ARSON AND EXPLOSIVES It's difficult to say who's the forensic scientist in this field, that is, the one who testifies as an expert on the stand who may just be an expert witness testifying from hypotheticals. Police bomb squad duties usually consist of mostly retrieval and disposal, responsibilities more in common with HAZMAT than forensic arson/explosion investigation. Likewise, many firefighters don't have the specialized talents of arson investigators. Add to this the problems of jurisdiction and overlap between police and fire departments, and you begin to see the confusion. A lot depends upon job title and work-related responsibilities. In this forensic area, job function determines expertise. Fires and explosions, by their very nature, require extensive on-site investigation, so it's a safe bet to say that the one who testifies as the forensic expert will be the one who is most able to make sense of chemical tests conducted by criminalists AND has practical on-site investigative knowledge of the crime scene. In most cases, this will be someone called the arson investigator, although explosion experts can be found separately. In rare cases, forensic chemists, pathologists, and other experts also testify. Any expert witness in this area should have an understanding of the chemistry of fire and the principles of combustion. They should not only keep up-to-date with the research literature, but they should have actual experience in the handling of explosives. Few fire safety education programs exist, so forensic law doesn't require any college degrees (although it's a plus). Both basic and advanced training courses exist at various institutes, and these are commonly sought-after credentials. Laboratory personnel must usually be qualified at recognizing chromatographic patterns. Experts are also generally expected to be familiar with manufacturer and association tests and standards, not that there are any proficiency tests, but that belonging to a professional association goes a long way in qualifying as an expert and in keeping one's skills sharp. According to ESPN, Santa Barbara County Fire Department investigators want to speak to the former NBA star concerning a criminal arson investigation. It took 250 firefighters more than four hours to contain a 25-acre fire last Saturday adjacent to the Rancho San Marcos golf course where Jordan and about a dozen friends were playing golf. "While we do not believe Mr. Jordan is personally responsible for starting the fire, our investigators have been told that members of his party could have started it, and we would like to speak to Mr. Jordan or his managers to learn more about their group," Santa Barbara County Fire Department Spokesman Keith Cullom told ESPN on Thursday. "So far, we are not getting any cooperation from him. "Michael Jordan was not at the hole where the fire started, but it is believed he would know who was involved. While we're not asking Michael to pick up the phone and call us, it would be appropriate for his managers or representatives to assist in our investigation, and so far they are not."

The Arson Bureau is responsible for conducting fire scene and follow up investigations for all incendiary or suspicious fires. In addition, Arson Investigators are called to determine the cause of fires that are not immediately discernible to firefighting personnel. The unit also investigates explosions, fire related deaths, life threatening burn injuries, suspected explosive devices and bomb threats. The unit is comprised of a Captain, one Lieutenant and twelve Arson Investigators. All investigators are certified peace officers. Penal Code 28.02 Arson: A person commits an offense if he starts a fire or causes an explosion with intent to destroy or damage:
  • any vegetation, fence, or structure on open-space land; or any building, habitation, or vehicle: knowing that it is within the city limits of an incorporated city or town; knowing that it is insured against damage or destruction;

    Click here to return to Home Page The Arson and Fire Investigation Division of the Dallas Fire-Rescue Department is responsible for determining the origin, cause, and circumstances of fires that occur in the City of Dallas. The divisions nineteen arson and fire investigators are sworn peace officers and enforce the laws of the State of Texas pertaining to arson and malicious false alarms. They are specially trained in the discovery, preservation, and presentation of evidence in proving the crime of arson.
    The Arson and Fire Investigators of Dallas Fire-Rescue investigate hundreds of fires each year that are determined to be intentionally set or incendiary in origin. Incendiary blazes are responsible for a large percentage of the annual fire loss within the City of Dallas and result in several fire fatalities each year. These malicious and criminal acts affect everyone within our communities. Burned structures blight our neighborhoods, lower property values, and cause increases in insurance rates.
