I would like to thank the Association of Asian-American Studies for giving me the opportunity to speak today. I am in the presence of many academics who, I am sure, know a great deal more about Chinese immigration to North America than I do. However, as a member of the Canadian Senate, I hope to be able to shed some light on Chinese immigration to Canada. I will begin with a broad historic survey, before discussing some of the contemporary issues in Canadian immigration policy, including new legislation tabled last month in our federal Parliament. An examination of Canadian history reveals that aside from our country’s indigenous peoples, no racial or ethnic group has experienced as harsh treatment as the Chinese. The development of the Chinese-Canadian community has been bound inextricably to Canadian immigration policy and past anti-Chinese laws. For a historical review, I have divided Chinese immigration to Canada into four waves.

Voting Resources The ability to have a say in the workings of government, either as an elected official or as a voter, is a powerful empowerment tool. Asian Americans are the fastest growing ethnic population in the United States, yet the community's political strength has yet to be fully realized. There have been some major victories, such as Gary Locke's election as governor of Washington and David Wu's election to Congress from Oregon, and Asian American representation at the state and local levels continues to grow in California. Asian American civic participation continues to lag far behind the community's population growth, however, and voter registration rates are woefully low. In New York, which boasts the nation's second largest Asian American population at more than 800,000, there never was an Asian American elected to city-wide, state-wide or national office until John Liu's election to the City Council in 2001. This is a startling and perilous fact. The stereotype of Asian Americans as a model minority has obscured the continuing barriers that prevent Asian Americans from participating effectively as candidates or as voters. Barriers to Political Participation Throughout United States history, Asian Americans have been disenfranchised by discriminatory laws that denied citizenship to Asian immigrants and rendered them ineligible to vote. It was not until 1943 that Chinese Americans were first permitted to become citizens. For Asian Indians, it was 1946. For Japanese Americans and other Asian Americans, that right did not come until 1952. The legacy of these discriminatory policies and the notion of Asian Americans as foreigners is still strongly felt today, impeding Asian American political participation.

Anti-Asian Voter Discrimination in 2004 Commemorating the 40th anniversary of the federal Voting Rights Act earlier this month, the Asian American Legal Defense and Education Fund (AALDEF), a 31-year old civil rights organization, released a new report outlining an array of voting obstacles encountered by Asian American in the November 2004 Presidential Election. AALDEF's new report, Asian American Access to Democracy in the 2004 Elections, documents violations of the Voting Rights Act and Help America Vote Act (HAVA) and other incidents of anti-Asian voter disenfranchisement in 23 cities in 8 states: New York, New Jersey, Massachusetts, Rhode Island, Michigan, Illinois, Pennsylvania, and Virginia. On Nov. 2, 2004, with the help of more than 1,200 volunteers, AALDEF monitored almost 200 poll sites and conducted a multilingual survey of 11,000 Asian American voters. AALDEF received more than 600 complaints of voting barriers. AALDEF executive director Margaret Fung said, "In the 2004 elections, Asian Americans faced an array of barriers that prevented them from exercising their right to vote." These included:

This guide is designed to serve as an introduction to the resources in the John Jay College Library in the areas of Asian criminal justice and legal studies and Asian American criminal justice and legal studies. The aim of this guide is to help the users of the John Jay Library to locate the material that the Library has in this field and suggest some additional resources available in New York City. The first and second sections of the guide have been devoted to Asian and Asian American criminal justice and legal studies respectively. It was arranged in this manner so that the researcher of Asian American studies may first look through the sources pertaining to Asia to gain an understanding of the history of the cultures and the laws which govern them, the possible sociological, political, or economic causes of criminal behavior, and the effectiveness or ineffectiveness of corrections in these groups. The section on Asian American criminal justice is concerned with the study of criminal behavior among these ethnic groups and the legal system’s response as well as Asian American victimization by criminals or by the legal system in this country. While the bibliography concentrates largely on the materials available in the reference and reference law collections, much more information is available in the circulation and periodical collections. This guide will go over any databases or indexes needed to search for information in these sources. In addition, electronic resources as well as many libraries in the New York City area can also be consulted. The third section of this guide contains information on all of these resources.

HARRISBURG, Pa. The newly created Governor's Advisory Commission on Asian American Affairs and its 15 appointed commissioners held the inaugural meeting recently, according to Gov. Edward G. Rendell. Commissioners will serve three-year terms.
Rendell said he created the Commission by Executive Order to ensure the state's responsiveness to the needs and concerns of its Asian American citizens. Commissioners will plan and develop initiatives jointly with Pennsylvania's Asian American citizens and communities, businesses, educational institutions and governmental entities to benefit Pennsylvania and its citizens culturally, economically, educationally and technologically.
At the first meeting, the Commission began discussions on the topics of international business, health care, education and to review its mission statement. The Commission also will focus on highlighting the rich Asian culture for the benefit of all Pennsylvanians, Rendell said, noting that more than 75,000 Asian Americans live and work in the Keystone State.
Rendell appointed Hai-Chow Harry Kao as the Commission's first executive director and Atty. Michael Choi as chairman on June 28. Other commissioners include Manny Alam, Philadelphia; Douglas M. Chen, Harleysville; PJ Dhillon, Harrisburg; Dr. Freddie Fu, Pittsburgh; Atty. Glenn F. Hing, Philadelphia; Adam Kim, North Wales; Bao Ming Li, Ph.D., State College; George Matthews, New Holland; Truong N. Phuong, Harrisburg; Narasimha B. Shenoy, Malvern; Grace L. Shu, Montoursville; Andy Toy, Philadelphia; Julie Wong, Philadelphia; and Chris Yau Choy Young, Pittsburgh.

Thursday, October 23, 2003 CONTENTS ACTION ALERT: Sikh Americans from Key States Urged to Contact Representatives Regarding Hate Crimes Legislation SMART has been working with the Leadership Conference on Civil Rights, the nation's largest umbrella civil rights organization, to advance federal legislation combating hate crimes. Current law permits federal prosecution of a crime as a hate crime only if the act was motivated by bias based on race, religion, national origin, or ethnicity, and the assailant intended to prevent the victim from exercising a federally protected right. If this legislation is enacted, it would expand federal jurisdiction to include a broader set of bias categories. Second, the legislation would increase funds and support from federal law enforcement in the prosecution and investigation of hate crimes. Such action would enhance vigilance and effectiveness in the response to hate crimes.
