HSLDA News January 24, 2002 Alaska Charter School "Benefits" May Have Strings Attached Proposed new regulations in Alaska are proving the arguments that government strings are always attached to governmental benefits, and that home schooling families who accept government money may face significant new restrictions on their home school programs. Because of questionable expenditures of state money by some virtual home schools (known in Alaska as "public school correspondence home schools"), the Alaska Department of Education is considering new rules to restrict the funding. Several Alaska school districts have initiated programs allowing home schoolers to enroll in public correspondence programs and receive some state funding. The best known is Galena School District's Interior Distance Education of Alaska (IDEA) program. Parents who enroll their children in IDEA are subject to certain restrictions and requirements not imposed on those conducting home education under Alaska's excellent law. For example, students in grades 4 or 7 must take the California Achievement Test 5 administered by a certified teacher who is approved by the school district. In addition, IDEA requires 3rd, 6th, and 8th graders to take the Alaska Benchmark Examinations in reading, writing, and math, although state law does not require this of home schoolers yet. Students must also pass the High School Graduation Qualifying Examination in order to receive a high school diploma. Further evaluation of these students requires parents to report the progress of each child to Galena School District every semester.

Sec. 14.56.300. Library assistance grant fund.
There is established in the department a library assistance grant fund. From legislative appropriations to the fund, the department shall make grants to eligible libraries for public library operations, for interlibrary cooperation, or for regional library services.
Sec. 14.56.310. Eligibility.

  • is a nonprofit corporation and holds meetings of its board of directors in public; provides services listed in AS 14.56.400 (a); and is approved to receive grants under AS 14.56.300 by resolution of the governing body of that municipality; libraries sharing resources free of charge with other libraries in the state; and libraries providing regional library services. A library described in (a)(1) of this section is eligible for a public library assistance grant. A library described in (a)(2) of this section is eligible for an interlibrary cooperation assistance grant. A library described in (a)(3) of this section is eligible for a regional library services assistance grant.

    History and Introduction
    The laws of our country guarantee a free appropriate public education to all children. Despite these laws, for many years children with disabilities were often denied access to public education. It wasn't until the early 1970s, when parents filed lawsuits in federal court, that courts began to recognize that children with disabilities were not being offered the benefits of public education. This led to the passage of several laws that specifically addressed education rights for children with disabilities. In 1973, Section 504 of the Rehabilitation Act was passed. This Act prohibited entities receiving federal funds from discriminating on the basis of disability. School districts receiving federal funds were required to provide a free appropriate public education to all children, including children with disabilities. Yet, despite the clear language and intent of Section 504, children with disabilities continued to be excluded from schools. In 1974, Congress passed the Family Educational Rights and Privacy Act (FERPA) . This act protects the privacy and confidentiality of student records. It also provides parental access to their child's educational records and rights regarding the amendment and destruction of these records.

    Cutthroat Trout This information was produced with cooperation from The Alaska Department of Fish and Game, Division of Sport Fish and Trout Unlimited Cutthroat trout! Highly prized, these sport fish are found year-round in streams and lakes throughout southeast Alaska. But declining harvests and decreasing numbers of trophy-size cutthroat in waters known for these large and very special fish have many anglers concerned. Abundance Two types of cutthroat trout inhabit southeast Alaska waters: resident and sea-run (anadromous). Studies indicate that both grow slowly and that their numbers are relatively small. Resident stocks - found mainly in lakes and above barriers in some streams - spend their entire life in fresh water. Sea-run cutthroat typically reside in lakes during the winter and migrate early in the spring to feed in salt water. They move back into lakes for the fall and winter. Only 8 inches long by the time they are 4 years old, cutthroat take at least 12 years to reach the 3-pound trophy size (20 inches) in lakes. In sea-run systems, cutthroat grow to about 16 inches in 10 years. Catchable-size resident cutthroat average 2,000 to 4,000 per lake, whereas sea-run cutthroat numbers are fewer, with only 200 to 2,000 fish in most systems.

    Indian/Alaska Native Tribes and Indian Organizations The President's Memorandum of April 29, 1994, titled, "Government-to-Government Relationship with Native American Tribal Governments" that was sent to the heads of executive departments and agencies reaffirmed the unique relationship between the U.S. Government and Native American Tribal Governments as stated in the Constitution, treaties, statutes and court decisions and directed each executive department and agency to consult with tribal governments prior to taking actions that affect them. The Domestic Policy Council (DPC) Working Group on Indian Affairs, chaired by Secretary Babbitt, has requested that each Department develop its own operational definition of "consultation" with Indian tribes to meet the requirements of both the Indian Self-Determination and Educational Assistance Act, Public Law 93-638, and the President's Memorandum. I know all of you share with me a commitment to ensure that the intent and spirit of the President's Memorandum is fully embraced in the Consultation process that we are implementing.
