All of the sections of the MPEP are found in the section index 2143.01 Suggestion or Motivation to Modify the References THE PRIOR ART MUST SUGGEST THE DESIRABILITY OF THE CLAIMED INVENTION "In determining the propriety of the Patent Office case for obviousness in the first instance, it is necessary to ascertain whether or not the reference teachings would appear to be sufficient for one of ordinary skill in the relevant art having the reference before him to make the proposed substitution, combination, or other modification." In re Linter, 458 F.2d 1013, 1016, 173 USPQ 560, 562 (CCPA 1972). Obviousness can only be established by combining or modifying the teachings of the prior art to produce the claimed invention where there is some teaching, suggestion, or motivation to do so found either in the references themselves or in the knowledge generally available to one of ordinary skill in the art. In re Fine, 837 F.2d 1071, 5 USPQ2d 1596 (Fed. Cir. 1988); In re Jones, 958 F.2d 347, 21 USPQ2d 1941 (Fed. Cir. 1992). In In re Fine, the claims were directed to a system for detecting and measuring minute quantities on nitrogen compounds comprising a gas chromatograph, a converter which converts nitrogen compounds into nitric oxide by combustion, and a nitric oxide detector. The primary reference disclosed a system for monitoring sulfur compounds comprising a chromatograph, combustion means, and a detector, and the secondary reference taught nitric oxide detectors. The examiner and Board asserted that it would have been within the skill of the art to substitute one type of detector for another in the system of the primary reference, however the court found there was no support or explanation of this conclusion and reversed.

All of the sections of the MPEP are found in the section index 716.07 Inoperability of References Since every patent is presumed valid (35 U.S.C. 282), and since that presumption includes the presumption of operability (Metropolitan Eng. Co. v. Coe, 78 F.2d 199, 25 USPQ 216 (D.C.Cir. 1935),examiners should not express any opinion on the operability of a patent. Affidavits or declarations attacking the operability of a patent cited as a reference must rebut the presumption of operability by a preponderance of the evidence. In re Sasse, 629 F.2d 675, 207 USPQ 107 (CCPA 1980). Further, since in a patent it is presumed that a process if used by one skilled in the art will produce the product or result described therein, such presumption is not overcome by a mere showing that it is possible to operate within the disclosure without obtaining the alleged product. In re Weber, 405 F.2d 1403, 160 USPQ 549 (CCPA 1969). It is to be presumed also that skilled workers would as a matter of course, if they do not immediately obtain desired results, make certain experiments and adaptations, within the skill of the competent worker. The failures of experimenters who have no interest in succeeding should not be accorded great weight. In re Michalek, 162 F.2d 229, 74 USPQ 107 (CCPA 1947); In re Reid, 179 F.2d 998, 84 USPQ 478 (CCPA 1950).

Book Notes This page is a casual pass-time of mine to record my thoughts about my art books. The entries are not formal book reviews, but brief notes on the books' subject and significance. Entries appear in no particular order, although the catalogue list is alphabetized by title. In the early 1980s I began haunting used book fairs for old books with good text, and browsing bookstores for more contemporary publications with good photos of art. Since then my collection has blossomed into hundreds of books and catalogues. This page is a first stab at discussing some of this material and it's a work in progress. Time permitting, it may become a more thorough compendium of reviews organized by order of the importance of each book. But for now, this is just for fun I love my books and learn more from them through note-taking. Hopefully these notes offer interest and insight for those who also love art and art books.

While Ernie O'Malley's On Another Man's Wound is recognized as a classic account of the Anglo-Irish War from 1916 to 1921, the author's introduction to the book makes it clear that it is also a book about culture. "The tradition of [End Page 143] nationality," O'Malley wrote, "which meant not only the urge of the people to possess the soil and its products, but the free development of spiritual, cultural and imaginative qualities of the race, had been maintained towards the end of our struggle not by the intellectuals but by the people who were themselves the guardians of the remnants of culture."
