The Federal Animal Welfare Act The Animal Welfare Act
The Animal Welfare Act (AWA) is the federal law that governs the humane care, handling, treatment, and transportation of animals used in laboratories. Contrary to popular belief, it does not prohibit any experiment, no matter how painful or useless; it simply sets minimum housing and maintenance standards for confined animals. The Animal Welfare Act act also covers dealers who sell animals to laboratories, animal exhibitors, carriers, and intermediate handlers, dog and cat breeders, puppy mills, zoos, circuses, roadside menageries, and transporters of animals. However, it specifically excludes retail pet stores, state and county fairs, livestock shows, rodeos, purebred dog and cat shows, and "fairs and exhibitions intended to advance agricultural arts and sciences."
Fines and/or terms of imprisonment are listed as penalties for violations of the act.
Species Covered by the Animal Welfare Act
Technically, the act covers any "live or dead dog, cat, nonhuman primate, guinea pig, hamster, rabbit, or any other warm-blooded animal, which (sic) is being used, or is intended for use for research, teaching, testing, experimentation, or exhibition purposes." The United States Department of Agriculture (USDA)
interprets the act to exclude birds, rats, and mice bred for research, and horses and other farm animals, such as livestock and poultry, used or intended for use as food or fiber. Horses and other farm animals are covered if they are used in experiments, but equines are now specifically denied coverage if they are used in entertainment events such as rodeo or mule-diving.

I recently readand was much dismayedby an article on the subject of "pitbulls" by Naomi Lakritz in the Calgary Herald . As a dog owner (originally from the US and living for some years in the Netherlands), I find very worrisome any call anywhere for Breed Specific Legislation, and as the owner of a Staffordshire Bull Terrier, which is often placed under the "pitbull" rubric, these worries become quite personal.
I am as well a writer and a historian, and I find it disturbing that Ms. Lakritz apparently did little research in producing what must be characterized as an inflammatory and demagogic piece. I have no problem with journalism based upon personal opinion; in fact having been publishing art and culture criticism for nearly 15 years a good part of my own writing is necessarily the expression of a very personal point-of-view.

If such a measure is allowed to pass, it will establish a very dangerous model for other cities and states to follow. Help is needed immediately from fanciers particularly West Hollywood residentsto fight this proposal. It is critical that city officials hear from residents!

Attention California fanciers! At their meeting this evening, the West Hollywood City Council will consider asking the City Attorney to draft an ordinance banning ear cropping, tail docking, debarking, and other non-therapeutic procedures.
The American Kennel Club recognizes that ear cropping and tail docking, as described in certain breed standards, is an acceptable practice integral to defining and preserving breed character and/or enhancing good health. Appropriate veterinary care should be provided. We further believe that responsible dog owners, in consultation with their veterinarian, should have the right to make decisions about proper care and treatment for their pets—not the government.

    As a nonprofit dog rescue charity dedicated to helping Saluki hounds in distress we are very concerned that this bill will, in fact, put an end to bona fide rescue services that currently help countless dogs nationwide. At STOLA we work with humane societies and shelters in finding appropriate homes for purebred Saluki hounds who have very specific medical, training and housing needs. We provide them with needed veterinary medical care, spay/neuter, socialization, grooming
    and retraining as needed prior to placing them in carefully screened adoptive homes. In this way we are able to take some burden off government sponsored humane shelters and to ensure that this very special breed of dog gets the care it requires and deserves. Salukis are thought to be the worlds first domesticated dog, dating back at least 6000 years in their present form, and long time companions to people. Salukis have several different medical readings from other breeds including thyroid, heart issues, and a tendency to die easily
    from anesthesia. Regarding behavior issues they are very sensitive and intelligent dogs who display some attributes of catlike behavior so they do require special understanding. As a group dedicated to their specific needs we can provide for them far better than any organization doing multiple breed rescue. For this reason we are very concerned that the PAWS bill will put an end to breed specific rescue as we know it because it effectively discriminates against charitable rescue organizations.     I turn to what might be called the politically opportune parts of this legislation that is, the breed-specific aspects. In creating this legislation the government is treading a path which other governments around the world have tried and failed at. Around the world breed-specific legislation has a sad and sorry history. I understand the reasons for it, and I do not question the motives of people who promote breed-specific legislation. However, I question the effectiveness of it, the research that led to the decision and the minister's own commitment to it, despite the fact that the Premier made a rash statement on public radio one morning about a sad and tragic event. It is the sort of knee-jerk political reaction that results in bad law, and as time passes it will be shown to be ineffective law. The bill introduces breed-specific legislation in a fairly underhand and tricky way. It does not attempt to define breeds, although nominally it is aimed at four specific breeds. They are referred to in the advisory notes to the bill as the dogo Argentino, the fila Brasileiro, the Japanese tosa, and the American pit bull terrier. The bill simply says that all the dogs that the commonwealth bans for importing into Australia are declared restricted breed dogs in Victoria. Once a dog is a restricted breed dog then certain conditions apply to its ownership, control, management and registration, and certain penalties apply for breaches of those requirements.

    Insurance companies dropping home insurance coverage for owners of large dog breeds Shushu, a 9-year-old spayed Dalmatian, is a favorite playmate for the children in her Randolph, Mass., neighborhood and a regular blood donor at the Massachusetts Society for the Prevention of Cruelty to Animals. "She's a lovable dog," said her owner, Barbara Mersal, an MSPCA employee. "I've never had a problem." So, Mersal was shocked when she received a letter from her homeowners insurance company informing her she was being dropped because of Shushu. The dog, the company argued, was a breed that would no longer be covered. Mersal's decade-long relationship with the company would end because of a beloved dog. Mersal is not alone. Many insurance companies are looking to cut costs by excluding owners of large breed dogs from homeowners insurance plans. Breeds that have been targeted include pit bull-type dogs, Rottweilers, Doberman Pinschers, Chow Chows, Akitas, Siberian Huskies, and German Shepherd Dogs, and in some cases, even Dalmatians and Boxers. Insurance companies defend the breed-specific measures, saying that dog bite injuries account for more than one-third of all liability claims against homeowners insurance. These claims cost the industry $310 million in 2001, according to the Insurance Information Institute.
