Analysis
What the Bill does
  • Under the existing U.S. patent law, the right to patent the invention belongs to the person who was the first to invent, not the one who was first to file for the patent. The rationale is that such provision protects the small individual inventor who cannot rush to the patent office to get a patent. A common criticism of the U.S. system is that in practice this provision gives rise to expensive litigation over who was first to invent, and therefore, favors corporations with big money. Besides it is out of tune with the rest of the world.
    Best mode is a subjective test; the court looks at whether at the time of application the patentee knew about the best mode. Needless to say, it invites much litigation in patent invalidity challenges. Section 4 of the bill eliminates this requirement so that inventors will not have to disclose the best mode.

Teleflex v. KSR (Fed. Cir. 2004) (unpublished). Intro : Teleflex sued KSR for alleged infringement of Teleflex's patented adjustable gas-pedal assembly (Patent No. 6,237,565). The case was dismissed on summary judgment after the judge determined that the invention was obvious. Teleflex appealed the decision. Obviousness : A patent claim is obvious, and thus invalid, when the differences between the claimed invention and the prior art "are such that the subject matter as a whole would have been obvious at the time the invention was made to a person having ordinary skill in the art." The determination of whether an invention is obvious is based on a number of factors commonly termed Graham Factors, including:

    Since every patent is presumed valid ( 35 U.S.C. 282 ), and since that presumption includes the presumption of operability (Metropolitan Eng. Co. v. Coe , 78 F.2d 199, 25 USPQ 216 (D.C.Cir. 1935),examiners should not express any opinion on the operability of a patent. Affidavits or declarations attacking the operability of a patent cited as a reference must rebut the presumption of operability by a preponderance of the evidence. In re Sasse , 629 F.2d 675, 207 USPQ 107 (CCPA 1980). Further, since in a patent it is presumed that a process if used by one skilled in the art will produce the product or result described therein, such presumption is not overcome by a mere showing that it is possible to operate within the disclosure without obtaining the alleged product. In re Weber , 405 F.2d 1403, 160 USPQ 549 (CCPA 1969). It is to be presumed also that skilled workers would as a matter of course, if they do not immediately obtain desired results, make certain experiments and adaptations, within the skill of the competent worker. The failures of experimenters who have no interest in succeeding should not be accorded great weight.

    Introduction
    Some critics have said that due to the low citation numbers of non-patent references in software patents, the burden of showing non-obviousness and innovation has not been met and these patents should be considered invalid. Additionally, the "state of the patenting art" is marked by increasingly high number of patents in technical areas of minimal revolutionary innovation. This study was undertaken to investigate the practice of citation of non-patent references in patents over the course of the last 27 years in areas of decidedly non-technical nature. In addition, the growth in the numbers of patent issued and numbers of citation of any prior art was assessed. Comparison was made to the major criticized area of software patents
    Findings

    The Art of living of the Eritrean people can be depicted in many varied forms. With each time period, we see the need for different modes of representation where the New and the Old are reflected in the eyes of artists, in the choices they make, in how they represent themselves and their environment, and how they use symbols to create a universe that encompasses both a personal vision and a rich imagery inspired from the diverse cultures of Eritrea. Sometime in the month of April 2005, there was a casual meeting at The Gallery in Asmara where, in lieu of an exhibition, artists and art lovers discussed the subject of Art Criticism. This manifestation shows that more and more efforts are being undertaken to foster the creation of favorable art environments around the country and the art scene in Asmara was certainly looking for a forum to exchange experiences, discuss styles and ultimately to muse on the purpose and meaning of art, i.e. its philosophy. A work of art, when of interest, often titillates us with the mystery of its own creation. No matter how much it can be deconstructed into its basic elements, the whole is greater than the sum of its parts. At the most immediate level, there is an object, a construction, and at another, the concepts, the ideas. In terms of criticism, understanding and interpreting works of art may be fundamental issues, but for the artists it seems that criticism itself is but a factor relevant only subsequently, a postscript to the creative process.

    UTILITY PATENT INFORMATION
    I. Background Information
    To give you some background information, a patent is a contract between an inventor and the government. The inventor must fully disclose his invention and he thereby contributes something new and useful to the fund of public knowledge. In exchange, the government grants to the inventor, or his assignee, the right to exclude others from making, using or selling the claimed invention for 20 years from the date of filing of the application for patent.
    When a patent application is filed with the United States Patent and Trademark Office, a Patent Examiner, in determining patentability, must find that the invention is (1) useful, (2) novel and (3) non-obvious. The invention is useful if it has a present day useful purpose. Novelty is satisfied unless the Examiner finds a single prior art reference which contains all of the features of the invention which are claimed in the patent application.
    In determining whether an invention is obvious, an Examiner may rely on the combined teachings of several patents, printed publications or other prior art references. If a hypothetical person of ordinary skill would view the claimed invention either as an obvious combination of the individual features disclosed in several references, or as an obvious extension of the existing technology, then the Examiner will reject the application as not patentable. In reality, the determination of obviousness involves subjective judgment regarding, for example, the actual content of the prior art, the level of skill of the ordinary skilled person in the technical field and the reasonableness of combining features from different source references.
