House Panel Holds Hearing on Regulations Governing Proprietary Institutions
Members of the U.S. House Committee on Education and the Workforce heard differing opinions about whether current federal regulations that govern the financial-aid eligibility of for-profit postsecondary institutions should be relaxed. At issue are rules that require at least 10 percent of a proprietary institution's revenue to come from sources other than federal student-aid programs and that prevent institutions from offering more than half of their instruction through distance education. David Rhodes , president, School of Visual Arts in New York City, argued that proprietary institutions were seeking “simply recognition of reality — the reality of the changes in higher education in the last 30 years and the reality that an institution's corporate structure does not determine its status as an institution of higher education.” Nicholas Glakas , president, Career College Association, charged that the "60 Minutes" report that prompted the hearing was grossly unbalanced. Glakas argued that the issues raised in the report do not indicate an industry-wide problem and that "until an investigation has been concluded, no conclusions should be drawn since no charges have been made."

Charter Schools: An Approach for Rural Education? ERIC Digest.
Charter schools have emerged in the 1990s as a prominent and controversial school reform idea. This Digest describes characteristics of charter schools, outlines some tentative research findings, discusses advantages and shortcomings, and summarizes challenges rural communities might face in starting such a school.
WHAT WE HAVE LEARNED ABOUT CHARTER SCHOOLS
In some ways, charter schools are traditional and tap historic rural roots of public education. They give parents, students, and educators public school alternatives based on the idea that competition will bring educational innovations (Thomas, 1996). But there is potential for controversy, especially in poor rural communities with limited financial and educational resources to support additional schools. Since Minnesota passed the first charter school law in 1991, 32 other states and the District of Columbia have passed similar legislation (Hirsch, 1998). The Center for Education Reform (1998) estimated 1,129 charter schools existed nationwide in September 1998. Most schools were in the South and West. Half were in three states: Arizona, California, and Michigan. Almost another quarter were in four other states: Colorado, Florida, North Carolina, and Texas. While the number of charter schools has increased rapidly since 1991, these schools represented only about 0.5% of public school students in charter states during the 1996-1997 school year (RPP International, 1998). It is unclear how many were in rural areas.

powered by Google College Attorneys as Advocates for AOD Prevention by Joel Epstein Too often, the word from the general counsel’s office is that if an institution of higher education (IHE) takes a "hands-off" approach, no one can hold it liable for injuries or damages that occur as a result of alcohol or other drug use on campus or at an off-campus school event. Times have changed. Having an alcohol and other drug (AOD) policy is mandated by federal law and may in fact help insulate schools from liability. The Drug-Free Schools and Communities Act Amendments (DFSCA) of 1989 and accompanying regulations require IHEs to adopt and enforce policies prohibiting unlawful AOD use. Nonetheless, many college and university administrators continue to fear that creating an AOD prevention program will expose their schools to liability. Such concerns appear to stem from a misunderstanding of the regulations and of U.S. tort law (the law of wrongful acts). IHEs can and should design AOD prevention programs that fully comply with the law and also minimize the risk of institutional liability. U.S. tort law concepts of duty complement the DFSCA regulations as the background against which colleges and universities must assess their approach to AOD prevention. According to Barbara Bennett, Esq., former associate general counsel for Vanderbilt University, IHE legal duties include the duty to supervise new or inexperienced students. If a school neglects to perform such duties with reasonable care, its negligence may result in liability.

Arizona Becomes 33rd State to Adopt Massage Regulations
Arizona has become the 33rd state to pass massage therapy legislation. Senate Bill (SB) 1103, sponsored by Sen. Carolyn Allen, et al., was signed on May 12, 2003 by Governor Janet Napolitano, and will be formally introduced into law on July 1, 2004. Elements of the bill could potentially assist massage therapists who have experienced difficulties practicing massage in multiple jurisdictions. Currently, individual municipalities have their own massage regulations, some of which contradict one another; this makes it difficult for massage therapists to work in more than one city. The Arizona House of Representatives cites this example: "... a massage/bodywork therapist practicing in Phoenix only needs 500 educational hours, while a therapist practicing in Chandler would need 700 educational hours. The cost of a license also varies depending on the municipality." Statewide licensure will require that all applicants meet the same criteria. Applicants will initially be required to complete a minimum of 500 hours of massage therapy education; pass a board-approved examination; and supply a complete set of fingerprints for state and federal background checks.
