age at which children may operate ATVs on state-owned or -managed land (but see COMMENT). It requires ATV operators and owners to obtain a safe ATV certificate from DEP to operate or allow the operation of ATVs on state-owned or-managed land DEP designates for such use, and requires ATV operators to be at least 10 years old to obtain such certificates. It sets conditions for ATV use by minors and authorizes the commissioner to modify or suspend certificate requirements and enter into reciprocal certification agreements with other states. It makes violation of certain of its provisions an infraction. The bill requires new or used snowmobile or ATV dealers to provide purchasers with information on registration requirements, laws, regulations, and certification requirements, and authorizes the commissioner to adopt regulations to implement its provisions.

National forests were established by Congress in 1897 to improve and protect our country’s forests. The Multiple Use-Sustained Yield Act of 1960 stated that the national forests would be administered for outdoor recreation, range, timber, watershed, wildlife and fish purposes. Today, national forests cover more than 190 million acres nationwide. The U.S. Forest Service frequently finds itself called upon to perform a balancing act, trying to keep all users of the forest content. Conflicts between boaters and fishermen, hikers and horsemen, preservationists and loggers are all part of the balancing act. In recent years a new trouble zone lies between all-terrain vehicle (ATV) users and their opponents. First introduced in 1971, ATVs quickly became popular, with almost 4 million in use today. Two areas of concern regarding ATVs in the national forests are the safety of ATVs themselves, and the effects of their use in the forests on the environment.

Governor's Traffic Safety Committee ATVs To promote the safe operation of all-terrain vehicles (ATVs) and respect for the rights of property owners, New York State requires ATVs to be registered and ATV operators and riders to obey special laws. WHAT IS AN ATV? An all-terrain vehicle is any self-propelled vehicle with two or more wheels that is manufactured for sale to be used primarily off-highway or in off-road competitions, and that is no wider than 70 inches and weighs no more than 1,000 pounds. This does not include vehicles manufactured for off-highway use and designed exclusively for travel on snow or ice, and supported by one or more skis, belts or cleats that utilize and endless belt tread. Those vehicles, which include snowmobiles, are subject to other laws and regulations. ATV REGISTRATION An ATV must be registered with the Department of Motor Vehicles (DMV) if it is operated anywhere in New York State, including on the owner's property. The exception is that ATVs used only for agricultural purposes, or for snow plowing (except for-hire plowing), are exempt from the registration requirement. All-Terrain Vehicles
All-terrain vehicles (ATVs) are three- or four-wheeled motorized vehicles with large, soft tires and a relatively high center of gravity. Used primarily for off-the-road activities, ATVs have handlebars like a motorcycle and are designed for a single operator to straddle the body of the vehicle to move. Some can reach speeds of 50 mph and weigh up to 600 lbs. Very few states require a license to operate an ATV, most of which are used for recreation. There are no mandatory national safety standards for their construction and only some states have issued regulations for their use. ATVs are often operated by children, some as young as age five. ATVs have been involved in an alarming number of injuries and deaths, particularly among young people. Because of this, in 1998, the Consumer Public Safety Commission (CPSC) replaced its initial consent decree with ATV manufacturers with an updated ATV Action Plan agreement, which included not marketing or selling adult-sized ATVs for use by children younger then 16, not marketing or selling 3-wheel ATVs, and providing information and safety education. The American Academy of Orthopaedic Surgeons (AAOS) supports the Consumer Product Safety Commission consent agreement placing restrictions on the sale of four-wheeled ATVs to children. In addition, laws mandating licensing for operators should be passed and enforced.
