During the Juvenile Court process there should be inquiry into whether the youth who is the subject of the Court proceeding is eligible for or is receiving special education. This is not because the Court should make educational decisions, but because it is relevant to the disposition of most cases. The State, and its constituent parts, have a particular responsibility in this area.
"Related Services" include transportation, and such developmental, corrective, and other supportive services including speech language pathology and audiology services, psychological services, physical and occupational therapy, recreation, including therapeutic recreation, social work services, counseling services, including rehabilitation counseling, orientation and mobility services, medical services for diagnostic and evaluation purposes as may be required to assist a child with a disability to benefit from special education.9
IDEA permits a child whose behavior is a manifestation of disability to be placed in an appropriate "interim alternative education setting" over parental objection for dangerous behavior under certain circumstances. School personnel cannot take this action on their own. Rather, they must request a due process hearing and seek an order from a Hearing Officer placing the child in the interim alternative educational setting.11

(Under separate cover) The district received two charter school applications on Oct. 1, 2004, under the names of Lotus School for Excellence and The New America School. DAAC reviewed the applications and reached consensus on a number of strengths and concerns. By law, DAAC is required to review charter applications before the board acts on the application. The DAAC report will be presented to the board of education and questions will be addressed.
Representatives of the Lotus School for Excellence community will present an overview of their school and answer questions from the board.

Not all children with chronic debilitating illnesses can be managed at home and therefore require care in some type of long-term, or extended care, facility. These facilities are often necessary for multiple reasons, including:
  • The severity or complexity of the illness and / or the inability to set up and maintain adequate home care or other needed services within the community
  • Community resources such as school, day care and respite may be absent or inadequate
  • Some caregivers are dysfunctional, short handed or disabled themselves
  • As children with severe disabilities are now living longer and their parents aging, some families are unable to provide the necessary quality and quantity of care

The Department of Curriculum and Instruction offers a variety of degrees and programs. Before proceeding into any field of education at SWT, the degree applicant should inquire as to certification requirements associated with or prerequisite to the degree. You must keep in mind that certification requirements and graduate degree requirements may not be related and that the satisfactory completion of degree requirements may not always lead directly to certification.
The Master of Education degree offerings from each department consist of a minimum of 36 hours without the thesis. Semester hour requirements vary within the major and minor areas. Some courses are scheduled at night to enable working students to complete a degree and/or certification. It is also possible to earn the degree of Master of Arts with majors in Elementary Education and Secondary Education with a minimum of 30 semester hours including the thesis.

School administrators continue to struggle with disciplining special education students under the Individuals with Disabilities in Education Act (IDEA), but experts say educators shouldn't feel their hands are completely tied by the federal regulations. The keys to successfully disciplining special ed students are: thorough knowledge of the IDEA and its implementing regulations; using the IEP team to determine if the child's behavior was the result of his or her disability and involving parents in the decision-making. Patricia Jordan Rea, Ed.D., a former special education teacher and director who teaches at the College of William and Mary, advises school administrators to become especially familiar with the protections for students with disabilities under the "stay put" provisions of IDEA: suspensions over 10 days are not allowed; long-term suspension or expulsion for misconduct determined to be related to a student's disability is not allowed; educational services cannot cease if a student is removed from school for a long-term suspension or by expulsion; and disciplinary measures are to be made by the IEP team rather than unilaterally.
