Redwood City police continue arson investigation

Print this page REDWOOD CITY — Investigators are combing through a list of Redwood City probationers and parolees convicted of arson in hopes of identifying a suspect or suspects in their investigation of five suspicious fires Saturday morning.
Redwood City Police Department Detective Jeff Price said Tuesday that there are four adults out on parole in Redwood City with previous arson convictions.
The Police Department is also waiting for a list of registered arsonists in San Mateo County from the Department of Justice in Sacramento. Investigators continue to encourage citizens to call in any information they may have regarding the fires, which began between 2 a.m. and 5:30 a.m. at five separate apartment complexes on the west side of El Camino Real, police said.
The fires occurred on Hess Road, Arch Street, and Lincoln, Jackson and Oak avenues, according to the Redwood City Fire Department.

The U.S. Fire Administration recently announced the beginning of its 14th annual program of providing direct technical assistance to selected state and local fire investigation agencies. According to the USFA, case prioritization and management, arson data collection and analysis, investigation reports, training, and time-of-day staffing coverage also are key components of the site reviews. This program provides this assistance to help improve arrest and conviction rates and promote arson prevention by highlighting the positive features of a jurisdiction's arson control operations, recommending options for resolving problem areas, and identifying potential inter-agency and community anti-arson partnerships. Any state, county or city fire investigation agency interested in participating should meet the following criteria:

Sloppy arson investigation could undo guilty plea

Arson investigators may believe that a guilty plea solves all their problems in collecting and preserving evidence and in proving a case. But the Nebraska Supreme Court recently showed that improperly collected evidence can come back to haunt an investigation - even 13 years later. State of Nebraska v. Thomas J. Silvers, 255 Neb. 702; 587 N.W.2d 325; 1998 Neb. lexis 230, Dec. 4, 1998 "In 1986, following a fire at his home that caused the death of his stepdaughter, Thomas J. Silvers pled guilty to first degree arson and first degree felony murder and is currently serving sentences for those convictions." Although Silvers sought post-conviction relief from his plea of guilty based on several theories, the key one for our purposes was: "... he was denied effective assistance of counsel because his attorney failed to file a motion to suppress evidence seized by fire and police officials without warrants at various times after the fire and failed to inform him of the viability of such a motion."

Tech Assist "Arson is increasingly experienced as a violent crime committed for many different reasons," said R. David Paulison, United States Fire Administrator. "USFA's technical assistance focuses heavily on improving the working relationships among fire, police, prosecutors and other state or federal agencies by suggesting strategies for closer cooperation." "Case prioritization and management, arson data collection and analysis, investigation reports, training, and time-of-day staffing coverage also are key components of the site reviews." USFA provides this assistance to help improve arrest and conviction rates and promote arson prevention by highlighting the positive features of a jurisdiction's arson control operations, recommending options for resolving problem areas, and identifying potential inter-agency and community anti-arson partnerships. The Arson Control Assistance results in a confidential report with guidelines to improve arson investigations and case outcomes. The program already has proven to be a valuable service to over 120 State and local jurisdictions. The Massachusetts State Fire Marshal is mandated to investigate the cause and circumstances of fires and explosions where local fire authorities are unable to determine the cause, where a violation of law exists, or when the fire or explosion is classified as suspicious or incendiary nature. By administrative order, the State Fire Marshal also investigates cases involving explosive devices, blast explosions, fires causing fatal or serious injuries or which damage state property or any public records.
The State Fire Marshal’s investigators are most often called in to join with rural, suburban or urban fire service and law enforcement investigators in a "team" probe of large scale fires, arsons, and fires or explosions which result in injury or death. With chants of "Civil Rights are under attack, what do we do? KVUE Fire destroyed 6 units at the Austin Park Apartment complex Monday. Andrew Ryan Neely-Otts, 25, is accused of setting fire to the Austin Parke and Chevy Chase apartments. He was arrested Monday morning at the Travis County Courthouse. Both complexes are near Anderson Lane and U.S. 183. The fires began around 3 a.m. August 1. Six units at the Austin Parke complex were destroyed, and several others were damaged. More than two dozen people were displaced as a result of the fire. No one was injured. The office and the club house at the Chevy Chase apartments were damaged. No residences were involved. Both apartments are owned by the same company, Belco-Equities, which has several properties throughout Austin.

The State Fire Marshal is the chief investigator in charge of the investigation of arson and suspected arson in the State of Texas. By statutory authority, the State Fire Marshal commissions peace officers to act as fire and arson investigators and to perform other law enforcement duties. Fire and Arson Investigation Services Division Field Investigators may be assisted by in the analysis of evidence. Forensic Arson Laboratory services are also provided at no cost to the fire service and other law enforcement agencies in the State of Texas.

The 16-year-old girl is in intensive care in Grimsby's Diana, Princess of Wales Hospital after Sunday's blaze at her home in Claxby Road, Scunthorpe. Her parents and 10-year-old brother were also injured, but less seriously. Six men aged between 17 and 39 and a 16-year-old girl are being questioned by police in Scunthorpe and Hull. On Saturday night, officers were first called to a disturbance outside the house which involved the occupants of a car and a van allegedly shouting abuse and throwing missiles. The fire broke out early on Sunday morning. Scenes of crime officers and fire investigators were continuing to examine the house on Monday and the area remained cordoned off.

Fire/Arson Investigation Unit The Fire Investigation Unit is comprised of one lieutenant, one sergeant, 12 fire investigators, and an arson accelerant detection K-9 named Augie. This unit is under the direct supervision of the captain of the Fire Prevention Bureau. The fire investigators work a rotating shift schedule: two 12-hour days and two 12-hour nights followed by four days off. The Fire Investigation Unit has the authority to investigate the origin, cause, and circumstances of every fire, explosion, or hazardous materials emergency in which the fire department has a reasonable interest. When the fire investigator has reason to believe that a fire, explosion, or hazardous materials incident may be the result of a violation of any law, the investigator will immediately take custody of and safeguard all physical evidence in connection with the incident.
