ATV regulations for youth riders
It is unlawful for anyone in control of an ATV to permit it to be operated contrary to the following requirements: Age requirement
  • Under 12 -
    • May operate only on private property with permission of the owner.
    12 through 15 -
    • ATV safety certificate valid only if the rider is able to properly reach and control the handle bars and reach the foot pegs while sitting upright on the seat of the ATV. ATV safety certificate is valid for ATVs 90cc or less, unless the person has completed the new riding component test on an ATV over 90ccs. May operate an ATV on public lands or frozen public waters with a safety certificate, only if accompanied on another ATV by a person 18 or over who has a valid driver's license. May make a direct crossing of roadway with a safety certificate, only if accompanied on another ATV by a person 18 or over who has a valid driver's license. Must wear a helmet while operating on public lands and frozen waters when crossing road rights-of-way.
    16 and 17 -

Debating the safety of ATVs

August 28, 2002 All-terrain vehicles, or ATVs, are a controversial subject. For those who ride, ATVs are an exciting way to spend time outdoors. Others view the vehicles as a noisy threat to the environment. A recent study conducted by consumer, children's and environmental groups says ATVs are a serious health threat to children and that the industry needs stricter regulation. Over the past 20 years, more than 4,500 Americans died riding ATVs. Of those deaths, 38 percent were children under 16. Half of those, were under the age of 12.

Registration North Dakota law requires that you register your ATV if it is operated in areas that are open to public access. The fee will register your ATV for two years. These fees pay for ATV safety information, training and facilities. A current registration certificate must be carried on the machine at all times. A valid driver's license or safety rourse permit is required to operate an ATV in public access areas. Persons ages 12-16 must successfully complete an ATV safety Course and written exam to receive an ATV Operators Permit in order to legally operate an ATV. ATV Safety Training Pushed For Kids As Accidents Rise
BURNSVILLE, MN (AP) - Keith Grundhauser spent four hours tearing around a dusty parking lot on a big green ATV, shifting his weight from side-to-side through curves and leaning back hard during panic stops to keep the machine's wheels on the ground. Now 19, he started riding all-terrain vehicles capable of hitting highway speeds when most children were stuck on bicycles. But it wasn't until last week that he got formal training. A $100 check from the maker of his new ATV persuaded him to take the class in riding the popular machines that often leave their riders with sore thumbs and shoulders from gripping the throttle and hanging onto the handlebars. "Everyone thinks they know everything, but they don't," said Grundhauser, of St. Paul, after taking a ride around Buck Hill Ski Area south of Minneapolis with a safety instructor.

By: Carol Dawson Year 2000 Priorities Get a Hearing Frustrated by CPSC's inability to focus on serious product safety hazards, some years ago Congress directed the agency to set priorities in its budget requests. Until recently, CPSC voted to establish certain Priority Projects, which were product safety issues that must be fully funded, i.e., the data collection, research, and/or technical work required would take precedence over other less significant projects. Congress had directed that these projects relate to specific consumer products. The goal was to complete projects in a more businesslike manner rather than dragging projects on and on over the years. Since Ann Brown took over the office of chairman in 1994, priority setting has largely been ignored. Nevertheless, the Commission still considers what it calls programmatic priorities and conducts a public hearing before the budget process begins. Currently CPSC is preparing its Fiscal Year 2000 budget, and it sought public comment at a hearing on May 21, 1998.

Consensus is building for lawmakers to ban the use of all-terrain vehicles on pavement, but a West Virginia University study shows that only about one-third of ATV fatalities in the state occur on highways or other paved surfaces. The study by WVU's Center for Rural Emergency Medicine shows that many more accidents occur off-road, and lawmakers, as well as, lobbyists are far less willing to limit use of the vehicles on private property. The push to regulate the popular vehicles has come after 17 deaths and many injuries this year in ATV accidents. Even Senate Transportation Chairman Mike Ross, D-Randolph, who has opposed some ATV bills in past legislative sessions, has said he would strongly support a bill to keep ATVs off of highways. What he doesn't want are any laws that would interfere with ATV use by farmers, surveyors and people like himself in the oil and gas industry. Leff Moore, a lobbyist for the West Virginia Recreational Vehicle Association, said ATVs should be simply banned from all paved surfaces because they're not designed for it. Their balloon-like tires are meant to mold themselves to rough terrain for traction, not operate on smooth surfaces, he said. According to Sam Love, lobbyist for the West Virginia Motorcycle and ATV Dealers Association, banning their use on paved highways would address only part of the problem, and that would in itself be going too far. He said many dealers believe ATVs should be allowed on many back roads, even those that may be paved.

Filed under: ATV Intermountain Guide News Intermountain Guide strives to promote ATV Safety in Utah and throughout the Intermountain West by providing safe guided ATV tours in Utah and Nevada . A article published recently in the Salt Lake Tribune outlines new potential regulations as non-guided ATV accidents in Utah are on the rise. In the wake of increased deaths and injuries among riders - including 51 deaths in Utah over a five-year period - federal regulators are weighing whether to clamp down on safety standards for all-terrain vehicles.
Consumer Product Safety Chairman Hal Stratton previously opposed more regulation, arguing voluntary industry standards and rider education were the keys to safety. But rising fatalities and serious injuries to riders - particularly youngsters - prompted him to review the matter.
Concern about ATV injuries has grown in Utah as well - right along with the burgeoning sales of the versatile machines.

All-Terrain Vehicle Injury As bigger and faster ATVs have been introduced over the past
decade, ATV-related deaths and injuries have increased
substantially in every age group. From 1997 to 2001, injury rates
increased 23 percent for children ages 6 to 12 and 233 percent for
children younger than 6. ATVs are motorized vehicles with large, low-pressure tires. They are usually designed to carry one rider on an uneven surface and are generally used for recreation and farm, ranch and industrial work. Adult-sized ATVs have engines larger than 90cc. The average adult-sized ATV has an engine between 229cc and 649cc. These vehicles weigh between 400 and 600 pounds and can travel at speeds well above 70 miles per hour. Youth-sized ATVs come in various designs. Manufacturers’ guidelines suggest that children under age 16 should operate ATVs with engines smaller than 90cc and children ages 6 to 12 should operate ATVs with engines between 70cc and 90cc.   • In 2002, at least 44 children ages 14 and under died as a result of ATV-related injuries. Children ages 10 to 14 accounted for more than 75 percent of these death.

Where Will You Ride?
Choose well your places to ride. Before you go out, check on available trails, their condition, ownership of land, posted areas and regulations that apply. Ask about barriers such as fences, rivers, cliffs or swamps; where rivers can be crossed and routes around swamps and cliffs. Get maps and learn how to use them. Power lines, strip mines, old railroad rights-of-way, logging roads are possible places to ride. Forest or park rangers, sheriffs' offices, sportsman clubs, other trail users and 4-wheelers are good sources of information. The Forest Service also offers "Travel Plan" maps

U.S. Consumer Product Safety Commission Chairman to Hold ATV Meeting in Albuquerque, New Mexico
WASHINGTON D.C. - U.S. Consumer Product Safety Commission Chairman Hal Stratton will conduct a regional public field meeting on All-Terrain Vehicle (ATV) safety in Albuquerque, New Mexico, on November 6, 2003.
"We want to hear from New Mexicans and other stakeholders in Arizona, Oklahoma, Texas, Utah, and Colorado about how they use their ATVs. We want to get their perspective on ATV safety issues," said Stratton.
The Commission is aware of 40 ATV-related deaths in New Mexico; 106 deaths in Arizona; 59 deaths in Oklahoma; 206 deaths in Texas; 80 deaths in Utah; and 44 deaths in Colorado between 1982 and 2001. Nationally, the Commission has reports of 4,541 people who died on ATV's during that period. The death rate in recent years has climbed, with Commission staff estimating 547 deaths associated with the use of ATVs in 2000 alone.
ATV injuries requiring an emergency room visit have more than doubled in recent years - from an estimated 54,700 in 1997 to 111,700 in 2001. In this same period, the estimated number of ATV drivers increased 36 percent, driving hours grew 50 percent and the number of ATVs increased 40 percent, according to a recent Commission staff analysis. About a third of the victims injured in 2001 were under 16 years old.

Dangerous ATVs In 2002, the latest year for which figures are available, manufacturers sold 825,000 all terrain vehicles (ATVs). That was more than the number of small pickup trucks sold. Manufacturers such as Kawaski Motors, Honda, Arctic Cat, Polaris, and Yamaha say they previously promoted snowmobiles, but now focus on ATVs. As ATV sales rise, so do the numbers of injuries and deaths, particularly among children. In 2002, there were 113,900 serious injuries and 357 deaths. ATVs fall into a regulatory void. Because they don't operate on roads, they aren't subject to regulation by the National Highway Traffic Safety Administration. Investigated by the Consumer Product Safety Commission (CPSA), the agency concludes states are in a better position to regulate. Only 10 states require a driver's license, 27 require a minimum age for the driver, and 20 states require riders to wear helmets. Two-thirds of states allow 12-year-old drivers. In Utah, 8-year-olds are legal.

Olathe, Kansas - Riding an all terrain vehicle can be an enjoyable and rewarding outdoor sport. ATV's are fun and functional too. On the other hand, reckless or unsafe ATV use can result in a dangerous and destructive experience for both people and the environment. Many people have been seriously injured or have died as a result of ATV-related accidents. More than 3,400 ATV-related deaths have been reported to the U.S. Consumer Product Safety Commission (CPSC) since 1985. Approximately 35 percent of the victims were under 16 years of age and 15 percent were under 12 years of age. In response to the community's need for ATV safety education, Johnson County 4-H has received a grant through American Honda Motor Co., Inc. to offer the public four free classes, March 2, 15, 22 and 30. Participants will receive helmets, gloves, goggles and medical kits along with a handbook on ATV safety. Classes sizes are limited.
