    A copy of the amicus brief is available in PDF format, which can be read with a free copy of Adobe's Acrobat Reader . A Spanish version of the Amicus Brief is currently being translated by CEDHA. A Spanish version of this press release is also available. The Center for International Environmental Law (CIEL) and the Center for Human Rights and Environment (CEDHA) filed an amicus brief (or "friend of the court" brief) at the Inter-American Commission on Human Rights on behalf of the Wichi and four other indigenous communities in northern Argentina. The brief asks the Commission to grant precautionary measures to halt further development until the government of Argentina prepares an environmental impact assessment and consults with the indigenous peoples threatened by the development. The Wichi and other indigenous communities also have asked the Commission to enforce Argentina’s promise to honor their land claims. A preliminary hearing is scheduled for October 12 th in Washington, DC.

    Marcela Valente BUENOS AIRES, Aug 13 (IPS) - In the latest episode of conflicts over indigenous land rights in Argentina, Kolla Indians in the northwestern province of Salta complained this week that they were brutally beaten by employees of a sugar company that is laying claim to their traditional land. But the Kollas say the company has presented no legal title to the land, where the indigenous community has always lived. Flores, for example, said his grandparents are buried there. The beatings were denounced this week in Buenos Aires by lawmakers sitting on the congressional Human Rights Commission, who accused the owners of the sugar mill of violently attempting to evict the Indians, with no legal authorisation. The Kollas said El Tabacal employees are cutting down the trees around their village, to plant sugar cane.

    Overview There 16 to 20 indigenous groups in Argentina which dwell primarily in the North of the country, bordering Bolivia and Paraguay. The larger groups are the Collas (35,000), the Chiriguanos (15,000), the Tobas (15,000), the Mapuches (40,000), the Guaranies (10,500) of Misiones, and the Wichi (25,000). Further South, about 36,000 Mapuches live in the province of Nequen and Tehuelches, bordering on Chile. There are also varying estimates of Quechua and Quichua speakers in Argentina depending upon seasonal employment. In the Tierra del Fuego, there are also some Selk'namgon people. Quechua is the most widely spoken indigenous language in the northwestern provinces. While there are about 5,000 permanent residents who are Quechua speakers in the province of Jujuy, there have been estimates of about 800,000 Quechua speakers from Bolivia coming to Argentina for employment, including 200,000 temporary laborers, 100,000 looking for work, and 500,000 living in Buenos Aires. Chiringuan, Choroti, Mataco, Mocovi, and Toba are spoken in the Gran Chaco. In Mesopotamia, Guarani is the main language for indigenous people. Mapudungun is spoken in Patagonia, while Yamana, Ona, and Selk'namgon are spoken in Tierra del Fuego.

    Argentina: the struggle of the Kolla people The "yungas" are forest lands that spread along the Andes from northern Argentina to Venezuela, and from an altitude of 500 to 3,000 metres, according to their latitude. From the floristic point of view they belong to the Amazonian Domaine and their typical formation is the so called misty forest. These montain forests maintain high levels of endemism and biodiversity, but they are being threatened by increasing deforestation, especially for crop production. A similar case of conflict is that of the Kolla communities of San Andres, Santa Cruz and Angosto de Parani in the department of Oran who are fighting for the ownership of San Andres Estate. In 1986 San Martin del Tabacal -that became a susidiary of the American company Seabord Corporation- donated those lands to the province of Salta to be handed over to the Kolla. Nevertheless, this was never realized and still in January 1997 the company continued to exploit forests under a special authorization from the Government of Salta. The indigenous communities, as well as Greenpeace Argentina, have denounced this exploitation as unsustainable. Following a brief description of who the region's indigenous peoples are, and of the issues and concerns that face them, this paper presents the broad outlines of a more detailed strategy document that is currently being prepared. Some examples are provided of what the IDB has been doing to respond to its mandate to address the needs of indigenous peoples. It also mentions some of the major challenges that the Bank faces in order to be more effective in fostering the sustainable socioeconomic development of indigenous people.     Second-class citizens in the lands of their ancestors :: 11/10/2002 Ten years ago, on the 500th anniversary of the arrival of the first Europeans in the American continent, the descendants of the continent's indigenous peoples vocally reclaimed their rights and identity. Today, they remain among the most marginalised and poorest communities, discriminated against and often exposed to grave abuses of their fundamental rights, Amnesty International said today.
    The statement came on the eve of the day known as Columbus Day, Día de la Raza or Native American Day in which several countries in the Americas celebrate the continent's multicultural heritage.
    "More than half the countries on the continent recognize the multicultural character of the state and guarantee indigenous rights in their constitutions and legislation. However, this is in stark contrast with the reality faced by the vast majority of indigenous people from Canada, through Central America, down to the very tip of Chile and Argentina, who are often treated as second-class citizens," Amnesty International said.
    "Basic rights of indigenous communities, including the right to land and to cultural identity in the use of language, education and the administration of justice are systematically violated in a variety of countries," the organization added.

The most recent eviction, this time of the Curinanco-Rua Nahualquir family, took place on the 31st May 2004. Benetton’s land holdings in Argentina were acquired from The Southern Argentinian Land Company, whose right to the land title is historically disputed not only by the Mapuche and their lawyers, but also by a rapidly growing Argentinean popular consensus, who would like to see the company and others like it investigated and dissolved. Given the Mapuche claims to the land, Benetton is in direct contravention of the Codes of Conduct of the European Union (Resolution 15/11/99). The land itself, approximately 2.2 million acres in the Patagonian provinces of Neuquen, Rio Negro, Chubut and Santa Cruz was taken from the Mapuche during the violent Desert Campaigns of the late nineteenth century, at the hands of Argentinian colonialists; sold on to British owned Southern Argentinian Land Company; later to an Anonymous company and finally to Benetton.

    Although the new Permanent Forum for Indigenous Peoples was a welcome addition to the United Nations structure that would ensure that indigenous populations had their views heard within the system, certain commitments were needed to make it work effectively, several countries with significant indigenous populations told the Third Committee (Social, Humanitarian and Cultural) this morning.
    It was imperative for the financing of the Forum, some speakers said, to come from a stable revenue stream, like the United Nations' regular budget, to assure the smooth operation of the Forum.  The debate came as the Committee wrapped up two days of discussion surrounding the programme of activities of the International Decade of the World's Indigenous People.
    The Forum was created by a resolution of the Economic and Social Council (ECOSOC) in 2000.  Its first session is scheduled to take place from 6 to 17 May 2002.

    SANTIAGO, Jun 6 (IPS) - The "war on terror",identified in Amnesty International's annual report as a new source of human rights abuses, is threatening to expand to Latin America, targeting indigenous movements that are demanding autonomy and protesting free-market policies and "neo-liberal" globalisation.
    In the United States "there is a perception of indigenous activists as destabilizing elements and terrorists," and their demands and activism have begun to be cast in a criminal light, lawyer José Aylwin, with the Institute of Indigenous Studies at the University of the Border in Temuco (670 km south of the Chilean capital), told IPS. Pedro Cayuqueo, director of the Mapuche newspaper Azkintuwe, also from the city of Temuco, wrote that the growing indigenous activism in Latin America and Islamic radicalism are both depicted as threats to the security and hegemony of the United States in the "Global Trends 2020 - Mapping the Global Future" study by the U.S. National Intelligence Council (NIC). NIC works with 13 government agencies, including the CIA (Central Intelligence Agency), and is advised by experts from the United States and other countries.
