Judicial Selection - An Asian American Perspective
Sandra R. Otaka For Asian Americans, the choice between merit or appointive selection and the election of judges turns, in large part, on which system is more likely to give Asian American attorneys equal access to becoming judges. In many areas of the country, merit selection may offer Asians greater opportunity. Chicago, where the Asian American population runs between 4 and 5 percent, is a case in point. Several years ago, the Asian American Bar Association of the Greater Chicago Area took a position supporting merit selection. To understand why, a little local Asian American history is helpful. Merit Selection v. Election Ten years ago, Illinois had not one Asian American judge. No Asian American had ever been appointed by the Illinois Supreme Court, which is still true today. No Asian American had ever been elected to the bench. And, no Asian American had ever been selected by the circuit court judges as an associate judge. (In this quasi-merit selection process, the chief judge of the county creates a list of candidates. Then all the elected circuit court judges vote. The candidates with the most votes become associate judges. These judges never have to stand for election by the general public.) All this was true even though Illinois had the fourth largest Asian American population in the United States.

hen Leo Choy remembers the 1960s, he remembers the days when it would have been unthinkable for an Asian American to do what he does now: head up a contracting firm, let alone one that grosses $7 million a year and employs some 50 people. That's because until 1984, when the city's minority business ordinance was first approved, city contracting and subcontracting jobs went almost exclusively to a tight-knit, virtually all-white crowd. The unions that controlled the labor supply offered membership only to apprentices, themselves usually relatives of union members. "They were networking only with those they've worked with," recalls Choy, now in his 50s. But thanks to City Ordinance 12D, formally known as the Minority/Women/Local Business Utilization Ordinance, Choy's LC General Engineering and Construction of San Francisco has won significant bids. Among other jobs, the firm was responsible for rewiring Balboa and Mission high schools to accommodate computer networks. Since the mid '80s when the ordinance went into effect, "a lot of our contractors and engineers have gotten into public works," said Choy, also president of the Asian American Contractors Association, a group representing more than 100 companies in the Bay Area.

The call for a recognition of cultural diversity, a rethinking of ways of knowing, a deconstruction of old epistemologies, and the concomitant demand that there be a transformation in our classrooms, in how we teach and what we teach, has been a necessary revolution-one that seeks to restore life to a corrupt and dying academy. ASIAN AMERICAN LITERATURE AND THE IMPORTANCE OF SOCIAL CONTEXT
    Elaine H. Kim
Eat a Bowl of Tea No-No Boy II Also part of the social context of Asian American literature are the stereotypes of Asians in American popular culture. They vividly reflect the attitudes that have helped shape the Asian experience in the United States, and they remain today in various forms as a legacy Asian American writers are forced to recognize if they hope to be understood and appreciated. Chickencoop Chinaman The Woman Warrior Publishers Weekly The Woman Warrior is deliberately antiexotic and antinostalgic, as can be seen in the unexpected way Kingston satirically describes the Chinese food that Chinatown tourists think they know so well: Many of the first Asian American writers in English were trying to counter negative stereotypes about Asia and Asians. Understandably, the earliest efforts do not reflect the realities of life for most Asians; because United States laws restricted the immigration, naturalization, and settlement of Asians, the relatively small Asian population consisted until recent years primarily of laborers without the means or the inclination to write. Most had little formal education, particularly in English. Besides, writing and literature were the domain of the literati of Asia, who traditionally confined themselves to poetry and classical essays. Autobiography as such was a Western form, and fiction was considered frivolous. Peasants performed as storytellers, dramatic dancers, and singers, but they rarely expressed themselves through the written word, and certainly they did not write autobiographies.
