CODE OF FAIR TESTING PRACTICES IN EDUCATION

The Code of Fair Testing Practices in Education ( Code ) is a guide for professionals in fulfilling their obligation to provide and use tests that are fair to all test takers regardless of age, gender, disability, race, ethnicity, national origin, religion, sexual orientation, linguistic background, or other personal characteristics. Fairness is a primary consideration in all aspects of testing. Careful standardization of tests and administration conditions helps to ensure that all test takers are given a comparable opportunity to demonstrate what they know and how they can perform in the area being tested. Fairness implies that every test taker has the opportunity to prepare for the test and is informed about the general nature and content of the test, as appropriate to the purpose of the test. Fairness also extends to the accurate reporting of individual and group test results. Fairness is not an isolated concept, but must be considered in all aspects of the testing process. The Code applies broadly to testing in education (admissions, educational assessment, educational diagnosis, and student placement) regardless of the mode of presentation, so it is relevant to conventional paper-and-pencil tests, computer based tests, and performance tests. It is not designed to cover employment testing, licensure or certification testing, or other types of testing outside the field of education. The

Exemption from school tests
In many US states, students participate in educational testing every spring. In some states, children who do not pass these tests are forced to attend summer school.
At the end of third grade and eighth grade, failure means mandatory retention.
Most children with dyslexia suffer from extreme anxiety during formal tests, and they do not perform well.
In many states, children are not allowed any accommodations while taking these tests even if they have an IEP or a 504 plan that allows accommodations during classroom tests. If you feel that your child would suffer unnecessary stress from this testing, or would not test well, in most states you can exempt your child from participating by writing a letter to the principal. Send a copy to his teacher and any involved resource specialist. In the letter, just state that you do not want your child to participate in the state standardized testing program. It is not necessary to give a reason. Tell the principal that you will either pick up your child from school during the testing times, or that you'll keep your child usuefully occupied in the library.   • design or purchase tests that are aligned with state content and performance standards. If standards span more than one grade, teachers must be informed as to what portion of those multi-grade standards are to be taught at each grade. design or purchase tests that are the same for all children (with appropriate accommodations as needed), but are valid and accessible for all students, including students with limited English proficiency and students with disabilities. design or purchase tests that are consistent with nationally recognized professional and technical standards and use multiple measures that include higher-order thinking skills. Tests must also objectively measure academic achievement, knowledge, and skills without evaluating or assessing family beliefs and attitudes. must produce and provide individual reports of student performance to parents, teachers, and principals in a comprehensible and uniform format. States must also make assessment results to schools no later than the beginning of the following school year, beginning with 2002-03. must all participate in the National Assessment of Educational Progress (NAEP), otherwise known as the "nation's report card." If Congress appropriates sufficient funds, beginning in 2002-03 states must participate in NAEP reading and mathematics assessments at grades 4 and 8 every two years. Until now, state participation in NAEP has been voluntary. ED is expected to use NAEP to confirm state test results in reading and math.

State Proficiency Testing in Mathematics. ERIC Digest. by Kilpatrick, Jeremy In recent years many states have developed their own assessments of student learning in mathematics, usually aligned with state standards or curriculum frameworks. Many of these assessments are intended to have high stakes: financial or other consequences for districts, schools, teachers, or individual students. In some cases, teacher promotions or high school diplomas may depend on students achieving passing scores. As of 1998, 48 states and the District of Columbia had instituted testing programs, typically at grades 4, 8, and 11 (Council of Chief State School Officers, 1998). Currently, 19 states require students to pass a mandated assessment in order to graduate from high school, and several other states are phasing in such a requirement (Gehring, 2000). In response to calls for an end to social promotion, some states and districts have begun requiring grade-level mastery tests for promotion, typically in grades 4 and 8. Interestingly, there is some evidence suggesting an inverse relationship between statewide testing policies and student achievement in mathematics: "Among the 12 highest-scoring states in 8th grade mathematics in 1996, ... none had mandatory statewide testing programs in place during the 1980s or early 1990s. Only two of the top 12 states in the 4th grade mathematics had statewide programs prior to 1995. By contrast, among the 12 lowest-scoring states, ... 10 had extensive student testing programs in place prior to 1990, some of which were associated with highly specified state curricula and an extensive menu of rewards and sanctions" (Darling-Hammond, 1999, p. 33).

Released Tests, Answer Keys, and Scoring Guides
Section 101.33 of the Texas Administration Code (TAC) states, "Beginning in 2004 with the 2003–2004 school year and subsequent even-numbered years, the Texas Education Agency shall release all test items and answer keys for the Texas Assessment of Knowledge and Skills (TAKS), the State-Developed Alternative Assessment (SDAA), and the Reading Proficiency Tests in English (RPTE). After a period of five years, each test item that has been field-tested but not used on a test will be released." In order to implement this section of the TAC, the tests are made available to the public after all districts have completed testing and in accordance to the Schedule for Release of Tests adopted by the State Board of Education on September 12, 2003.
